Registration of a newborn is the responsibility of legal representatives. Bypassing the procedure, it is problematic to obtain social and medical services. A developed system of contacting government agencies allows you to submit an application without queues: in multifunctional centers (MFC), on the State Services website, passport office and territorial management structures of the Ministry of Internal Affairs (MVD).
To register a child through the MFC, you will need documents; which ones are needed depends on the situation: whether the placement is carried out with both or with one parent.
Why is this necessary?
The process usually goes without much difficulty if parents are prepared for it in advance. At the same time, having registration in the future will make life much easier for the baby and the citizens responsible for him. This will make it possible:

- apply for benefits and other types of assistance in child social protection structures;

What it is
Registration of a newborn through the MFC is a legal confirmation of the child’s place of residence. Draws up for the purposes specified in Part 1 of Art. 3 of the Law of the Russian Federation June 25, 1993
Registration is necessary so that the child can use his social rights - to receive benefits, medical care, etc.
But registration should only facilitate the receipt of such benefits, but cannot be a prerequisite for obtaining social or other assistance.
In Art. 3 of Law No. 5542-1 states that the lack of permanent registration of a citizen cannot serve as a basis for violation of human rights and freedoms, including the right to medical, social and other types of assistance.
Is it possible to do without registration?
Many parents are concerned about this issue, because if the child is not registered in the place where he lives, he will not have to pay utilities for another family member. But this is a rather dubious way to save money because, firstly, if it is necessary to prepare urgent documents for a child in the future, parents may encounter difficulties and lose time. Secondly, there is a possibility of receiving punishment for non-compliance with legal norms from the state.
It is important to understand that a fine will be imposed not for lack of registration, but for the illegal residence of an unregistered person in the owner’s living space. Such a decision is made by employees of the migration department if the fact of illegal residence is established and proven.

Where is the baby registered if the parents do not have permanent registration?
The right of a child to live together with his parents is prescribed in the Family Code of the Russian Federation. The legislator does not derogate from this right even if neither of the parents has permanent registration.
The child must be registered at the place of temporary registration of one of the parents. In this case, no additional requirements for the composition of documents are required, just as the consent of the owners and other residents of such residential premises is not required.

How long does it take to process
In general, a permissible period of 3 months is allotted for the preparation of relevant documents. If registration is not completed during this time, then when submitting an application later, you may need an explanatory note indicating the reason for the delay.
If the child is not registered after the allotted period and there are no compelling reasons for this, the state may take a punitive measure against his representatives, namely the obligation to pay a fine in the amount of up to 5,000 rubles.

What are the consequences of not having a residence permit?
According to the law, a citizen of the Russian Federation must not forget about the need to inform the state where he lives. If a person moves, it is required that he notify the relevant authorities after leaving his previous place of residence. He is given no more than a week to do this, otherwise he may be fined.
The newborn does not have an apartment or house in which he previously lived. There is no official document establishing the maximum period for which an infant can remain without registration. It is better to do it faster in order to enjoy all the benefits provided by the state.
The Code of Administrative Offenses provides for liability imposed on persons who allow persons to remain permanently on the territory of their property without appropriate documentation. You can find out about this only if they themselves want to write a statement admitting to a violation of their rights. If a complaint comes from strangers, then it is not easy to prove illegal presence. If guilt is admitted, then a fine of 2 to 3 thousand rubles is imposed for 2021. In Moscow and St. Petersburg the amount is slightly higher (the violator is required to pay from 3 to 5 thousand rubles).
Note! If a man and woman have not recorded anywhere that the child lives with them, but are themselves registered legally, then they will pay a fine only when they themselves admit that they are not fulfilling the duties assigned to them. If they want to evade responsibility, they must present documents confirming that the child sharing the same living space with them is their son or daughter.
For a short period
Temporary registration of a newborn can be carried out for a period not exceeding 3 years; it is not necessary to be discharged from the place where the child will live all the time. For example, there are situations when the place of permanent residence is in Moscow, and a family with a baby decides to leave for a long period to visit relatives, on a work trip, or for any other reason to St. Petersburg or another city in Russia.
There may also be a situation where parents are waiting for the apartment to be vacated by previous tenants or after renovation in order to move in. When temporarily registering a child, the parents or legal representative must also have any type of registration at the same address. Confirmation of this, together with the main list of documents, is provided to the territorial migration department.
It is still very advisable to complete this type of registration, even if it is not immediately necessary, because this way the child will be able to receive medical services if necessary or will be freely registered in kindergarten.

Temporary registration is carried out a week in advance; if you have permanent registration in another region of the country, the period may increase due to data verification and waiting for a response to the relevant request.
What nuances arise when contacting the MFC?
In some cases, visiting the passport office may be inconvenient, for example, due to the fact that it is open 1-2 days a week for several hours.
Some may think that it would be smarter to get to the multifunctional center, and they will be right. At the MFC, registration of a newborn is carried out according to the one-window principle, that is, the applicant submits the entire package of documents to one specialist and after 3 days picks up the finished document. In addition, the Center’s staff willingly advises and helps to understand difficult situations.

Required documents for registration
One family member can submit documentation in full.
- For an official marriage, you will need to collect the following documentary evidence:
- civilian identity cards;
- a certificate from the maternity ward, which will indicate all the information about the newly born baby, how much he weighs, how tall he is and other important information;
- marriage confirmation from the registry office.
It is important that the family receives a certificate within the first month that the child has been born; for this, it is important to choose the baby’s name in advance, otherwise administrative punishment will most likely follow.

- The next step is to go to the passport office with the birth certificate you have already received. You will need to submit an application for registration of the child using Form N6. The form can be picked up at the branch itself, or you can download it here.
Originals and copies of the following documents are submitted with the application:
- birth certificate;
- civil identity card of representatives;
- confirmation of marriage;
- Based on the type of housing facility the child fits into, you will need:
- an extract from the registration log, if registering in an apartment;
- When registering in a private house, a house register is submitted, which is kept by the homeowner; he must provide it upon request to register a new person if the house is rented.
- Certificate of personal account of the housing property from the place of future registration.
- If the child receives registration at the father’s place of residence, then it is also necessary to submit confirmation that the mother does not disagree.
When the entire set of documents is provided, it remains with the department until the end of registration. If everything is prepared correctly and there are no difficulties, registration can be completed within a day, but on average the period is up to 7 days.

When registering a newborn in a private home, an entry about this is made in the house register. And also directly during the submission of documents, parents can make an entry in the column about children in their civil passports.
Fitting the child in with the mother
In order for a father to register his offspring with him, he must either be in a marital union with his mother, or appear at the appropriate institution, namely the registry office, and put his signature on a document establishing the right to paternity. If he does not do this, then the mother must independently attend to the issue of registering the child with herself:
- receives a birth certificate for his child;
- fills out form No. 6;
- brings:
- Civil ID card with a copy.
- Birth certificate with a copy.
- An extract from the home registration journal or the journal itself.
- If more than 30 days have passed since the birth of the child, you will also need an extract from the registration register at the address of residence of the baby's father.
- A certificate showing the status of your personal housing account.
- An extract about the living space or a document that will act as evidence of ownership. In situations where these papers are not available, any basis agreement can be provided. For example: purchase and sale, inheritance, social rent agreement in the case of municipal housing.
Registering a child at the mother's place of residence does not cause any difficulties.

At the registration address of only the father
- Both parents must appear at the passport office to submit their own application. The father submits Form No. 6, the mother submits consent for the child’s registration with the father.
- Along with the applications, the same documents are submitted as in the previous case, plus:
- civil identity card from the second parent;
- extract from the house register or house register;
- If more than 30 days have passed since the birth of the child, an extract from the house register at the mother’s place of residence will also be required.
Where can I register my child?
The parents of the child must live in the dwelling where the baby is registered. This:
- a house or apartment belonging to parents or relatives;
- housing rented from the municipality (social rent);
- service housing;
- dorm room;
- apartment rented from a private person.
To register a baby in an apartment, parents registered there do not need:
- ask the consent of the owner for the registration of the newborn;
- “settle” the baby’s registration with the residents;
- adhere to sanitary or regional standards for residents in municipal apartments.
There are no strict deadlines for registering a newborn. The fastest registration is important for parents - without a certificate (the form cannot be submitted for the calculation of state assistance and see a doctor. It is believed that it takes a month to register a child. But even if the deadlines are violated, it is unlikely that parents will face a fine. Registration rules in 2021 do not require payment state fee for the registration procedure for children.
Legislation
- The obligation to have permanent or temporary registration is indicated in Art. 3 of the Law of the Russian Federation 5242-1 of June 25, 1993
- The registration procedure is approved by Decree of the Government of the Russian Federation No. 713.
- The obligation of minors under 14 years of age to live with their parents (one of them) is indicated in Art. 20 Civil Code of the Russian Federation.
Registration is more of an administrative and legal nature, since its obligation is established by the state, and responsibility for its untimely completion is imposed by officials - according to the norms of the Code of Administrative Offenses of the Russian Federation - Article 19.15.1 , with the provided exceptions.
Can they refuse?
Refusal of registration is possible if not all documents are submitted. Registration of a newborn will be refused if the parents want to register him in a living space where they themselves are not registered. A refusal may follow if there is no consent for registration of one of the parents, especially the mother.
Only a written reasoned refusal should be required.
It can be appealed administratively - to higher authorities or through the court - in the manner of claim proceedings.
Price
The procedure is completely free - no state duty is paid for it and no other payments are made.
But, if the registered minor has no citizenship or is a foreign citizen, a fee of 350 rubles will need to be paid, and the receipt will need to be attached to the rest of the documentation.
Parents have the right to choose the most convenient and acceptable way to obtain a certificate of the child’s place of residence.
