Subject and general terms of the agreement.

1.1. The subject of this residential lease agreement is the provision by the lessor, for a fee, of temporary possession and use of residential premises for the tenant to live in.

1.2. The rental property (residential premises) is located at: _________________________________

Characteristics of the object: the indicated room is located on the ___ floor, _______ storey building.

1.3. At the time of concluding this agreement, the premises for rent belong to the Landlord on the right of ownership, are not mortgaged or seized, and are not the subject of claims by third parties. The above is guaranteed by the Lessor.

1.4. The residential premises leased by the parties have been inspected and are in good condition, meeting the requirements for exploited residential premises used for residential purposes in accordance with the purpose of the property.

1.5. The landlord has the right to demand termination of this agreement and compensation for losses in cases where he establishes facts that the Tenant is using the premises not in accordance with the terms of the rental agreement or the purpose of the rented residential premises.

1.6. The transfer of residential premises by the Landlord for use by the Tenant is carried out at the time of signing this agreement by handing over the keys to the apartment.

The transfer deed is not drawn up.

1.7. The employer undertakes:

  • use residential premises for rent in accordance with the terms of this agreement and exclusively for living;
  • compensate the Landlord for losses caused in the event of damage to the residential premises;
  • do not carry out internal redevelopment and reconstruction of the premises without the consent of the Landlord, do not move the electrical wiring system, etc.
  • observe fire safety measures;
  • return the rented premises on the day of expiration of this agreement or termination for other reasons in a condition determined by agreement of the parties to this lease agreement.

Payment under the rental agreement and payment procedure.

2.1. The parties to this agreement have established that the amount of payment for the transferred residential premises is: _________________________________________ rubles per month paid (in advance) _________________________ until the ___________________ day of the current month.

Payments for utilities, electricity and gas are the responsibility of the Landlord. Payment for additional services (telephone, cable TV, Internet) is borne by the Tenant,

2.2. The Tenant undertakes to pay the above payments in full on a monthly basis.

2.3. The amount of payment for the transferred residential premises can be changed only by agreement of the parties.

Responsibility of the parties.

3.1. A party to a contract whose property interests are violated as a result of non-fulfillment or improper fulfillment of obligations under the contract by the other party has the right to demand full compensation for losses caused to it by this party.

3.2. Any party to this agreement that fails to fulfill its obligations under the contract or performs them improperly is liable for the above in the presence of guilt (intention or negligence).

3.3. The absence of guilt for non-fulfillment or improper fulfillment of obligations under the contract is proven by the party that violated the obligation.

Settlement of disputes.

4.1. Disputes that may arise during the execution of the terms of this agreement, the parties will strive to resolve amicably in the manner before trial: through negotiations, exchange of letters, clarification of the terms of the agreement, drawing up its additions and changes, etc.

4.2. If a mutually acceptable solution is not reached, the dispute will be resolved in a court of general jurisdiction.

Contract time.

5.1. This agreement comes into force at the moment of signing this agreement and is valid until “____” ___________ 20__.

5.2. In case of early termination of the contract, the Interested Party is obliged to notify the other party 14 days in advance.

5.3. Termination (expiration) of the validity period of this agreement entails the termination of the obligations of the parties under it, but does not relieve the parties to the agreement from liability for its violation, if any occurred during the fulfillment of the terms of this rental agreement.

6 Amendment and/or addition to the agreement.

6.1. This agreement may be amended and/or supplemented by the parties during its validity period based on their mutual consent.

6.2. Any agreements of the parties to change and/or supplement the terms of this agreement are valid if they are in writing, signed by the parties to the agreement.

How to fill out an apartment sublease agreement correctly?

A legally competent document regulating the relationship between the Tenant and the Subtenant will contain the following information:

  • date, place of preparation, name of the document (sublease agreement);
  • information about each party to the transaction (full name, registration address, passport details - for individuals);
  • information about the apartment and property as the subject of the contract: it is necessary to indicate brief characteristics of the apartment (cadastral number, total and living area, number of rooms, postal address, etc.);
  • details of the documents that are the basis for the ownership and use of housing for the tenant (lease agreement), as well as the ownership rights of the landlord (for example, a purchase and sale agreement);
  • a list of property transferred for temporary use along with an apartment, a separate item or in the form of an annex - a transfer deed;
  • obligations of the parties, including mentioning that the apartment can only be used for its intended purpose (for living);
  • The rent is set in total terms, indicated in numbers and in words. The conditions for payment of utility bills are fixed. If this is not specified in the contract, it is considered that housing and communal services costs are included in the rental payment;
  • the amount of the security payment made by the Subtenant one-time at the same time as the first payment. It covers losses incurred due to the fault of the Subtenant, or is returned to him upon termination of the contract;
  • the terms of termination of the contract must contain the circumstances upon the occurrence of which the transaction is terminated at the initiative of one of the parties. A deadline is established for notification of the intention to terminate the contract early;
  • additional items at the discretion of the parties, for example, the condition of the property on the date of signing the agreement, if a separate acceptance certificate is not drawn up;
  • list of attached documents;
  • details of each party to the transaction;
  • signatures.

  • a document confirming the emergence of ownership of residential premises before the entry into force of the Federal Law “On State Registration of Rights to Real Estate and Transactions with It” (Article 6). 7. Application for a subsidy to pay for housing and utilities. The following requirements apply to submitting an application for a subsidy to pay for housing and utilities:

  • the application is drawn up in the prescribed form;
  • the application can be filled out by hand or by machine, or printed using electronic printing devices;
  • the application can be completed either by the recipient of the public service or by a specialist from the authorized body;
  • the application is prepared in a single copy – the original;
  • The application must be signed personally by the recipient of the public service.

Applications for a subsidy to pay for housing and utilities are not accepted from:

  • borrowers under an agreement for the free use of residential premises of a private housing stock;
  • refusal of recipients to whom the right to use residential premises of a private housing stock was granted under a testamentary refusal agreement;
  • rent recipients living in residential premises of a private housing stock under a lifelong maintenance agreement with dependents;
  • subtenants of residential premises of state, municipal and private housing stock living under a sublease agreement;
  • temporary residents in residential premises, regardless of the type of housing stock.

8. Documents confirming the income of the applicant and his family members, taken into account when deciding on the provision of public services.   • documents provided for by the tax legislation of the Russian Federation, depending on the taxation system chosen by individual entrepreneurs, which is certified by a document from the tax authority.

When applying the general conditions for the establishment of taxes and fees and the simplified taxation system, the following must be submitted: a book of income and expenses and business transactions of an individual entrepreneur on paper, and, if necessary, primary accounting documents confirming income and expenses for the billing period; when applying the taxation system in the form of a single tax on imputed income for certain types of activities - copies of the tax return certified by the tax authorities. Confirmation of receipt of funds allocated to the guardian (trustee) for the maintenance of the ward (ward) is a certificate of the amount of funds paid, generated by the authorized body without the participation of the citizen. When calculating the total income of the family of a recipient of a state service, regardless of whether they live separately or together, the income of citizens who are in relation to the recipient of a state service or members of his family: a) a spouse is taken into account; b) parents or adoptive parents of minor children; c) minor children, including adopted children.

9. Copies of documents confirming the legal grounds for classifying persons living together with the applicant at the place of permanent residence as members of his family.   • Marriage certificate;
  • child's birth certificate;
  • passport of the applicant and his family members;
  • an extract from the personal file of a serviceman or other person serving in the federal executive authorities;

10.   • a will confirming the residence of the citizen as the beneficiary;
  • a lifelong maintenance agreement with a dependent, confirming the citizen’s residence as an annuity recipient;
  • a document confirming the divorce of the former spouses;
  • other documents confirming the reasons for the citizen’s residence in the same residential premises with the applicant.

11. Copies of documents proving the identity of the applicant and his family members. Identification documents of the applicant and his family members may include the following documents: for citizens of the Russian Federation:

  • passport of a citizen of the Russian Federation;
  • birth certificate with an insert confirming citizenship of the Russian Federation;
  • other documents;

for citizens of states with which the Russian Federation has concluded a corresponding international treaty:

  • passport of a citizen of a foreign state; other documents identifying the foreign citizen.

12. Documents containing information about persons registered together with the applicant. Documents containing information about persons registered together with the applicant include:

  • passports of all family members who have reached the age of 14 years (imprint of the registration stamp at the place of residence), or certificates of registration at the place of residence of family members registered at the place of residence using identification documents other than passports;
