Drawing up a Premises Inspection Report occurs in different cases: during purchase and sale, rental, repair work, after flooding and other unforeseen force majeure circumstances. The act is drawn up both during the inspection of residential premises and non-residential objects (warehouses, industrial buildings, offices, etc.).

The main reasons for drawing up an act are the need to confirm or refute any harm caused to the premises, or to describe the condition of the premises at a certain point in time without reference to any event.

Why and in what cases is an apartment inspection report needed?

With the help of this document, the condition of the property is recorded. The act can be divided into two main types:

  • Mandatory, issued in situations where inspection cannot be avoided (judicial audits, investigations, etc.);
  • Optional, issued when a company or person transfers an item of property (sale, donation, sale, etc.).

According to practice, in recent years both companies and citizens have been trying to draw up this document.

Who might find the apartment inspection report useful?

The act is a document necessary in case of any disagreements between the parties. So, for example, the act is necessary for the following parties:

  1. Apartment seller . The act will be documentary evidence of the inspection of the real estate. Also, if we consider the acts and their results, the selling party may change the terms of the sale. If the buying party agrees with the document, this will be proof that he, the buyer, is completely satisfied with the condition of the residential property. Therefore, if the buyer makes claims after the transaction, the act will turn into a weighty argument confirming the seller’s side.
  2. Realtor . Based on the act, the realtor will report to the seller, because the document itself indicates data such as the date and time of the inspection. The document also contains information about the buyer. The act is used for the realtor to prove that he was the one who found the buyers.
  3. Buyer . But the buyer does not need the document. The only case of an apartment inspection report may be a situation in which law enforcement agencies contact the owner of the apartment (for example, in the event of a robbery).
  4. Tenant . The tenant will need the document if he plans to return the property to the owner. The act in this case is proof that the premises and its technical condition have not changed in any way.
  5. Landlord . He needs the deed in the case when he will rent out the property. If there is a document, the lessor will be able to personally check after some time what the condition of the real estate remains.

Instructions for writing a premises inspection report

The act is drawn up according to standard office work rules, so it should not cause any special difficulties.

  • In the “header” of the document in the middle, its name is written and the essence is briefly indicated (in this case, “inspection of the premises”), and the locality in which it is being drawn up and the date : day, month (in words), year.
  • Then the composition of the commission that conducts the inspection is entered: the position of each member of the commission, the full name of the organization that he represents, last name, first name, patronymic are indicated.
  • Next, information related to the object itself . Here you need to enter information about its name and purpose, indicate the owner, as well as the address where it is located.
  • The commission's conclusions are published below : if the premises and all inspected elements are in good condition, then this should be noted, but if there are any complaints or comments about its condition, then they should be described in as much detail as possible.
  • In the final part of the act, it must be signed by all members of the formed commission and, if necessary, certified with seals.

Inspection procedure

It is worth noting that there are no specific actions associated with inspecting the apartment. Most often, the apartment inspection report is a purely individual document. Of course, a person alone is not able to conduct an inspection. A commission consisting of interested parties is assembled for inspection.

The commission, once in the premises, must check the technical, electricity, communications, etc. The commission also checks fire safety. In some circumstances, environmental safety is also an important parameter. A special inspection commission, inspecting the apartment, room by room, records comments using special acts. Of course, if there are no comments, and the condition of the real estate is assessed as satisfactory, the commission will have to draw up an appropriate act.

Features of drawing up an act

As noted above, the apartment inspection report is a document that a person alone cannot draw up. After all, if so, there will be a high probability of either making mistakes when drawing up the document, or drawing up the document to please one of the parties.

The commission inspecting a real estate property must consist of at least two experienced people.

Most often, inspecting an apartment, as well as drawing up the corresponding act, are procedures that are assigned to people working in a government department or in the relevant supervisory authorities.

It is also worth noting that the law does not prohibit the involvement of additional experts in the apartment inspection process. Experts can be engineers, electricians, technicians and other specialists. The involvement of such specialists will guarantee that the premises will be inspected and the inspectors will be objective.

Information about the condition of a real estate property can be entered into a document either by hand or using a computer.

Very often, an apartment inspection is carried out so that the commission can determine the damage caused to the property. The purpose of inspecting the apartment must also be stated in the act. The document also notes the cause of damage to the property. And, of course, if possible culprits are known, information about these culprits is also displayed in the document.

There are also situations in which additional annexes are drawn up along with the act. If there are additional appendices to the act, a corresponding note must be made in the act. For example, if the inspection was carried out using a camera, the photographs will be just an appendix to the report being drawn up.

What needs to be clarified before the inspection?

Before you begin inspecting an apartment before purchasing, you need to decide on your own needs, since each person has his own preferences with characteristic features:

  1. If the buyer has children, then for the general development of the child and his comfort, kindergartens, schools, sports and playgrounds should be located.
  2. If you have a vehicle, it would be advisable to locate the parking lot near the house so that the car is protected and safe.

It is worth paying attention to the documents, since the presence of legal difficulties can lead to problems in the future. Very often, as practice shows, inconsistency of details can lead to legal proceedings in the area of ​​challenging the purchase and sale agreement.

It is recommended to consult with lawyers who can check all the documents, since this way you can count on the correct approach to the case in the future.

Conventionally, the process of inspecting an apartment before purchasing can be divided into the following stages and details:

  1. The seller himself is checked, namely all his documents and personality in general.
  2. Documents for the apartment are being checked.
  3. Initially, the external condition of the apartment is assessed for compliance with the provided planning documents.
  4. The area where the house is located is inspected.

The steps are simple and straightforward, but it still requires special attention to detail, which is more than enough.

Requirements for the content of the act in 2021

Most often, the act is drawn up in the form of descriptive documents, although many (and this is allowed) draw up the document in the form of a simple table. This is especially convenient if a lot of information is entered into the document.

Regarding volume: it entirely depends on how complex the object is. The larger the apartment, the more information about it will be available during the inspection. The scope of the document being compiled is also influenced by the purposes for which the audit is carried out.

Another example of important information that, if a document is drawn up, must be included in the information about all real estate objects that are subject to inspection. The document also notes all responsible persons working at the facility in question.

Based on the results of the inspection, the commission must draw appropriate conclusions and also make comments, if any. If there are no comments, the commission must note that there are no comments.

The inspection report must be issued in several copies. Interested parties should receive a legally binding copy. The parties (their representatives) must autograph the copies.

If companies using a seal are involved in the transaction, they must put it in the act. It is important to take into account here that correctly executed acts are powerful evidence in possible proceedings in court.

Features of filling out the act

The apartment inspection report, even if it is drawn up without following forms, must still be drawn up in accordance with the peculiarities of office work. The document must be completed step by step:

  • Filling out the header (city, date, document name);
  • Composition of the group responsible for the inspection (data of specialists, their position and the company they represent);
  • Fact of inspection of an apartment or other residential property;
  • Conclusions of members of inspection groups;
  • No comments on the condition of the apartment;
  • Signatures of responsible parties.

It is worth considering that all the data noted above is not mandatory, but it would be advisable to note them in the act being drawn up. Also, if this is the decision of the responsible persons, it is recommended to indicate additional items with more detailed information in the apartment inspection report.

As an example, we can imagine a situation in which the inspecting parties or their representatives discovered any problems, defects or deviations from the norm in the inspected object.

If something similar was discovered, the inspecting parties or their representatives will have to write down in the report all the data about these defects and inaccuracies (who discovered them, how they discovered them, how they manifest themselves, the date and time the defect was discovered and other important points). In general, it is important to note any, even the most insignificant and smallest details of the defect. This is extremely important, because any defects may well lead to litigation in the future.

In the event that the tenant party does not notice any oversights, then it will be officially considered that the tenant received the apartment in perfect condition.

In this case, the owner of the residential property may upon arrival demand compensation from the tenant for damages. Even if the tenant has nothing to do with this damage. For the same reason, even minor details should be reflected in the inspection report of residential property.

The inspection was carried out in clear sunny weather with good natural light.

Established by inspection. A three-story red brick building that houses the plant's management, a computer center, accounting and some other administrative services. Its northern part runs along the street. Paris commune of Ensk, southern - facing the territory and production buildings of the plant, enclosed by a three-meter fence of concrete slabs, the western side of the building faces the 1st Northern Lane, the eastern side is adjacent to the five-story building of the Teplopribor Research Institute branch. The shape of the building is rectangular, its length is 75 m, width is 18 m. The windows are evenly spaced, three windows on each side, and are barred on the ground floor. The front door is in the center of the building, the emergency exits (there are two) on the opposite side are clogged with nails.

The cash register occupies a corner room on the second floor, one window of which overlooks the factory territory, the second - onto 1st Northern Lane. The entrance to the ticket office is directly from the corridor, which stretches along the entire second floor. It is reached by two staircases located 20 m to the left and right of the main entrance. The entrance door to the cash desk is single-leaf, upholstered on both sides with light iron. The door has two mortise locks.

During the inspection, the door was opened by cashier V.V. Smirnova. The room is divided into two adjacent parts by a partition, into which is built a door, upholstered in light iron and having a window measuring 26 by 30 cm, which opens from the part in which the cashier is located during work. This room is almost square in shape, its size is 3.5 by 3 m, its height is 3 m 30 cm. The existing window faces 1st Northern Lane; there is no grill on the window. The second room measuring 3 by 2 m with a south-facing window is intended for visitors. There is no furniture in it. The window is also not barred. The windows in the rooms are the same size: height - 180 cm, width - 110 cm. The window frames are double, double-leaf. In the cashier's room there is a window with a window size: height - 30 cm, width - 48 cm, located on the right, 103 cm from the window sill. The frames are closed, but not locked. The floor of the cashier's room is covered with brown linoleum. Near the window there is a single-pedestal desk, the size of the top board of the table is 105 by 80 cm, its right side rests against the side wall. Two-thirds of the table is covered with glass. There are three old Viennese chairs in the room: one near the window, next to the table, the second near the single-pedestal table, the third against the right wall. 160 cm from the window along the southern wall there is a safe with two compartments: upper and lower. Safe size: 60 by 50 by 150 cm.

At the time of inspection, the safe doors are closed. Next to the safe there is a double-door wardrobe 90 cm wide, 200 cm high, along the northern wall 100 cm from the front door there is a table measuring 110 by 90 cm without cabinets or cabinets. There is no damage to the floor, ceiling, walls, or door surfaces.

During the inspection, photographs were taken of the general view of the room being inspected and the general view of the safe. A total of 6 frames of film were used.

The inspection report is accompanied by a diagram of the scene of the incident (Appendix No. 1) and a photo table (Appendix No. 2).
