The lack of a deadline in the law for providing police officers with housing will be challenged in the Constitutional Court

The state strives to provide housing for its citizens. At the same time, employees of the Ministry of Internal Affairs are provided with additional guarantees. Their presence makes it possible to take advantage of several benefits options at your discretion. The provision of housing for employees of the Ministry of Internal Affairs and the police is under strict control. In order for the state to provide assistance in purchasing a home, you will need to prepare a package of documents and take a number of actions. We’ll talk further about what benefits can be provided to employees of the Ministry of Internal Affairs, the specifics of obtaining a housing certificate, as well as what social payments for a mortgage are.

Options for benefits for employees of the Ministry of Internal Affairs

The state offers employees of the Ministry of Internal Affairs several options for preferential receipt of real estate. The choice of a suitable person is made independently.

He has the right:

  • Get a municipal apartment. In this situation, housing will be provided on the basis of a social rental agreement. However, this method is only available to citizens who were in line before 2005.
  • Move into service housing. This option is only suitable for district police officers.
  • Receive monthly cash payments. They are provided after issuing the appropriate certificate. The funds received can subsequently be used to purchase housing.

A housing certificate is one of the ways to improve living conditions. This is a document that gives the right to a subsidy. You can use it only once in your life and exclusively for the purchase or construction of housing.

The document is issued to citizens who have worked in the Ministry of Internal Affairs for at least 10 years. Similar conditions apply in the event of a citizen’s dismissal for health reasons or as a result of staff changes, as well as reaching the retirement age. Family members of police officers who died while on duty have similar rights, but only if during their lifetime they were on a waiting list for improved housing conditions.

In this case, it is necessary to take into account such nuances as the submission of an appropriate application by family members of the deceased within the prescribed period. At the same time, spouses who entered into a new official marriage before receiving housing are deprived of this right.

The housing certificate is provided in accordance with the following conditions:

  • A person working for the police lives in an apartment that has been declared unsuitable.
  • Two families live in a one-room apartment.
  • At the time of filing the application, the Ministry of Internal Affairs employee does not have his own housing or other real estate.
  • A police officer lives in a dormitory or communal apartment.
  • A police officer lives in the same building with a chronically ill citizen whose health threatens the well-being of other residents.
  • An employee of the Ministry of Internal Affairs lives with his family in a municipal apartment, the area of ​​which does not meet the established minimum. The legal value of the indicator must be below 15 square meters per person.

Additionally, you will need to prepare a package of documents. It's quite extensive.

The certificate is provided on the basis of the following documentation:

  • statement from a police officer;
  • passport of a citizen working in the police;
  • certificate from the house register;
  • certificate of marriage or divorce, if the employee of the Ministry of Internal Affairs was in an official relationship;
  • personal account statement;
  • documentation for the children of a police officer;
  • documentary evidence of the absence of real estate ownership.

The request and necessary documents are sent to the Ministry of Internal Affairs. Then a special commission meets to make a decision.

After the documents are submitted to the housing commission, the process of considering the request begins. It takes 10 days. During this period of time various checks are carried out. If there are no comments, a positive decision is made. Then records are opened against the police officer.

A person must indicate in advance the desired date for receiving a housing certificate and EDV if he needs compensation.

This is because the request must be submitted on time. Thus, a citizen has the right to submit an application a year before he receives the rights to the certificate. Based on such applications, a queue for benefits is formed. The commission may refuse to provide a subsidy. Such a decision can be made if at least one document is missing, on the basis of which the right to improve living conditions is granted, or if the person has previously used a similar opportunity. Providing false information will also become an obstacle to obtaining housing from the state. If a person needs a housing subsidy for employees of the Ministry of Internal Affairs in 2021, it is better to provide truthful information.

How much is

Funding is provided in different amounts, depending on the region of service and residence of the employee. It is determined by the average prices for apartments and the minimum standard of living space for each citizen. The calculation is based on the cost of 1 sq.m. A coefficient is applied; in Russia in general it is equal to 1.

The standard living space is:

  1. For a single employee – 33 sq.m.
  2. For a family of 2 people – 42 sq.m.
  3. 3 or more members – 18 sq.m. for everyone, including children.

Important!: when applying again for a subsidy if the composition of the employee’s family changes, the living space allocated under the program is not recalculated.

Expert opinion

An employee of the Ministry of Internal Affairs, the Federal Penitentiary Service of the Russian Federation or his family members cannot require additional documents to issue a certificate for participation in the subsidy program. What are social benefits for police officers?

The latest changes to the legislation regulating benefits for representatives of the Ministry of Internal Affairs were made in 2013.
Since then, no adjustments have been made. Most of the benefits for internal affairs employees are reflected in Federal Law No. Among other regulations establishing the rights to preferences for law enforcement officers are:

  • Federal Law No. 247 - established social guarantees for police officers (housing, medical care, benefits and additional payments);
  • Law N 4468-1 - regulates pension payments to former employees of the Ministry of Internal Affairs;
  • RF PP N 1223 - established the conditions for providing financial assistance for the purchase of living space.
  • Resolution of the Council of Ministers N 941 - outlined the conditions for calculating the length of service of police officers.

Under similar conditions, a lump sum payment is issued for the purchase of housing. The decision to provide it is made by the heads of federal executive authorities. In order for an application to be approved, the applicant must meet a number of requirements.

The list of which includes:

  • An employee of the Ministry of Internal Affairs is forced to live in a dormitory or in a communal apartment. In this case, the footage of the living space is not taken into account.
  • A citizen working in the police is not a tenant of the municipality. The rule applies even if the contract is signed to a family member of a police officer.
  • Two or more families live in an adjacent or isolated room. Parents of spouses and minor children who have entered into a legal marriage are taken into account.
  • The number of square meters per resident is less than 15.
  • An employee of the Ministry of Internal Affairs is forced to live in the same living space with a seriously ill or infected person who poses a threat to other persons.

The size of the lump sum payment may vary. It depends on the number of persons who live in the premises with the citizen.

Widows and widowers of institution employees have the right to apply for housing only until they re-enter an official marriage. In such situations, the state does not seek to provide beneficiaries with the property they are entitled to right away. Accommodation is provided slowly. A person must be prepared for the fact that he will have to wait for his turn for decades. Due to rapid waiting, representatives of this category of citizens often lose their rights.
