How to get to school without registration or without Russian citizenship

Quick navigation through the material

Any Russian must be registered at the place of residence or temporary stay. A citizen of the Russian Federation without a residence permit cannot receive social benefits and enjoy government benefits; in addition, difficulties arise in finding employment. In general, there will always be restrictions along the way; it will definitely not be possible to fully realize your rights. A child will certainly not be accepted into school without registration, since the Law obliges everyone, including minors, to have registration. How does such a restriction correlate with the current norms of legislation in the field of implementation of civil, constitutional rights and human freedoms?

On what basis is it possible to enroll a child in school without registration?

The Constitution of the Russian Federation stipulates that the presence or absence of registration is not a reason for restricting and infringing on human rights with regard to obtaining an education; it also enshrines the right of everyone to an accessible and free school education. In addition, the Federal Law on Education regulates the lack of rights of the school administration to refuse education to those who wish to receive education, regardless of race, religion, place of origin, and most importantly, place of residence. Based on these standards, a child has the right to study at school without registration. If it were not for the inconsistency of the legislation: The same Federal Law on Education establishes priority for children living in the territory where it is located. In this situation, without confirmation of the fact of territorial affiliation with the school, it may serve as a legal refusal due to the lack of free places.

Does a parent have such a right?

According to the legislation of the Russian Federation, parents can change the place of study that their child attends. The legal representatives of minors are also entitled to the same rights. It is permissible to change educational institution at any time of the year - there are no restrictions on this issue. Clause 3 of Art. 44 Federal Law No. 277 predetermines the right to choose to change the place of study.

No one has the right to refuse to transfer a child to another school. This is a direct violation of Russian legislation.

The selected institution is obliged to consider the applicant's request. The appeal can be either approved or rejected. Refusals are received in situations where there are no free places left for new applicants. This is the most common problem due to which parents continue to search for an educational institution.

  • Realization of the rights according to the Constitution to universal access to education;
  • Exercise of the right to study at the actual place of residence in a subordinate school.

2. Obtaining temporary registration for parents and child. More about this below.

    It should be understood that “propiska”, a term previously used in the USSR, is now found only in everyday, colloquial speech, and the word “registration” is a legally recognized term used by law, although in fact these are synonyms and have the same meaning. Permanent registration arises as a result of ownership of property. But the absence of one’s own property cannot affect the exercise of a citizen’s rights. An alternative and so far the only option for legal residence is temporary registration and differs from permanent registration by a limited period of validity. But if there is no registration at all, this is an offense and entails administrative liability in the form of a fine for lack of registration, sometimes of considerable size.

    How long can you live without registration in Russia?

    According to the Federal Law on the Right of Citizens to Freedom of Movement, the maximum period of stay without registration is 90 days. When considering the specified norm of the Federal Law, it is necessary to note the following nuance: the starting point of such a period is the day of actual arrival at a specifically defined place, which is not recorded by anyone. An exception may be in specialized places: hotel houses, hotels, medical institutions, correctional centers and the like - there the administration is obliged to register the length of stay of the citizen, and in case of non-compliance bears administrative responsibility. Thus, we can conclude that if a citizen without registration is not detained anywhere for a period longer than established, in theory he cannot be held accountable, but in reality, in the event of a collision with law enforcement officers, such a fact will be difficult to prove. Some citizens have found a way to avoid punishment for lack of registration by purchasing car and train tickets.

    What to do if they refuse everywhere?

    An educational organization may not accept it if the number of students already exceeds the established norm. In other cases, refusals are unfounded. If the educational institution is overcrowded, parents will have to submit an appeal to the local government education department. The executive authority must receive a written application for the child’s placement in an educational institution. The applicant must provide information about himself, the student, the reason for changing the educational institution, and also justify the choice of a new institution.

    In what cases can you stay without registration?

    Based on the directives of the above law, registration is not required for a citizen in the following cases:

    • for a stay in Moscow, if you have permanent registration in a residential building in one of the districts of the Moscow region;
    • arrival in St. Petersburg also does not require registration, provided that the main place of residence is registered in the Leningrad region.

    Along with the existing clauses, an addition has been added to the Federal Law: residents of the Republic of Crimea with permanent registration also do not need to register upon arrival in Sevastopol. A citizen of the Russian Federation without registration at the place of residence in other cases is obliged to register with the authorized body.

    How to obtain temporary registration

    Such registration is needed by the state to maintain statistical data on population registration, and by citizens as an alternative to permanent registration. Key points that arise after receiving registration:

    • the maximum validity period is 5 years, after which you must register again within 7 days;
    • the opportunity to use all government services, including medical and educational;
    • official employment;
    • social contributions and benefits;
    • the opportunity to enroll a child in school.

    How long will it take to re-register a student?

    Admission is considered valid after the issuance of an administrative act for the school, signed by the director. The administration must meet the deadline (no more than 6 working days), accepting a correctly completed application and receiving a complete package of documents.

    After changing schools, the child will begin a long (and sometimes very difficult) period of adaptation. To make sure that everything is going well in the new place, that the child is not offended by teachers and peers, or that he has not fallen under bad influence, use the “Where are my children” application from the AppStore or GooglePlay. With it, you will always know where your child is now, what route he took during the day, and what is happening around him.

    List of documents for temporary registration:

    • identification document;
    • completed application;
    • If the owner of the property where you are registering cannot be present in person, a statement certified by a notary is required.
    • documents for the property where you are registering;
    • for a child the list is the same.

    You can register by visiting the authorized body, and on the official website of the State Servants online. Obtaining temporary registration is a notification procedure and does not require any checks. By the way, there is no state duty. The period for receiving registration depends on the method of application, but in general it is about three days. If some documents are missing and additional time is required for consideration, the period is extended to eight days, then a certificate of registration with the authorized body is issued. A citizen of the Russian Federation without a residence permit, having received temporary registration, will be able to fully exercise their rights and legally rely on the provision of protection by the state. Administrative liability for lack of registration or late receipt of it If for some reason you still doubt the need for registration, then be prepared to bear administrative liability in the form of a fine. Some types of offenses and fines

    • lack of registration: for residents of Moscow - up to 5,000 rubles, for residents of other cities of Russia - up to 3,000 rubles;
    • late registration – up to 5,000 and 7,000 rubles.

    It should be noted that there are other types of offenses established by the Code of Administrative Offenses. It is important to know that the owner of the property will also be held administratively liable in the form of a fine for allowing citizens to live in their home without registration. Based on all of the above, the obvious preferential, and most importantly, legal option for living on the territory of the Russian Federation is to obtain registration at the place of location. Summarize:

    • registration is necessary for everyone and is mandatory, with the exception of citizens who have stayed in the country for less than 90 days;
    • permanent registration arises on the basis of residential property, and temporary registration on any other property, the only condition: the intended purpose of the object must be housing;
    • the easiest way is to obtain temporary registration, which will also allow you to exercise your rights and move freely around the country;
    • It is quite difficult to get to school without registration, so it is easier for a child to obtain temporary registration;
    • Failure to register is an offense and entails an administrative fine and, in some cases, a criminal fine.

    How to soften the transition

    Nevertheless, if you still need to change schools, if there is nowhere to go, then you need to prepare for this in advance. Here are some basic ways to do this.

    1 Before moving to another school, it is good to talk with a parent who, due to circumstances, moves a lot. Often these are military families. Some career military personnel move a lot, and every time the child is in the position of “new.” Perhaps their experience and advice will be useful to you too.

    Keep in mind that children of primary and secondary classes are not that angry and cruel, but they are demanding and demanding of new children. Children at this age are forming a group identity, and how the collective consciousness will react to this identity - to let in a new person or to reject them - is a very big question. If you have a choice of which class to send your child to, then let it be weaker, but with a better psychological climate. Teams with very strong competition, with a pronounced tough leader or with a history of bullying are dangerous for a newcomer.

    It makes a huge difference whether a child ends up in an established team or goes to a school where the class has just been formed. What was mentioned above most likely applies to a situation where the class has already been formed a long time ago, all the students know each other and have been studying together for more than one year. But there are lyceums and gymnasiums that recruit entirely new fifth or ninth grades. And here the child seems to be going back to first grade: he finds himself in a team where everything is in a state of ferment, where the team is just beginning to take shape, and roles are distributed. This is a completely different story, an easier one.

    2 If you know that your child has communication difficulties, then he needs to work with a psychologist, go to training or go to a summer camp so that he gets the skill of getting used to new social roles (but only to a camp in which you are confident , in which teachers know how to maintain the right moral climate. The first camp you come across may not be beneficial, but harmful).

    It is important to warn the child that at first it will not be easy and you will have to get used to it. If he is anxious or suspicious, this should be done either very early, or, conversely, not too much, depending on the child. Every parent of such a child knows how he reacts, say, to a planned trip to the dentist. Some people need to be prepared in advance so that they can prepare for the situation, calm down and accept it, while others need to be prepared almost the day before so that they don’t screw themselves up. The child must be explained what adaptation is and how addiction occurs. It is useful to talk about your experience, about the experience of your friends: how you went through similar things, what difficulties arose, how you overcame these difficulties.

    But in addition, the child must be motivated as much as possible, explained why this school is better - from an educational point of view, from the point of view of prestige. Try to find something good about the new school, not of an advertising nature, but of a truthful nature.

    4 Be sure to take your child to see the new school. Look at the teachers and, if possible, get to know the students so that he has at least some idea of the school. To do this, you need to contact the administration of the new school in advance and arrange such a visit.

    5 If the relationship with the students at the old school is good, you need to have a farewell party, and also try to preserve as much as possible those connections that the child wants to keep: write down telephone numbers, parents’ contacts, arrange meetings, especially in those three to four months while the child gets used to it. That is, do not trust a child (even a teenager) to record contacts, but duplicate it. After all, due to emotions and embarrassment, a child may not write something. During the first months, you should support meetings with old classmates as much as possible, offer to go for a walk with them, go to the cinema or theater.

    6 It’s good when, when changing schools, a child maintains an out-of-school social circle: his friends from childhood, friends in the country, the children of your friends, friends from the studio, club or scout troop. It happens that even one such out-of-school friend is enough for a child to feel confident in a new school. And he will feel confident because he knows: he has a strong back, he is not alone, he has someone to look to for understanding and support. This is a kind of security guarantee.

    7 It is necessary to find out in as much detail as possible the procedures in the new school, some regime issues, differences in the program, and so on. Sometimes parents chase the prestige of the school, not realizing how enormous the workload is and that the child cannot bear it. If you are going to move to a school where there are really more requirements, it is better to go to preparatory courses there for at least three months, solve all the tasks, study with tutors from this school, so that the child can imagine the volume of workload in practice, study from those textbooks, according to which is taught at this school.

    Typically, all stronger schools have either preparatory courses or electives, or you can individually agree with the teacher about classes. This is also useful as a final check: is it still worth moving here? After all, it may turn out that the gap in preparation is major, that it cannot be overcome, that the child will not be able to study at this level, or will be able to, but with great difficulty.

    In order for a child to study well in a new school, it is important that there is not a huge difference in the level of learning. It’s bad if the new school is much more complicated than the old one, but it’s also bad if it’s much simpler. That is, it is important that the child does not feel like an outsider, but if he suddenly feels like a successful leader in a weak school, this is also bad. If the gap in level between the old and new schools is cardinal, then the main difficulties of adaptation will not be in the social sphere, but in the academic sphere. If you understand that your child clearly will not cope with the curriculum of the new school, hire a tutor to improve him as much as possible in a limited time. It is important that a professional should do the tightening; most likely, you yourself will not be able to cope in the event of a huge gap.

    8 Everything must be done to ensure that the child fits into the social cliché rating as much as possible - improve clothes, phone model, shoes, backpack. Unfortunately, all this is important, and is accepted based on clothing. Especially in a children's environment.

    9 You can make some long-standing desire of a child come true - buy a bicycle of a different model, a hoverboard, something for the computer. Something that is not related to school and that will bring him joy. This joy will be a support for him in the difficult first months, when he will have to spend energy getting used to it.
