Rules for using maternity capital for house reconstruction

Maternity capital has been used as a form of support for families with children since 2007; it is a special certificate that guarantees the payment of a certain amount of money. Since then, legislators have continually improved its use and expanded the capabilities of certificate holders.

The legal basis for using capital for the purpose of reconstructing houses is regulated by two government regulations.

Government Resolution No. 937 dated November 27, 2010. According to the document, financial resources can be used for the reconstruction of housing without the involvement of construction organizations (legal entities). Government Resolution No. 141 dated February 14, 2020. The regulatory act allows the transfer of funds under an agreement between a person and a company to an escrow account.

It is important to know! As a result of the reconstruction, the living space should increase; for this, extensions can be made to the house, or the attic can be converted into an attic space. Repair of windows, roofing, etc. is not considered reconstruction and is not paid for from maternity capital funds.

Important changes from 2020

From the very beginning of the program, the subsidy parameters changed only in terms of indexation. If initially the conditions for the use of maternity capital assumed its amount to be 250,000 rubles, then it gradually increased due to indexation. As a result, in 2021 the amount reached 466,000 rubles.

Until the beginning of 2021, maternity capital was provided to families in which a second or subsequent child was born or adopted. As soon as the right to a subsidy has arisen, the family can apply to the Pension Fund and receive the appropriate certificate. Once the child reaches three years of age, the maternity capital can be used to improve living conditions.

Important changes have emerged in 2021. At the initiative of the President of the Russian Federation, subsidies have undergone major changes for the better. Since the beginning of the year, new standards have been introduced:

  • Maternity capital is available to families starting with their first child. We are talking about children born from January 1, 2021 inclusive. The amount of the subsidy in this case remains the same;
  • if a second or subsequent child is born in this family, the amount of capital increases by 150,000 rubles. If the subsidy was previously received, the family still receives these 150,000. If not, they are added to the 466,000 not previously received;
  • if a third child is born in this family, she also receives money from the state - 450,000, which can be used to pay off the mortgage loan.
  • the program has been extended until 2026 inclusive.

Acceptance of documents for maternity capital for the first child will begin in the spring of 2021, and the Pension Fund will still be in charge of the matter.

In general, the subsidy can be used for other purposes. For example, for the education of children or transfer funds to the mother’s retirement savings account. But most citizens still use maternity capital to expand their living space or purchase new housing with the addition of their own or mortgage funds.

  • purchase of a residential building or apartment;
  • construction of a residential building;
  • reconstruction of a residential building;
  • using funds for full or partial early repayment of an existing mortgage loan;
  • use of money to obtain a mortgage loan. Many banks allow you to use maternity capital as a down payment. The property being purchased must be residential.

As you can see, the acquisition of non-residential properties is not provided. If you want to buy a plot of land or a dacha with this money, this is impossible. It is also important that the object of purchase can only be located in Russia.

Is it possible to spend maternity capital on renovating an apartment?

According to the law, maternity capital cannot be used for repairs, only for reconstruction of the house. Moreover, due to this action, the area of ​​​​the room should increase, that is, living conditions will improve.

It is almost impossible to direct capital to renovate an apartment in terms of reconstruction; how can you increase the number of square meters in it? Exceptions are apartments on the ground floor, to which a major extension can be built. Of course, everything must be legal and formalized; this is the only way the Pension Fund will allocate funds.

And if we consider whether it is possible to spend maternity capital on home renovation, then this is realistic. Reconstruction with an increase in the area of ​​such an object is easier to do. You can enlarge the house, add a floor. As a result, government money will help make the house bigger.

Installation of gas, sewerage, water supply, heating, installation of windows and doors - all this is not included in the concept of reconstruction.

The use of maternity capital to improve housing conditions will proceed as follows:

  1. First you need to obtain a certificate for maternity capital. It can be registered with the Pension Fund immediately after the birth of the child and the corresponding right arises. But in general there is no need to rush; you can submit your application much later.
  2. Search for real estate. It is imperative to warn the seller that maternal capital will be raised. The fact is that after concluding a deal, he will receive the money only after the Pension Fund has verified the documents, that is, after 1-2 months.
  3. Conclusion of a purchase and sale agreement, its registration in Rosreestr.
  4. After receiving the certificates of ownership and the purchase agreement, the citizen (usually the mother) goes to the Pension Fund to write an application and attaches the details of the seller’s current account to it.
