For residents of large cities, noise is part of everyday life. But in order to relax after a working day, as well as to get a good night’s sleep, silence is necessary. Similar legislation is being adopted at both the federal and local levels.
In the Moscow region there is a regional law dated March 7, 2014 No. 16/2014-OZ “On ensuring peace and quiet for citizens in the Moscow region.” It is popularly known as the law on silence in the Moscow region. Since January 1, 2021, the official text of this legal document has not changed. The latest amendments to the law are dated April 4, 2020. It is mandatory to comply with the regional silence regime both on weekends and on weekdays.

Exceptions to the law on silence
In the official text of the legal act there is a list of actions that the law does not consider violations. Accordingly, liability in the described cases is not provided for by law. The text of the law states that it will not be a violation if an individual or legal entity:
- prevents crime;
- eliminates the emergency and its consequences;
- carries out emergency work at life support facilities.
Also, the following will not be recognized as violations of the law in 2021:
- Mass city events.
- Religious celebrations.
- Cultural and sporting events.
- Carrying out cleaning work on the territory of the municipality in summer and winter (these changes came into force on June 13, 2021).

How much noise can you make in the Moscow region?
The current version of the law on silence in the Moscow region, starting January 1, 2022, allows making noise on weekdays from 8 a.m. to 9 p.m. On weekends (Saturday, Sunday, holidays) it is permissible to be loud from 10 a.m. to 10 p.m.

But according to the law there is also a quiet hour. This is the quiet time from 13:00 to 15:00. It applies to:
- listening to music loudly;

However, we all live in a society and are surrounded by people. Despite the rules of conduct under noise legislation, you should also simply humanly critically evaluate your actions.
If the music screams from the stereo system in such a way that it is understandable without additional measurements, then you should make it quieter. And if repair work is being carried out, then drilling can be moved from Saturday to weekdays.
This approach to the law on silence will help maintain friendly relationships with residents of the apartment building. Excessive noise and loud music will not cause a showdown.
What actions are considered a violation of silence by law?
In accordance with Art. 2 of the Law, the following actions are considered violations of silence:
- use of sound-reproducing devices at any objects;
- screaming, singing, playing musical instruments, performing work using technical and mechanical equipment.
Violations are not actions that, although falling within the specified characteristics, are committed for the purposes of:
- combating crimes;
- prevention of accidents and natural disasters;
- liquidation of accidents, natural disasters and their consequences;
- preventing other force majeure circumstances and eliminating their consequences;
- ensuring personal or public safety;
- ensuring the functioning of life support facilities for the population;
- cleaning the area.
Mass events, for example, sports and cultural events, rituals and ceremonies, can also lead to violations of silence on weekdays and weekends, but are not covered by the law and do not constitute an offense.

The right of citizens to rest in the Moscow region is protected by the regional “Law on Silence” adopted in 2014 (OZ No. 16). - Call a specialist from Rospotrebnadzor to take noise measurements. If the sounds are louder than the level required by 52-FZ, then an act will be drawn up. On its basis, it will be possible to go to court to make a decision on the fact of violation of the law.
- Contact the local police officer. He will be obliged to react. Then he will have to visit the noisy residents and have a preventive conversation with them. An apartment with noisy tenants who are constantly drilling, doing repairs or playing music at times not allowed by law may be registered.

If neighbors regularly incite peace, citizens have the opportunity to turn to law enforcement agencies to protect their rights to rest. To record the fact of a violation, you will need to measure the noise level. This can be done in two ways:
- Independently, using programs installed on your computer or smartphone. There are special applications that measure sound levels in decibels. You need to take measurements and save a screenshot of the results. At the same time, you need to record loud sounds on a voice recorder and make a video in the apartment during the noise. Police officers who arrive on call can:

- force you to write an explanatory note;

Russian Federation standards establish acceptable noise parameters in apartments and adjacent areas. At night, their level in the apartment cannot be more than 45 dB, near the apartment building - no more than 60. During the day, the value of these parameters is higher. For indoors – 55 dB, on the street near the house – 70 dB.
All this is spelled out in sanitary standards, which are referred to by Decree 52-FZ. This is the basic law that should be relied upon if there is no regional legislative act in any subject on the regime of silence.
What is considered noise today?
SanPiN specifies the permissible sound volume for apartment buildings and adjacent areas. According to these standards, the noise level during the day in rooms and apartments should not exceed 55 dB, and in areas adjacent to houses - 70 dB. At night, these indicators decrease by 10 dB each, i.e. 45 in apartments and 60 dB in courtyards.
For comparison:
- volume of human speech - 40 dB;
- the sound of a child crying - 70-80 dB;
- dog barking 60-70 dB;
- vacuum cleaner noise - 75 dB;
- scream - 90-110 dB
- car alarm siren - 100 dB;
- the sound of a working drill or hammer drill - 95-115 dB.

Any sounds exceeding the permissible volume level according to SanPiN are considered a violation.

It is still unknown when the issues of peace and quiet will be resolved at the federal level. Local authorities will have to bring regional laws into line with federal ones, but for now they are in full force.

- From Mon. By Fri. It is allowed to exceed the permissible noise level from 8:00 to 21:00.
- On weekends from 10:00 to 22:00.
At the same time, Sunday is also included in the list of days allowed for repair work. The interval is maintained from 13:00 to 15:00 - a mandatory stop to noise and any work being carried out.
Where to complain about violators
What to do if the established quiet regime is constantly violated nearby? Come to terms with it or start fighting for silence. Moreover, the issue can be resolved peacefully without the involvement of law enforcement agencies, but in some cases the matter comes to court.
Possible directions for filing a complaint are given below:
- Neighbours. First of all, contact the violators themselves with a request to maintain silence. It is quite possible that the neighbors understand the illegality of their actions, but due to insurmountable circumstances they are temporarily unable to behave within the law. And they will ask you to be patient for 1-2 days. In 90% of cases, it is possible to come to an agreement with the neighbors.
- Police. If the conversation has no effect, contact law enforcement. To record a violation, you will need a police squad. After the call, the police will draw up a report, which will be handed over to the local police officer. Further, he himself will carry out the work of maintaining order. The duties of the district police officer include visiting violators and conducting a preventive conversation. Often this measure is quite enough to restore silence.
- Management Company. In cases where previous measures do not bring results, write a complaint to the management organization. Attach to it a copy of the offense report drawn up by the police and a certificate issued by the local police officer confirming the work done. Such treatment does not bode well for violators - the Criminal Code has the right to file a lawsuit and, after a hearing, carry out an eviction.
- Rospotrebnadzor . This method is suitable for collective applications. If several apartments regularly suffer from noise emitted by one tenant, they can count on a full-fledged examination from Rospotrebnadzor, following a collective complaint.
Employees of the organization are required to conduct an examination by arriving at the hours specified by the applicants with special instruments. They take measurements, inspect the premises and draw up a report. During court hearings, it will be 100% proof of the offender’s guilt.

In different regions, the law affects cottage communities and even gardening associations. But this is at the discretion of the authorities, but maintaining silence in an apartment building is mandatory for all residents and tenants of residential premises.

On Saturday, the ban applies to night hours - from 10 pm to 10 am. Some regions add 2-3 daily hours of silence to this period.
The law also provides for exceptions. Noise will not violate the law if:
- carried out during official public events of various types (religious, sports, etc.);
- caused by emergency work;
- was a consequence of other actions that did not go beyond the legal framework.

- 21.00-8.00;

At night, silence is mandatory for everyone without exception. The limit is 45 dB. That is, any sounds louder than normal conversational speech will be considered violations.
Noise in the apartment during the daytime
During the daytime, a slight excess of noise is allowed. But on Sundays and holidays, activities that cause noise are prohibited. On Saturday, the restrictions are more relaxed, but they still exist - you can’t make noise earlier than 10 am and later than ten pm.
In some regions, the ban also applies from 1 pm to 3 pm.
Allowable time for noisy work in an apartment
The noisiest jobs are renovations. On weekdays they are prohibited from 7 pm to 9 am. Local authorities often extend the evening border until 10 pm.
There is also a special regime for the removal of waste generated during the repair process. This is allowed from 8 am until 10 pm.
During the lunch period there is also a kind of “quiet hour”. It lasts 2-3 hours, during which absolute silence is required.
Important! Although construction crews can work during the day without fear of breaking the law, they need to keep track of the clock. If the sound produced by the instruments does not stop for 6 hours, you need to stop and take a short break. This rule is fixed at the legislative level.

- preventing the commission of illegal, criminal actions;
- liquidation of emergencies and emergencies;
- carrying out work related to ensuring the well-being of citizens;

- carrying out cleaning of the municipal territory (last amendments on this issue were made on June 13, 2019).

There are measures of liability as such at the federal level (Articles 6.3, 6.4 of the Code of Administrative Offenses of the Russian Federation) and in the administrative code of the Moscow Region (Article 3.1).

- An individual entrepreneur will suffer in the amount of 50,000 rubles;
- The organization will incur expenses from 100,000 to 150,000 rubles.
As a result, the company can pay a total of up to 280,000 rubles in fines to the budget within 1 year.
