Conditions for receiving housing subsidies for employees of the Ministry of Internal Affairs

The one-time social payment to police officers is targeted. Funds are provided only to those employees of the Ministry of Internal Affairs who are recognized as needy and also meet other requirements.

The measure of social support in the form of payment is regulated by Federal Law dated July 19, 2011 No. 247-FZ. And also by-laws. In particular, by Decree of the Government of the Russian Federation No. 1223 of December 30, 2011 On the provision of a one-time social payment for the purchase or construction of residential premises to employees of the internal affairs bodies of the Russian Federation, persons serving in the troops of the National Guard of the Russian Federation and having special police ranks, as well as other persons entitled to receive such payment.

Legal aspects of subsidized assistance for employees of the Ministry of Internal Affairs

The main regulatory document on subsidies for the purchase of residential real estate for employees of the Ministry of Internal Affairs is Law No. 247-FZ of July 19, 2011, as amended on March 1, 2021. This is a federal law on social assistance to employees of the Ministry of Internal Affairs.

The issue of providing monetary allocations to police officers is also regulated by Government Decree No. 1223 of the Russian Federation dated December 30, 2011, as amended on November 15, 2019. This document regulates the procedure for providing a lump sum payment to employees of the Ministry of Internal Affairs for the purchase of a house, apartment, or housing construction.

Another document that is taken into account when providing financial assistance for the purchase of real estate to police officers is the Housing program. It was developed in 2002, but the validity period is regularly extended.

Options for benefits for employees of the Ministry of Internal Affairs

The state offers employees of the Ministry of Internal Affairs several options for preferential receipt of real estate. The choice of a suitable person is made independently.

He has the right:

  • Get a municipal apartment. In this situation, housing will be provided on the basis of a social rental agreement. However, this method is only available to citizens who were in line before 2005.
  • Move into service housing. This option is only suitable for district police officers.
  • Receive monthly cash payments. They are provided after issuing the appropriate certificate. The funds received can subsequently be used to purchase housing.
  • Take advantage of compensation. It is provided if the police officer rents housing.
  • Receive a lump sum payment or compensation from the state for the purchase of premises or construction of a house.
  • Obtaining an apartment from the housing stock of the Ministry of Defense.

Which categories are eligible for state assistance?

Housing subsidies are provided to several categories of citizens.

Those serving

Employees serving in the Ministry of Internal Affairs are allocated funds for the purchase and construction of real estate. Conditions for receiving subsidies:

  • work experience – from 10 days in your department;
  • the police officer and his family members do not own a house or apartment;
  • there was no previously concluded agreement on the social rental of an apartment or room;
  • discrepancy between the area of ​​the premises where the citizen lives and the standards of square meters of housing per person in force in the region;
  • the premises are in disrepair;
  • accommodation in a communal apartment, a dormitory, together with another family in adjacent rooms;
  • housing is considered dilapidated;
  • living together with a person who has been diagnosed with a serious chronic pathology.

If a citizen meets these conditions, he submits an application for a housing subsidy.

Retired

Citizens who have been transferred to the reserve have the right to apply for funds to improve their living conditions. Reasons for dismissal from position:

  • retirement due to age, length of service;
  • for health;
  • as a result of reforms in the Ministry of Internal Affairs;
  • at their own request, but if they have completed the minimum period of time that allows them to qualify for funding.

Families of deceased employees

If a police officer who has been allocated a housing subsidy dies in the line of duty, the next of kin will receive the money for him:

  • spouse – the marriage must be formalized;
  • children of the deceased under 18 years of age or under 24 years of age studying at a university;
  • children of the deceased who have lost their legal capacity, without age restrictions;
  • relatives who are dependent on the deceased, if the fact of dependence is confirmed, and the dependence on the deceased employee of the Ministry of Internal Affairs lasted at least 1 year before the death of the citizen.

The condition is to apply for a subsidy within 12 months from the date of death of the citizen. If a widow applies for a subsidy, then she is subject to an additional requirement - she must not remarry at the time the allocation is issued. This condition also applies to widowers of a deceased spouse.

In accordance with Federal Law No. 380-FZ of December 2, 2021 “On the federal budget for 2021 and for the planning period of 2021 and 2022,” in 2021 the Russian Ministry of Internal Affairs provides budgetary allocations for the provision of unified social contributions in the amount of 4.66 billion rubles.

Due to the internal redistribution of funds, the expenses provided for by the consolidated budget list of the Ministry of Internal Affairs of Russia for the unified social allowance were additionally increased in the amount of 5.32 billion rubles.

Thus, in 2021, 9.98 billion rubles were allocated for the provision of unified social contributions, which made it possible to provide for 1,313 employees (pensioners) of the Russian Ministry of Internal Affairs, including 61 families of deceased employees.

In the period from 2012 to 2021, 14,336 people on the waiting list of the Russian Ministry of Internal Affairs were provided with ERUs, of which 941 were families of deceased employees.

There are 89,025 people on the waiting list for the provision of ESV, including 2,263 on the waiting list who were registered in 2012.

In accordance with Federal Law No. 385-FZ of December 8, 2021 “On the federal budget for 2021 and for the planning period of 2022 and 2023,” in 2021 the Ministry of Internal Affairs of Russia provides budgetary allocations for the provision of unified social contributions in the amount of 4.66 billion rubles.

Due to the internal redistribution of funds, the expenses provided for by the consolidated budget list of the Ministry of Internal Affairs of Russia for the unified social allowance were additionally increased in the amount of 1.86 billion rubles.

Over the past period of 2021, 918 people on the waiting list of the Ministry of Internal Affairs of Russia were provided with ESV, of which 52 were families of deceased employees.

In accordance with Federal Law No. 247-FZ of July 19, 2011 “On social guarantees for employees of internal affairs bodies of the Russian Federation and amendments to certain legislative acts of the Russian Federation” (hereinafter referred to as Law No. 247-FZ), taking into account available funding in 2021, the following are subject to the provision of ERU: as a matter of priority, family members and parents of deceased (deceased) employees; employees (pensioners) who have a priority right to receive unified social contributions over those on the waiting list registered in 2012; waiting lists with registration dates up to December 20, 2012.

Work on the implementation of the ERU is carried out in accordance with the established procedure.

Please note: the employee's queue number is not a constant value and may change due to a number of reasons, including: - a change in the number of deceased employees whose families are subject to extraordinary provision of unified social contributions; — acquisition of the priority right to secure unified social contributions by employees; — reinstatement of employees in the queue by court decision; — change of registration date by court decision; — deregistration of employees for various reasons.

Considering that measures for the implementation of Articles 4 and 6 of Law No. 247-FZ are entrusted to the commissions of divisions of the internal affairs bodies of the Russian Federation, if questions arise regarding the provision of unified social contributions, it is necessary to first contact the housing commission of the division at the place of registration.

Types of subsidies and conditions for receiving

Employees of the Ministry of Internal Affairs are offered several types of funding with different conditions for receiving assistance.

For housing construction

A law enforcement officer has the right to spend the allocated subsidy for the following purposes:

  • participation in shared construction of an apartment building;
  • construction of a private house.

Both investments involve certain risks. So, in the first case, there is a possibility that the apartment building will not be built and construction will be frozen. Because of this, the citizen will be left without funds provided by the state.

To minimize this likelihood, subsidies are allocated only when construction is more than 70% complete. Another subsidy protection measure is a thorough check of developers. If the company's reputation is in doubt, then funding will be denied.

When building a private house, it is difficult to predict how much money will be required for construction. Even the compiled estimate does not always correspond to the final amount. Therefore, there is a risk that the allocated funds will not be enough to complete the construction. Another danger is that construction may be delayed.

Due to high risks, the procedure for obtaining subsidies for housing construction is complex and takes a long time to review the application.

For the purchase of housing

An employee of the Ministry of Internal Affairs has the right to use the subsidy allocated by the state to purchase an apartment from a secondary fund.

A citizen can buy housing taking into account the following points:

  • the apartment must be located in the region in which the citizen serves;
  • correspondence of the number of rooms in the premises to the number of rooms indicated in the housing certificate;
  • all relevant communications must be carried out in the housing;
  • compliance of apartment dimensions with current standards for living space per person.

After completing the purchase/sale transaction, the citizen has the right to immediately move into the apartment.

In addition to real estate in the secondary fund, an employee of the Ministry of Internal Affairs can buy housing in new buildings and private houses that are fully built.

Lump sum payment amount

The size of a one-time payment for the construction and purchase of housing for employees of the Ministry of Internal Affairs depends on several points:

  • average cost of real estate in the region;
  • number of family members;
  • current coefficients.

What are social benefits for police officers?

By figuring out whether apartments are provided to employees of the Ministry of Internal Affairs from the state, and how to get the benefit, a person will find out that there is another significant social benefit with which it will be possible to acquire housing. A person will be able to take advantage of social benefits, which are accrued under the military mortgage program.

However, if we are talking about police officers, the process of using the benefit will have a number of features. The provision of funds from the budget is regulated by federal laws. The money can be used to close an existing mortgage or used as a down payment.

For police officers, a lump sum payment is not a form of accumulative system.

This means that funds will be provided almost immediately after the subsidy is issued and placed in the queue. An applicant to receive funds must have worked in the Ministry of Internal Affairs for more than 10 years and need to improve their living conditions.

How to apply for a subsidy

There is a procedure for receiving a housing subsidy that must be followed.

Where to contact

To apply for a subsidy, contact the application review committee. Commissions are created in each region for each department of the Ministry of Internal Affairs. There is no time limit on work. The address of the commission that reviews applications can be obtained from management.

Required package of documents

Package of documents for applying for a housing subsidy:

  • statement;
  • a copy of the Russian passport of the applicant and all family members;
  • certificates of birth of children, marriage, divorce - if available;
  • document on work experience in the Ministry of Internal Affairs;
  • a certificate confirming that the applicant or family members do not own real estate;
  • extract from the house register;
  • the conclusion of the commission on the non-compliance of the housing with established standards, on recognizing the premises as dilapidated and unsafe;
  • bank statement for 5 years on the status of the applicant’s account;
  • pension certificate - for citizens who have retired due to age or length of service;
  • death certificate of an employee of the Ministry of Internal Affairs, if the benefit is issued by immediate relatives.

When a citizen lives in a communal apartment or hostel, this fact is confirmed by one of the documents:

  • an extract from the registration card;
  • address certificate;
  • act of residence.

If an applicant applies for a subsidy due to living in the same area as a relative who has been diagnosed with a serious chronic disease, then a medical report on the citizen’s pathology is attached to the package of documents.

Deadline for obtaining a certificate and its use

The period for reviewing documents from the applicant is up to 6 months. If a positive decision is made, the Ministry of Internal Affairs employee is put in line to receive allocations. It may take more than one year before a citizen is provided with a subsidy.

When the applicant’s turn comes, he is not given money for the purchase or construction of real estate, but a certificate for receiving a subsidy. He must take the document to the bank, where an account is opened on its basis. The period for transferring the certificate to a financial institution is 90 days, the period for disbursing funds is 6 months from the date of receipt of the subsidy.

Privatization of issued housing

Privatization of an apartment issued by the Ministry of Internal Affairs is possible if it was received under a social tenancy agreement or is municipal housing.

To obtain ownership of housing, you must submit an application to the unit of the Ministry of Internal Affairs of the Russian Federation, which is indicated in the social tenancy agreement as the lessor. The application is considered within 2 months. If the deadline has passed and you have not received any notice, we advise you to contact the district court at your home address.

If you receive a negative answer, you have the right to challenge the decision.

In practice, it is often found that landlords are not eager to give housing into personal ownership, so cases often end up in court. To ensure the privatization of your apartment, you should approach the legal process wisely.

Your goal will be to prove that you have not previously used your right to privatization by submitting the necessary list of documents (extract from the Unified State Register, extract from your service record, certificate stating that you did not receive housing at previous places of service or rented it out).
