How to replace a passport without residence permit and registration in 2021

A passport is the main identification document for a citizen of the Russian Federation. Its absence can cause a lot of inconvenience and problems with the law. To avoid this, it is necessary to follow the requirements of migration legislation, as well as take into account specific features. For example, how a passport is replaced in another city without registration with clarification of the nuances of registration at the MFC, FMS or through State Services - knowledge of the key subtleties will save time, finances and loyal relationships with government agencies.

What types of registration are there and how to obtain them

According to the new edition of Resolution No. 828, a citizen of the country can receive a lost passport or replace an outdated document at the place of application. This means that a new Russian passport can be issued without residence permit or registration. In Russia today there are two types of attachment to a specific place of residence:

  1. Permanent registration differs from temporary registration in that when registering, a person is given a stamp in his or her passport.
  2. Permanent registration is relevant if you have your own home or if you have a relative or spouse who allows you to register in your living space.
  3. Temporary registration is issued for a pre-agreed time period and can be done at a hotel, inn, hostel or even in a hostel.

! The loyalty of the laws in force on the territory of the Russian Federation allows you to have a permanent residence permit at one end of the country and register temporarily at the opposite end. One legal attachment to a certain living space does not exclude the second and does not lead to its cancellation.

The misconception of citizens lies in the impossibility of obtaining a new Russian passport if there is not one of the two types of registration provided for by law. Where to go to replace your passport

To replace your passport, you can contact the Ministry of Internal Affairs (MVD) or the nearest multifunctional MFC center, except in situations where :

  1. A citizen over 18 years of age has not previously received a passport and is applying for one for the first time;
  2. the passport was lost or stolen;
  3. Citizens with limited legal capacity or incapacitated apply for a passport.

If you fall into one of the above cases, you need to contact the territorial division of the Main Directorate of the Ministry of Internal Affairs to replace the document.

Important! Previously, a passport could be obtained from the Federal Migration Service (FMS). From November 2021, this service is abolished!

The procedure for replacing a Russian passport involves paying a state fee of 300 rubles

(initial receipt, replacement of photographs with age, registration after obtaining Russian citizenship). Loss, damage or theft also means the issuance of a new passport, but the state estimates re-issuance for these reasons at a different amount - in this case you will have to pay 1,500 rubles.

Another important circumstance is that a passport without registration will be ready not in 20 days, but in 30. Initial receipt at the age of 14 requires a minimum number of papers:

  • application written on Form 1P;

Reaching 14 years of age is not the only reason to obtain a new passport. Where can I apply for the issuance (replacement) of a passport of a citizen of the Russian Federation?

With an application for the issuance and replacement of a passport of a citizen of the Russian Federation, a citizen has the right to apply directly to the migration department of the territorial body of the Ministry of Internal Affairs of Russia or to the multifunctional center for the provision of state and municipal services or through the Unified Portal of State and Municipal Services.

What documents are required to provide public services?

  • birth certificate;
  • two personal photographs, identical and corresponding to the age of the applicant at the time of filing an application for issuance or replacement of a passport, in black and white or color, 35x45 mm in size with a clear image of the face strictly from the front without a headdress;

Documents submitted by citizens, executed in a foreign language, without duplicating entries in them in the state language of the Russian Federation (Russian), are subject to translation into Russian. In what cases can the acceptance of documents necessary for the provision of the state service of obtaining a passport of a citizen of the Russian Federation, or its issuance, be refused?

The grounds for refusal to accept documents are:

  • the citizen has not reached the age of 14;
  • absence or incompleteness of mandatory information in the application for the issuance or replacement of a passport, as well as if the information in the application for the issuance or replacement of a passport is not readable;
  • Failure to submit one or more documents specified in paragraphs 30 - 34 of the Administrative Regulations, or submission of documents that do not meet the requirements for them;
  • non-compliance of the submitted personal photographs with the requirements provided for in paragraph 38 of the Administrative Regulations;
  • submission by citizens of documents written in a foreign language and not having a corresponding translation into Russian;
  • if the identity of the citizen who applied for the provision of a public service has not been established;
  • When submitting an application for the issuance or replacement of a passport in the form of an electronic document, the application will not be accepted for consideration if:

    — submission by a citizen of a photograph in electronic form that does not meet the requirements established by paragraph 38 of the Administrative Regulations.

    — absence or incompleteness of mandatory information in the application for issuance or replacement of a passport in the form of an electronic document.

    — in the case of filing an application for the issuance (replacement) of a passport through a multifunctional center, the application will not be accepted for consideration by employees of the multifunctional center if a citizen who has reached the age of 14 does not have one of the documents confirming his citizenship of the Russian Federation, defined in subparagraphs “a” ", "b" or "c" of paragraph 1 of Decree of the President of the Russian Federation No. 444.

The grounds for refusal to issue or replace a passport are:

  • the person does not have citizenship of the Russian Federation;
  • inaccurate information specified in the application for the issuance or replacement of a passport in Form No. 1P;
  • lack of information on payment of state duty in the State Information System on state and municipal payments;
  • the citizen has a previously issued valid passport;
  • If a citizen fails to provide a receipt for payment of the state fee, this is grounds for refusal to issue or replace a passport.

What is the amount of state duty charged for the provision of public services?

For the issuance of a passport, a state fee is charged in the amount and procedure established by Article 333.33 of the Tax Code of the Russian Federation, namely:

  • for issuing a passport – 300 rubles;
  • for issuing a passport to replace a lost one or one that has become unusable – 1,500 rubles.

There is no state fee charged for issuing passports to orphans and children without parental care.

Individuals who have suffered as a result of an emergency situation and apply for a passport to replace one that was lost or has become unusable as a result of such an emergency situation are exempt from paying the state fee.

The state fee is applied taking into account a coefficient of 0.7 in the case of filing an application for the issuance (replacement) of a passport and paying the corresponding state fee using the Unified Portal of State and Municipal Services (functions).

The state fee is paid before submitting an application for the provision of a state service.

Payment of the state duty is made by the citizen through credit organizations of the Russian Federation or through payment systems.

In what case is the paid state fee subject to refund?

The paid state fee is subject to partial or full refund in the following cases:

  • refusal to issue a passport in the presence of appropriate circumstances (subparagraph 5 of paragraph 1 of Article 333.40 of the Tax Code of the Russian Federation);
  • payment of state duty in a larger amount than provided for in Chapter 25.3 of the Tax Code of the Russian Federation (subparagraph 1 of paragraph 1 of Article 333.40 of the Tax Code of the Russian Federation);
  • refusal of persons who have paid the state duty to perform a legally significant action before contacting the authorized body to the official performing this legally significant action (subparagraph 4 of paragraph 1 of Article 333.40 of the Tax Code of the Russian Federation).

Applications for the return of overpaid (collected) amounts of state duty must be submitted according to the territorial basis, which is indicated in the payment document in the line “payee.”

At the request of the citizen, during the period of issuing a passport, the employee responsible for accepting documents or an employee of the multifunctional center issues a certificate of acceptance of documents for issuing a passport in any form.

At the request of the citizen, during the period of registration of the passport, the employee responsible for accepting documents issues a temporary identity card of a citizen of the Russian Federation in form No. 2P. In this case, the citizen must submit an additional photograph.

Neither a new passport nor an old one, which does not have a permanent registration stamp, is a document due to which one may be accused of violating the laws. According to the Resolutions of the Ministry of Internal Affairs and the rules in force in 2021, violations are: untimely age replacement of photographs, extraneous marks, even if these are children's drawings. But there is not a word that the absence of a registration stamp is an offense. Obviously, in the 2021 edition, receipt at the place of application was specially added, because otherwise the first two would have been quite sufficient - at the place of temporary registration or permanent registration.

To change your passport in another city, first of all, you should know that there is a difference between the lack of registration at the place of residence and the complete absence of registration.

In the first situation, it is assumed that the citizen lives in the city without registration. He has the right to do this for no more than 90 days; after this period, the person must obtain a temporary registration. Violation of this rule is subject to administrative punishment.

It is important to understand that upon reaching the age of 20 or 45, a citizen is given a period of 1 month to replace the main identity document.

This means that during this time a person must submit documents to the passport office to obtain a new passport.

If a citizen does not have time to do this within the prescribed period, as well as if the document is stolen, lost or worn out, he will be forced to pay a fine. A new passport can be obtained only after it has been redeemed.
