Registration at place of residence or registration

After the adoption of the Law of the Russian Federation of June 25, 1993 No. 5242-1, registration replaced registration.

The main difference is not only in terminology, the procedure itself has been simplified - registration is of a declarative nature.

Regulatory acts establish 2 types of registration:

  • constant,
  • temporary.

Temporary registration is allowed within 90 days of staying in a new place. Moving to a permanent place of residence obliges the citizen to register no later than 7 days later.

When applying for registration in a new place, you can simultaneously deregister at your old address.

Confirmation of the fact of permanent registration of an adult is a stamp in the passport. The minor is issued a certificate of the established form.

Deadlines for consideration of applications

Here the result depends on the organization to which the request is sent. The following rules apply as standard:

  • multifunctional centers - on the day of application, if an extended statement is requested, the issuance period varies from 3 to 7 days;
  • management company – the terms for issuing the certificate are similar to the previous ones;
  • Migration Service - within 30 days, counting from the date of acceptance of the application;
  • Rosreestr – review and issuance periods do not exceed 5 days.

Is it possible to legally obtain information about those registered in an apartment?

In Russia, everyone's right to privacy, personal and family secrets is guaranteed, and the collection, storage, and use of information of this kind is not allowed. This is written in Art. 152.2, as well as in, which establishes the following guarantees for the protection of private information:

  • ensuring confidentiality and security of personal data;
  • informing the citizen about the purposes and methods of providing personal data;
  • mandatory obtaining of a person’s consent to collect information about him;
  • restriction on the transfer of information to third parties without the consent of the citizen.

Thus, either the owner or the tenant can find out who is registered in the apartment.

The data is owned by the management company, homeowners association or the board of a housing cooperative.

Information is prepared, as a rule, in the form of a certificate in Form 9 or an extract from the house register.

When information is requested by a third party, for example, a future home buyer, the owner's consent is required in the form of a notarized power of attorney. After submitting this document, information about who is registered in the house is issued to an authorized person.

In what cases is registration information needed?

A certificate of family composition and everyone registered in the same living space is considered the most common document. It contains data on the date of registration, deregistration and the degree of relationship of family members living in the apartment.

This information is required when:

  • receiving benefits, compensation and allowances;
  • concluding real estate transactions: sale, donation, mortgage;
  • when queuing for new housing;
  • participation in various government programs;
  • going to court;
  • admission to educational institutions:
  • employment.

It is very important to check those registered in the apartment before purchasing, because the real estate market attracts swindlers and scammers.

Before a transaction, future buyers try to control all legal issues, carefully studying the possible consequences of non-standard situations. As a rule, a purchase and sale agreement involves the release of all previously registered property. In this regard, it is necessary to make sure that after the transfer of ownership, those who are registered in the apartment will be able to be discharged without any problems upon purchase.

The right to receive information about registration

A citizen who has nothing to do with owning or renting an apartment has the right to receive registration information only on the basis of a notarized power of attorney, in accordance with Art. 185 of the Civil Code of the Russian Federation. By providing this document, the attorney can personally obtain information about all registered citizens.

You can find out the necessary information for free on the Internet only with the consent of the apartment residents.

In some cases, information about whether a person is registered can be obtained at the request of law enforcement agencies, the court or bailiffs.

The basis for requesting information containing personal data is Art. 13, which states that officials have the right to receive, upon a reasoned request, free of charge, information related to:

  • investigation of criminal cases;
  • consideration of administrative offenses;
  • checking statements and reports of crimes and incidents.

A court inquiry about whether a person is registered can be made on the basis of a petition to obtain evidence in the case received from the plaintiff or defendant.

When concluding a transaction for the purchase and sale of housing, the buyer is most interested in the timely deregistration of the former owners and persons living with them. To avoid problems with checking out tenants in the future, you can check whether the sellers have checked out all family members from the apartment:

  • through the Internet portal of the state register with a request about citizens deregistered;
  • by checking the extract stamp in the passport.

How to find a person by his registration address

There are several options for doing this, but it is unlikely that you will be able to obtain the necessary information on your own. Therefore, in some cases you will have to turn to third parties for help.

Electronic databases

Perhaps this is the only way to find a person by registration. Let us note that, in addition to illegal databases, there are also official sources on the Internet that can help in resolving this issue. These include:

  • tax inspectorate reference books;
  • traffic police bases;
  • online information desks
  • Bailiffs Service;
  • phone and address books.

This option is free, but has three serious drawbacks:

  1. Outdated information is often posted.
  2. The database covers a specific city, and if the locality is unknown, it is impossible to obtain information.
  3. Only information about the owner is indicated; the number of registered persons remains unknown.

Law offices

Human rights defenders are empowered to send requests in the interests of the client to government authorities, including law enforcement agencies. Therefore, through a lawyer it is quite possible to find a person at his registration address. However, you will have to pay for such services, and often the amount requested does not justify the result obtained.

Police

A civilian cannot make a formal request to search for a person through law enforcement agencies, so they will have to act informally. To do this, contact the local inspector at the place of registration of the person you need to find.

The result of such an appeal depends on the human factor: the district police officer is not obliged to do this, but can step into the situation and help the person who has applied.

Social network

Searching for a person by last name and residential address is possible through social networks, but you should not completely trust the information received. Moreover, the method is free, so it deserves attention.

You can motivate a request in different ways: no one will check your true goals. The human factor also comes into play here, but in a positive way. When turning to this method, it is necessary to take into account the fact that the information provided is at the level of unverified rumors: the person living in the apartment may not have a residence permit, and vice versa.

Detective agency

This is the most effective and expensive method. A private detective acts solely in the interests of the client, therefore he obtains the ordered information by any available means.

Government agencies issuing registration information

You can obtain reliable data on those registered and discharged from the apartment at the following government agencies:

  • Passport Office;
  • housing maintenance organization;
  • Multifunctional Center.

As a rule, the owner, tenant or his representative, by proxy, is issued a certificate in Form 9.

With the development of technology, it is easy to find out the number of people registered in an apartment online through paid and free services. In most cases, such information is publicly available and available to any applicant.

Among the official websites of government agencies are the following:

  • issues extracts with information about any addressable object: house, land, possession. Information is provided for a fee;
  • on the website in electronic form, for a fee, you can find out the full name of the apartment owner, the series and number of the registration certificate, the type and date of ownership;
  • You can find out how many people are registered in an apartment only with the consent of those registered;
  • provides information about the citizen’s place of stay or place of residence.

Free access to apartment registration data

According to Art. 5 all information can be divided depending on the order of provision into:

  • confidential,
  • public.

Public information includes only publicly known data. Personal information is protected by Law No. 152 Federal Law dated July 27, 1996, so it is impossible to see who is registered in an apartment via the Internet without notifying these citizens and obtaining their consent.

Article 15-5 of the Russian Federation dated July 27, 1996 No. 149-FZ provides for restricting access to resources on the Internet that process information in violation of confidentiality.

In this regard, it was created, which contains information about taking measures to limit access to information sites that violate laws in the field of personal data. For this reason, it is impossible to find out who is registered in the apartment at the address online.

For the same reason, you should not respond to dubious offers to provide information from information databases for a fee. Most likely, in this case, the customer will receive the same information that can be found in the public domain.

When making a purchase and sale transaction, a gift, or any other transaction where verification is required, the most reliable ways to find out whether a person has checked out of the apartment is to visit the passport office together or receive a certificate of all those registered by power of attorney.

How to find out if a person has been checked out of an apartment online

Although the virtual world has long become familiar, I do not recommend trusting sites with “full databases” or social networks. The first ones are most likely stolen, combined from several sources (telephone database, traffic police and much more), with errors and without updates. On their personal page they don’t write at all whether they managed to check out when they moved. It will not be possible to find reliable information about registration in this way.
