How to register ownership of non-residential premises in the Moscow region


Personal account features

A personal account in Rosreestr is needed mainly to obtain timely information on property objects. Here, using a simplified procedure, you can order the Unified State Register or an extract from it, as well as make changes to it if the document has inaccuracies. You can also view information on the characteristics of land ownership. In addition to the listed functions, the user has the opportunity to make an appointment at any branch of Rosreestr. The ordered appointment ticket will indicate the date and time for the consultation.

Deadline for registration actions

The deadlines for registration actions are established by Part 1 of Art. 16 of Law 218-FZ and depend on the method of submitting the application and documents, the specifics of the transaction itself and its form. The following deadlines apply to registering the transfer of ownership on the basis of real estate purchase and sale agreements:

  • as a general rule, 7 or 9 days, depending on whether the documents are sent directly to Rosreestr or first to the MFC, respectively (clauses 1 and 2, part 1);
  • for transactions that have undergone the notarization procedure - 3 days when submitting documents to the Rosreestr department directly and 5 days when sending them through the MFC (clauses 9 and 10, part 1);
  • in case of filing an electronic application for transactions that have a notarial form, the registration period is 1 day (clause 9, part 1);
  • if a mortgage is registered, then the period is 5 and 7 working days from the moment the documents are received by the registration authority or multifunctional center, respectively (clauses 11 and 12, part 1).

Registration in the personal account of Rosreestr

Registration with Rosreestr is carried out through the government services portal, but this does not require going to another website. It is enough to open the form to log into your personal account from Rosreestr and the user will automatically be redirected to the desired resource. If you already have an account on the government services portal, registration with Rosreestr is not required.

If there is no profile on the portal, the user should indicate his name, mobile phone and email. After the first stage of registration, new pages will gradually open for the user to fill out. In addition to the password, you will need to provide SNILS and passport information. Attention! Registration on the portal is completed successfully only after the information on identity documents has been verified. Information about the results of the verification is sent by email, after which you will need to additionally confirm your identity with an enhanced electronic signature or by personally contacting the service center. In the latter case, the user will receive a code to complete the registration procedure on the government services portal.

Required package of documents

In addition to the application for registration under a contract for the sale and purchase of real estate of transfer of rights, other documents that are annexed to the application must also be sent to the registration authority. Their absence is grounds for refusal of registration or its suspension. When submitting documents, the applicant presents an identification document (Parts 8 and 9 of Article 18 of Law 218-FZ), and to the necessary attachments Part 4 of Art. 18 of Law 218-FZ refers to:

  • confirmation of authority if another person acts on behalf of the buyer or seller;
  • a document confirming the existence of grounds for making a corresponding entry in the register (in this case, this is a purchase and sale agreement);
  • a receipt confirming payment of the registration fee (this document is not mandatory, but in practice is encouraged).

Rosreestr authorities do not have the right to request any other documents on the basis of Part 5 of this norm. In this case, at their discretion, the parties may submit additional documents (for example, a document establishing a description of the location of the property in the absence of an exact address). However, it is the right of the parties, and not their obligation, to provide all necessary documentation, in addition to that listed in Art. 18 of Law 218-FZ, Rosreestr employees must obtain independently by sending an interdepartmental request to the relevant state or regional body.

Authorization in your personal account

Login to your personal account is carried out in several ways:

  • According to SNILS, which acts as a login;
  • By email or mobile phone, which can also be specified as a login;
  • By electronic signature.

In the first two cases, the user is also required to enter a password. It will be identical for both authorization methods, since only one password is approved by the subscriber during registration. Logging in electronically is the most secure method that allows you to avoid account hacking. However, this requires either having the signature in the device's memory or on removable media. Additionally, you will need to install some plugins for the equipment to correctly perceive information.

Registration fee

The performance of legally significant actions by the divisions of Rosreestr to register the purchase and sale of real estate (transfer of ownership of an immovable thing) requires the applicant to pay the appropriate fee. This obligation of applicants is enshrined in Art. 17 of Law 218-FZ, and the amount of the duty is specified in Art. 333.33 of the Internal Revenue Code.

Based on sub. 22 clause 1 art. 333.33 of the Tax Code of the Russian Federation, as a general rule, for registration of ownership of real estate arising as a result of a transaction for the purchase and sale of such property, applicants will have to pay 2,000 and 22,000 rubles for individuals and legal entities, respectively.

At the same time, there are some special cases when the amount of the duty differs from that indicated:

  • when registering the transfer of ownership of the enterprise as a property complex to the applicant, according to subpara. 22 of the mentioned norm, you must pay to the treasury an amount equal to 0.1% of the value of all transferred assets (the maximum amount is limited to 60,000 rubles):
  • for registration of the right to a share, the fee will be only 200 rubles;
  • There are also some other special rules.

Mobile application of Rosreestr

Although Rosreestr’s personal account is serviced by the government services portal, there is a separate mobile application for Android and iOS. It's called Kadastr.ru. Unfortunately, this application is not a replacement for the user's personal account. However, with its help you can view information on objects, their value, and property characteristics. This is practically the same functionality that is offered in your personal account. The downside is the inability to make an appointment or conveniently search for your own facilities.

Where changes are made to the Unified State Register of Real Estate

Where are changes made to the Unified State Register? Subjects can contact the following authorities:

  1. Federal Service for State Registration, Cadastre and Cartography.
  2. Multifunctional center (MFC).
  3. Court (if the authorities are higher, they refused)

If representatives of the State Register do not want to register adjustments or make changes to the area in the Unified State Register, the subject has the right to go to court, having the decision of the authority in hand to re-apply to the above-mentioned bodies.

Personal account management Rosreestr

In the personal account of the cadastral engineer there is a user manual, which contains instructions for performing all actions. The main active operation is making an appointment, which is carried out in the appropriate section. In the “Make an Appointment” section, you must fill in all empty fields. When selecting a Rosreestr department, the user is provided with a list of all available departments with their work schedule and the ability to register. You must select a department at a specific address. After this, the time is adjusted. The exact time of reception is not indicated, but the time period.

To make an appointment, you also need to provide your own information, including real estate information. If you have a question about an apartment, the address must indicate its number. The completed entry is issued in the form of a coupon with a number. If necessary, you can always mark an appointment in your personal account.

The sections “My balance”, “My tasks” and “My statistics” are specific sections for use only by cadastral engineers. For example, in the “My Balance” tab you can view your current account, top it up and use it to pay for paid services, such as registration or extract from the Unified State Register.

In what cases is it necessary to enter information into the Unified State Register of Real Estate?

Any residential property must be registered and undergo state registration. After registration, the information is stored in the database of the Federal Service for State Registration, Cadastre and Cartography. Making changes to the USRN data indicates that the previous information is no longer relevant.

Correction of information depends on who is the owner - an individual or a legal entity.

In what cases is it necessary to make changes to the Unified State Register if the owner is an individual (grounds for making changes to the Unified State Register):

  1. After planning, changes to the Unified State Register are inevitable.
  2. Construction. The subject owns the land plot and plans to build a structure on it.
  3. Purchase and sale, donation, transfer of residential property for rent.
  4. New data. The owner received a new passport and changed his last name.
  5. Errors. During the documentation check, errors and inaccurate data were found.
  6. Pledge or encumbrance.

When changing the type of real estate, liquidation and other circumstances, you need to contact Rosreestr to make changes to the Unified State Register.

Information about an object owned by an organization remains relevant until amendments are made.

Making changes to the Unified State Register for legal entities is appropriate in the following situations:

  1. New address. The company is registered at a new address.
  2. New name.
  3. Change in area - increase or decrease in square meters legally assigned to the organization.
  4. Change of location - another city.

If a legal entity acquires the right to a different type of real estate, data adjustment is required. For example, receiving an object by inheritance, removing encumbrances.

Application for registration

In order to receive the state service of registering the transfer of ownership, it is necessary to draw up a corresponding application. It has a form approved by order of the Ministry of Economic Development dated December 8, 2017 No. 920 (with subsequent amendments). The form of this document is posted on the official website of Rosreestr, where it can be downloaded without any problems.

The approved form is universal for all cases in which this procedure is necessary. In this regard, in the case under consideration, only those sections that relate to the transfer of ownership in connection with a transaction for the alienation of real estate must be completed. Thus, the application must indicate:

  • name of the authority to which the application is submitted;
  • a request to register the right (clause 3.3);
  • object to which rights have been transferred;
  • the need to register the transfer of ownership (clause 6);
  • information about the new owner;
  • method of submitting documents and method of obtaining results;
  • Attached documents;
  • signature of an authorized person.

When filling out an application by the buyer's representative, it is also necessary to enter information about the representative (clauses 8.1.1 and 8.1.2 for individuals and legal entities, respectively).
