Reasons for enrolling in a school other than the place of registration
The regulatory documents do not indicate anywhere that the management has the right to refuse admission to children whose registration of residence does not relate to the area where the school is located. On the contrary, paragraph 1 of Article 5 of Law No. 3266-1 directly states that a child can be registered regardless of place of residence. This is the basic principle of granting the right to secondary education.
This is also stated in Article 43 of the Constitution of the Russian Federation. It is guaranteed to be free and, most importantly, generally accessible to educational institutions at the municipal and state levels. Clause 4 states that secondary education is mandatory.
If admission is refused, it is recommended to take the following actions:
- Request the school charter. It must comply with current legislation, and the only option for refusing to get into the school is the lack of free places.
- Municipal education authority. You should only contact it if there is an unmotivated refusal from the management of the establishment. The complaint indicates the reasons for the appeal and provides references to the laws violated.
- Court, prosecutor's office or Ombudsman for Children's Rights. This is the last option to achieve a fair solution.
But the possible consequences are also taken into account - a biased attitude towards the child on the part of the teaching staff, a greater likelihood of discharge for the slightest violations.

Important! You can go to school only on a general basis; competitive enrollment in the first grade is prohibited by clause 3 of article 5 of law No. 3266-1.
Possible reasons for refusal
It is not always possible to place children in a school other than their place of registration. The main reason is the lack of places. In this case, the advance time of filing the application does not matter. This is especially true in urban areas with a large number of new buildings, but undeveloped social infrastructure.
One of the common grounds for refusal is the effect of Law No. 310-FZ, which indicates that children officially residing in the area have priority for admission. If a child was registered earlier, but without registration in the area, a child with registration can be taken in his place. These rules have not changed in 2021.
Additional reasons for refusal:
- a specialized institution intended for children with special needs;
- the opposite situation, when due to the child’s health characteristics he cannot study in a regular school;
- This is a private training organization that accepts only after certain tests have been carried out.
The latter option is becoming more and more common, but in fact it contradicts paragraph 3 of Article 5 of Law No. 3266-1. But since such a school does not belong to a state or municipal network, these rules do not apply to it.

Features of the device for temporary registration
One of the options to increase your chances of getting accepted into your desired educational institution is to apply for temporary registration in the area. But for this you need to fulfill a number of conditions. The main thing is that the child lives with at least one of the parents. Even close relatives – grandparents, aunts, uncles – cannot register for school.
Recommendations:
- register for registration at least six months before submitting documents;
- completion date for registration - before the official acceptance of documents at the educational institution;
- actual residence not at the place of registration - no more than 90 days;
- There is no need to provide annual confirmation of registration, so this procedure can be done once.
Failure to comply with registration rules will result in a fine. For a fictitious resident it will be from 2,000 rubles. up to 3,000 rub. The homeowner can receive a receipt with large amounts - from 2,000 rubles. up to 5,000 rub.
Important! After paying the fine, the registration will still be cancelled. But the basis for all these actions is only a court order. The initiators of the process are usually persons living in the apartment, but who do not want to participate in fictitious registration.
How to register a child for school
A minor is required to live with his parents, so in order to obtain temporary registration, the father and mother, or one of them, must first register. The easiest way is to contact relatives and friends who live on the territory of the chosen school, or find a home owner who agrees to register them in their living space. Having collected all the necessary documents, the legal representatives apply for registration for themselves, and then submit an application for registration of the baby. The apartment owner's permission is not needed.
In the case when a young child needs to be registered without his parents, the procedure is formalized in the process of civil proceedings, and the parents will have to prove the urgent need for their actions.
A fourteen-year-old can obtain a temporary registration for school separately from his parents by attaching voluntary consent to the procedure to the application.
Where to contact
The necessary documents are needed for registration; they must be submitted to the territorial body of the FMS through the passport office, the Multifunctional Information Center or the Unified Government Services Portal. The employees, having accepted the application and documents, set a time for the procedure, which will be carried out at the Federal Migration Service of Russia or at the MFC, with the obligatory presence of the owner of the residential premises and the person being registered.

Certificate of child registration for school
The document for enrollment in studies is issued by the territorial body of the Federal Migration Service of Russia. There are two types: about the presence of permanent registration (form No. 8), about registration of a temporary type (form No. 3). The second option contains information about the registration period. The certificate states:
- FULL NAME. minor;
- Date and place of birth;
- the minor's residential address;
- day of issue of the certificate;
- signature of the Chief Commissioner for Migration Issues, seal;
- individual document number.
Provided 7 days after application. Certificate No. 8 is issued for an indefinite period and is considered the second main document of a minor until he receives a passport of a Citizen of the Russian Federation.
A certificate of registration of a child’s temporary type of school is valid for up to 10 working days.
Registration deadlines
Certificate form No. 3 is issued for a period of 1 to 36 months. The duration depends on the agreement between the child’s representative and the property owner. After the specified period, the registration is considered invalid.
What documents are needed
To register a temporary type of minor, you should submit an application to the FMS, MFC, or the passport office of the management company. Attached to the application:
- birth certificate;
- passports of parents, adoptive parents, trustees;
- marriage or divorce certificate, court decision on adoption, guardianship
- written consent of the mother or father, if the minor will reside at the place of registration of only one of them;
- document on temporary registration of parents, one of them;
- passport of the minor (if you have one);
- lease agreement for the use of municipal housing where the father and mother live;
- permission from the apartment owner or municipal authority, if desired, to register a minor over 14 years of age separately from their parents;
- application for temporary registration of the baby, which indicates: address, period, list of attached documents;
- foreign passport of a son or daughter, if they lived in another state.
The desire of the apartment owner to register a minor with his parents is not necessary. The exception is cases when a preschooler is registered separately from his parents, by court decision. In this case, you must file a claim with the court, attaching the following documents:
- consent of the property owner;
- written permission from the parents for a minor to live separately;
- birth certificate;
- passports of legal representatives;
- other documents, at the request of the judge.
In the courtroom, it is necessary to prove the fact of the need for temporary registration of the child for school separately due to special circumstances. The hearing of the case requires the participation of a representative of the guardianship and trusteeship authority and the prosecutor.
State duty and cost of other services
Temporary registration for citizens of the Russian Federation is completed completely free of charge. State duty is charged only to foreigners.
If the parents do not have Russian citizenship
Sometimes the child’s parents not only live in another city, but are citizens of another country. At the same time, they can place their children in a general education institution to receive secondary education for free. But this applies to citizens of countries that have signed the agreement on the Eurasian Economic Cooperation - EAEU. This right is specified in clause 8 of Article 98 of the agreement.
Conditions under which children without Russian citizenship are admitted to school:
- staying on the territory of Russia legally;
- migration card and migration registration statement;
- children of labor emigrants have the right to receive secondary education only during the period of validity of their parents’ contract;
- if a foreigner does not have the right to work in the territory of the Russian Federation, his period of stay is limited to 90 days, which also applies to a child.

The list of documents required by general education institutions to enroll a child in 1st grade has not changed for several decades. Of the basic documents, parents must provide:

Does the school check temporary registration and permanent registration?
When submitting an application, it is mandatory to provide a certificate from the passport office about the minor’s registration. If you do not have a permanent one, you must provide a document confirming the child’s temporary registration for the school. Its presence is equivalent to a permanent one in cases of emergency (submitting documents to school when moving) and guarantees enrollment in the first place.
The fact of temporary registration, together with a permanent mark, may raise questions among the administration of the educational institution, and priority enrollment will be denied.
A child’s lack of temporary registration is not grounds for refusal to enroll in education in accordance with federal laws. But it allows employees of an educational institution not to enroll a minor at the request of educational authorities and local regulations.
