How to check out of an apartment through the MFC: instructions for 2021

Modern people are accustomed to saving their time by delegating any tasks to competent persons. That is why even such a simple procedure as deregistration at a specific address should take place with minimal participation of the deregistering citizen. Very often, citizens of our country prefer to check out of their apartment through the MFC - “My Documents” paper collection points. The popularity of these government services is due to the accelerated procedure and the absence of the need for a citizen to independently visit many different departments to obtain the necessary papers. In this material we will talk about exactly how the procedure for deregistration from an apartment takes place with the participation of the MFC.

Check out of the apartment through the MFC

In what cases can you check out of your apartment in 2021?

Thanks to the opening of multifunctional centers throughout Russia, every day more and more of our compatriots prefer to carry out many legal procedures related to the field of housing law through the MFC.
At the same time, registration and check-out from an apartment are among the most popular procedures. So, a person can be discharged legally in the following cases :

  • A person who was registered at a place of temporary stay is forced to move from the address indicated in his certificate.

In this case, both the person wishing to deregister and the actual tenant (that is, the owner), who previously provided the citizen with housing under the conditions established in the contract, can write a corresponding application and contact the multifunctional center.

  • A person moves out of his permanent place of residence.

In this situation, a citizen can be discharged in one of two ways:

  1. deregistration without necessarily moving to a new place of residence;
  2. an extract from the previous place of residence with simultaneous registration at the new address of residence (that is, an extract upon request).

In 2021, it is still impossible to discharge minor citizens of the Russian Federation “to nowhere” (without actual registration at a new address). To do this, you must first obtain permission from the guardianship and trusteeship authorities!

Reasons

Removal of a citizen from registration at the place of residence is possible in the following cases:

  • moving;
  • evictions;
  • loss of the right to use the apartment;
  • cessation of his nomadic or semi-nomadic lifestyle;
  • detection of illegal registration;
  • declaring him missing or dead.

Temporary and permanent registration at the MFC, can it be obtained at any multifunctional center?

In our country, registration (called registration in legislative acts) is of two types:

  1. Permanent registration. It is understood that the citizen resides in the same place on a permanent basis. As a rule, only the owner of the premises makes permanent registration. The owner does not register strangers as this may affect the amount of rent.
  2. Temporary registration. It is issued to all citizens who plan to live outside their permanent place of registration for more than 90 days. Temporary registration at the place of residence (private house, apartment) is issued by shift workers, business travelers, as well as labor migrants moving in search of a better life.

Previously, registration could be completed exclusively at the territorial departments of the Federal Migration Service (now the GUVM). With the advent of the MFC, this service has become more widespread, and now citizens can register at any Multifunctional Center.

Methods for deregistration

There are really different ways to check out. The most common are the following:

  1. Registration immediately to a new place of residence. There is no need to deregister from the previous residential premises; it is enough to write an application for registration in the new housing. The refusal of the passport office in such a situation to require a preliminary extract is unlawful.
  2. Extract "to nowhere". The application indicates where the person intends to register in the future (any address). The MFC employee is given a passport. On average, the procedure takes 7 days.
  3. De-registration with the help of an authorized representative. If the subject does not have the opportunity to sign out on his own, this can be done by a citizen for whom the appropriate power of attorney (notarized) has been issued.
  4. Extract. You need to register on the portal. The service is provided free of charge. You must submit an application and join the queue. Having received the notification, the person must appear at the migration department of the Ministry of Internal Affairs with the necessary documents.

Step by step registration procedure

The registration procedure for a private home through the MFC consists of several key steps. The registration procedure will be approximately as follows:

  1. Make an appointment with MFC staff. This can be done over the phone or through the State Services portal. In addition, you can visit a nearby one at any time and make an appointment using the electronic queue.
  2. Receiving consulting support from MFC specialists on an issue of interest (for example, changing your registration), and setting a date for submitting documents. The passport office in your region of residence can also provide advice.
  3. Collecting documents necessary to register in the house.
  4. Visit of the MFC employee at the appointed time, submission of documents. An authorized specialist checks the submitted documentation and issues a receipt of receipt of the application.
  5. After checking the documents, specialists from the multifunctional center must submit the documentation for registration to the Main Migration Department of the Ministry of Internal Affairs (or the Federal Migration Service). When it is ready, the applicant will be notified remotely.
  6. After some time (usually the wait lasts about 8 days), applicants return to the MFC and pick up documents certifying the person’s registration.

Algorithm for checkout via MFC

To quickly check out from your previous place of residence, you need to responsibly submit an application and collect documents.

The standard procedure for deregistration through the MFC looks like this:

  1. Preparation of a package of documents (it is advisable to make copies of them).
  2. Selecting a department and studying the work schedule of the MFC.
  3. Make an appointment.
  4. Receive an electronic coupon.
  5. Filling out an application for discharge in the free registration window.
  6. Transfer of documents to the employee.
  7. Receiving papers back (except passports) and receipts confirming the acceptance of documents for registration.

At this point, all actions required from a citizen are completed.

Package of documents

The visitor needs to prepare the following documents at the MFC for check-out from the apartment:

  1. Statement (on form No. 6) of intention to be discharged. It is drawn up on the form available at the MFC.
  2. Original passport.
  3. Birth certificate if the person is under 14 years of age.
  4. Title documents for an apartment or house.
  5. Consent of residents (municipal housing).
  6. Consent of the owner of the premises if the apartment is privatized.
  7. Departure sheet or statistical sheet (when leaving abroad).

If the required document is not available, the registrars will not accept the application, so the process will be delayed.

Waiting period and cost of service

The deadline for obtaining an extract through the multifunctional center is slightly different from that provided by the migration authority. On average, deregistration takes place within a week. During this time, documents are checked and transferred to the Department of Internal Affairs of the Ministry of Internal Affairs. The deadline for discharge through the MFC may take up to 10 working days.

There is no charge for the service. If a citizen is required to pay money for an extract, he must file a complaint against the employee’s actions and submit it to the higher authorities of the center.

How to register a child in an apartment through the MFC

Registration of a minor child does not pose any particular difficulties and proceeds quite quickly. However, it must be taken into account that in the future users may encounter problems when registering a minor.

The legislator establishes a condition under which the registration of a newborn will automatically go to the place of registration of the mother. The reason is that parents are responsible for the child. In addition, when it comes to registering a child, you can choose one of several options:

  • registration at the mother’s place of residence;
  • registration of a minor at the father's address;
  • registration with a grandmother or grandfather;
  • A child can be re-registered with a close adult relative, provided that at least one of the parents is registered with him.

Please note that you can register a child with your grandparents until the child is 14 years old and has received a passport. Then he can be registered at a new address, regardless of his parents’ registration, and change his place of residence.

How to check out of an apartment in another city in 2021 through the MFC

The only effective legal way of discharge in this situation is discharge upon request. Thus, in this case, the citizen must be at a new registration address without being deregistered from his previous registration.

In this situation, all that is needed is to contact the employees of the local multifunctional center with a corresponding application for simultaneous registration in a new place with an extract from the previous address.

There are no other ways of remote discharge through the multifunctional center!

Also, due to ignorance of the legal framework, many of our compatriots are faced with a refusal to accept a package of documents when trying to register through a proxy. the whole point is that in this situation an individual must:

  1. issue a notarized power of attorney;
  2. have the application form certified by a notary office, which will need to be submitted to the MFC;
  3. and also hand over your own passport to a trusted person.

At the same time, we remind you that, according to the current legislation of the Russian Federation, namely, clause 22 of the Decree of the Government of the Russian Federation of July 8, 1997 No. 828, Art. 18 of Law No. 114-FZ of August 15, 1996, the transfer of a passport to third parties is allowed only in cases provided for by the law of the Russian Federation, as well as the seizure of this document. That is, the authorized representative will directly violate the law by presenting someone else’s passport of a Russian citizen to the MFC.

Remote deregistration

When considering the question of how to check out of an apartment while in another city through the MFC, you need to take into account several nuances. First of all, you cannot do without a trusted person. Therefore, the package of documents should include:

  • application and power of attorney certified by a notary;
  • passport of the authorized representative and the applicant.

Not every department of the service center provides deregistration by proxy, so it is better to find out this in advance by contacting the MFC. An extract with the participation of such a person is a more complex process, and you will also have to spend money on notary services for paperwork.

Let's sum it up

Anyone who has such a need can check out of an apartment through the MFC. The mentioned organizations were created to ensure that Russian citizens solve various bureaucratic procedures, using the so-called “one-window principle,” which implies resolving all issues and processing documents in contact with only one institution, and sometimes with the same specialist.

This practice has been hastily carried out in our country for several years, attracting more and more new clients. Since the effectiveness of these institutions has been proven by their popularity among ordinary people, we advise you to turn to them for help.

Submitting an application through the State Services portal

You can fill out and send an application for deregistration from an apartment to the Ministry of Internal Affairs using the State Services portal. In your personal account on the portal you will receive an invitation to come to the regional division of the registration authority.

Submit an application for deregistration Go to State Services The originals of the documents specified in the application must be submitted to the Main Department of Migration of the Ministry of Internal Affairs for verification

You can also file a complaint through the portal if authorities require additional documents or payment to deregister.

Price of the procedure

Speaking about the cost of applying to the MFC for an extract from an apartment, it should be noted that in this case it is zero. It does not charge any state fees for providing mediation services to citizens.

However, if you decide to carry out the extract with the help of a trusted person, you will have to spend money at the notary. In general, certifying all the necessary papers and issuing a power of attorney will cost you about 2.5 thousand rubles.

Checking out at the MFC is as easy as shelling pears, so if you are in no hurry, contact this organization

Results of service provision

De-registration is absolutely free and is not subject to fees. The result of this service can be both positive and negative. In a positive case, the person is discharged from his previous place of residence and a stamp is placed in his passport with a note indicating that the citizen has been deregistered.

To avoid fines, do not forget about the obligation to register at your new place of residence after discharge within 7 days. You can also find out how to register for an apartment or house through the MFC on our website.

In the negative case, the citizen receives a refusal. A refusal can be obtained, for example, if a person wanted to check out with the help of a trusted person, but did not provide his identity document.

In case of refusal, the issue can be resolved through the court. To go to court, you need to file a claim with the Magistrates' Court. It is not necessary to personally visit the court office; you can send all documents via mail or courier. If it is not possible to come to court, then you can add a petition to the documents sent to consider the case without the plaintiff. Refusals in court are extremely rare.

How many days does it take to register (permanent and temporary) at the MFC, what are the deadlines?

The registration period is standard, and does not depend on whether it is temporary or permanent. GUVM employees will carry out all registration actions within 3 days. This is the deadline. This time is spent checking the submitted documents and making adjustments to the registration data.

the Multifunctional Center increases the processing time to 8 days, as there is a need to coordinate the actions of interdepartmental agencies.

Service cost

The service for registering Russian citizens at their place of residence is absolutely free, and Russians do not need to pay any fees.

As for foreign nationals, as well as stateless persons, services such as registration will be paid for them. A duty of 350 rubles is provided.

Special cases of deregistration

Depending on the circumstances, status and personality of the subject who wants to be discharged, there are certain features of deregistration. For example, in the case of discharge without further registration, the applicant may provide inaccurate information about future registration. This practice is observed when selling real estate. However, it will not be possible to do this with a minor child, since his registration is strictly monitored by the guardianship and trusteeship authorities.

It is possible to discharge a subject without his consent, but this will require a court decision.

With debts

If there are debts on utility bills, MFC employees are required to check out the living space at the request of a citizen . In this case, it does not matter whether the applicant is the owner or not. You can deregister under any circumstances.

The presence of debts becomes the reason for refusal to register a purchase and sale transaction in Rosreestr . If an MFC employee refuses to accept documents to an applicant or asks to show an extract from a personal account for real estate, he can complain to senior management or go to court.

Discharge of the deceased

To discharge the deceased from the apartment, you need to contact the nearest MFC with documents. There is no specific time range when you need to submit documents for the discharge of a deceased person, but you should not delay this, because... rent will be charged on it and this will be an encumbrance upon the sale of the property. The procedure for discharging a deceased person is simple. First you need to obtain a document - a death certificate.

And with this document you can go to the MFC and write an application to deregister the deceased.

In the event that it is necessary to discharge a person who has disappeared for a long time, he can only be declared dead through a court. You can submit an application immediately after circumstances that could lead to the death of a citizen or his absence for 5 years (for participants in hostilities the period is shorter - 2 years). After studying all the facts, the court decides to declare the person dead. And with the court’s decision, you can go and discharge the person. The date of entry into force of the court decision will be considered the day of death. If the person turns out to be alive, then he retains all rights of ownership of the property.

Extract "to nowhere"

Let's consider two situations of deregistration from an apartment without further registration in another. There are no obstacles to discharging an adult citizen “to nowhere.” When submitting an application, you are required to indicate the address where citizens are leaving - it can be specified arbitrarily, there are no sanctions for this. You can write “to nowhere”:

  • if you urgently need to sell an apartment;
  • if a person must be discharged by court decision;
  • if a person is serving a prison sentence.

But it is impossible to discharge a child under 18 years of age “to nowhere.” This is monitored by the guardianship and trusteeship department, and no specialist will risk discharging the child without their consent in writing. Even if the apartment is sold, if the child is not registered at a new address within the established time frame, the extract will be canceled, and the state registration of the right to real estate will lose its legal force.

Discharge of children

It is difficult to discharge children from an apartment, since additional certificates and permissions from authorized bodies are required . In addition, a minor child cannot be sent “to nowhere.” It is required to submit an application to the MFC for simultaneous deregistration and registration at a new place of residence.

In addition to the previously provided package of documents, official representatives of the minor must submit :

  1. Permission from the guardianship authorities, which conduct additional verification of the family and the characteristics of the previously received registration. Attention is also focused on determining the conditions for the child’s future residence.
  2. At least one parent must be registered with each child. If the second parent is registered separately or does not participate in the deregistration, he must give permission to remove the minor from the register.
  3. When submitting an application, you must indicate the address of the child's subsequent registration. The location must be approved by guardianship officials.

Depending on the situation, additional problems may arise . Often, guardianship authorities carefully study cases when they simultaneously sell real estate in which a minor has a share.

Extract without consent

In exceptional cases, a citizen can be discharged from an apartment without his consent. Basically, such actions are carried out only through a court decision. You can be discharged without trial if:

  • the person is serving time in prison (it is necessary to provide a decision on the criminal case);
  • serves in the armed forces (provide a certificate from the military registration and enlistment office);
  • the person has died (death certificate provided).

Automatic checkout

A citizen can be discharged directly upon registration at a new place of residence. In this case, the time frame for registering in Balashikha may be slightly delayed, since the employee will need to wait for a response to the request from his previous place of residence.

About the opportunity

What needs to be done to check out of housing and register in another?

This version of the double procedure, when a person applies at a new place of residence for registration and simultaneous discharge from the previous place, is completely legal , since in paragraph 129 of the Administrative Regulations of the FMS, approved by Order of the Federal Migration Service of the Russian Federation dated September 11, 2012 No. 288 (as amended on January 19. 2015), describes the entire procedure for such a registration action.

The option of simultaneous checkout from one home and immediate registration in another is not only legal, but also convenient , as it saves time for citizens, and the paired procedure is available not only within the same locality, but even in a completely different region.

You can learn about whether it is possible to check out of an apartment to nowhere, as well as how to check out while in another city, from our articles.

Features and nuances of design

A special feature of checking out through the MFC is that you are checking out through an intermediary. The migration service itself is responsible for deregistering citizens. Multifunctional centers only accept documents and submit them to the relevant authorities for consideration.

MFCs themselves appeared due to the workload of the departments of the Main Department of Migration Affairs of the Ministry of Internal Affairs. So the waiting time for discharge increases slightly. This must be taken into account.

Another nuance is the limitations of the regulations for the provision of services to MFC employees.

For example, employees of multifunctional centers do not have the right to demand from the applicant a military ID or documents for an apartment.

And if you register at a new place along with the extract, you will definitely need the consent of the owner.

To summarize, we can say that issuing an extract through the multifunctional center is the most convenient way, which, although it will take a little more time, will save you from the need to stand in queues. It is best to use this method only when you have the opportunity to appear at the MFC in person. Otherwise, you will have to incur unnecessary expenses and inconvenience. In addition, it is not a fact that your application will be approved in principle if it is submitted by a trusted person.

Legal representative

If for some reason a citizen cannot personally go through the registration procedure, it is possible to issue a notarized power of attorney to a third party. In addition to the basic package of documents, the legal representative will need to provide his passport and a notarized power of attorney.

Features of registration in Moscow and St. Petersburg

Moscow and St. Petersburg are the leaders in the number of migrants, which is why migration policy here differs from other settlements. Citizens who want to leave their city and move to live in the country's largest metropolises should know that the rules for migration registration here are more stringent.

There is a rule according to which it is prohibited to live in Moscow and St. Petersburg for more than 3 months without registration. Therefore, many migrants use the services of fictitious registration. However, GUVM employees regularly conduct raids, and if a fictitious registration is discovered, the violators will be held accountable. Criminal proceedings are provided for the owner and residents of so-called “rubber” apartments.

When documents can be rejected

In addition to the situation described above, citizens may receive a refusal from an MFC employee to accept documents in the following cases:

  • the content of the application cannot be read or the document was submitted by an unauthorized person;
  • documents that are required to be submitted were not provided to the MFC;
  • movement within the territory of Russia was limited by Russian legislation (for example, “martial law” was introduced).

At the same time, the law does not provide for refusal to provide the service in question or its suspension for any period. Also, every citizen has the legal right to file a complaint against an action/inaction or against the final decision of the registration authorities in the event of:

  1. refusal to correct various types of typos and errors that were made when preparing documents by employees of the multifunctional center;
  2. violation of the deadlines for the provision of public services or the deadlines for registering an application;
  3. requirements for documents that are not listed in the list approved in the Administrative Regulations;
  4. demands from the applicant for a fee that is not established by current legislation;
  5. refusal to accept documents that must be accepted in accordance with the terms of regulations.

Regulatory framework

All aspects of citizen registration are regulated by the following documents:

  1. Federal Law “On the right of citizens of the Russian Federation to freedom of movement...” of June 25, 1993.
  2. Decree of the Government of the Russian Federation No. 713 of July 17, 1995 “On registration and deregistration of citizens...” and related Government Decree No. 809 of August 15, 2014 “On amendments to Decree... No. 713”.
  3. Housing Code of the Russian Federation. Art. 70-85 establish the procedure for registering residents in non-privatized apartments.
  4. The Code of Administrative Offenses (Article 19.15) lists sanctions for failure to register.

The system of all regulatory legal acts in the Russian Federation has a hierarchical structure, which in controversial situations presupposes the predominant action of those located above. At the very top of this structure are the articles of the Constitution of the Russian Federation; at the last stage - acts of local government bodies.

How to check out and register at the same time

Extract and registration simultaneously through the MFC are done in one window when applying . This does not increase the application processing time. The only difference in the presented situation is the list of required documents.

To check out and at the same time register in new housing through the MFC, you need to prepare the following papers :

  • applicant's passport;
  • birth certificate, if a minor citizen is deregistered at the same time as an adult;
  • application for discharge and simultaneous registration in new housing;
  • documents for real estate where it is planned to make a new registration: certificate of ownership, extract from Rosreestr;
  • notarized power of attorney from property owners who are not against the applicant’s registration on their living space.

When registering in a place other than your own, MFC employees only need to provide written and notarized consent from the owner. In order to save money, the owner of the living space and the registered citizen can contact the center together. If there are several property owners, the consent of each or their personal presence at the MFC on the day of submission of the application is required.

Standard document processing cannot take more than seven business days . But often the deadlines increase, which is explained by possible difficulties or additional verification by employees of authorized bodies.

The procedure for obtaining services at the MFC and the necessary documents

Multifunctional centers were created both to simplify various bureaucratic procedures for citizens and to relieve the burden on government agencies. All information in the databases of the MFC and the migration authorities of the Ministry of Internal Affairs is stored identically, so there will be no delays or inaccuracies.

Checking out of an apartment through the MFC is very convenient, because... Documents are received in one window, which significantly speeds up the process. Submitting and checking documents takes no more than 15 minutes.

For discharge, you can come to the multifunctional office in person, carry out the procedure through a proxy, or simultaneously with registration at a new place of residence (only if the old and new housing are located in the same city or service area of the MFC). Employees of the organization will accept the prepared documents and application and begin processing.

Before visiting the MFC, find out what documents you will need. In some cases, additional paperwork is required.

As a standard, to make an extract you need to provide:

  • statement;
  • passport.

If a person, along with an extract, wants to register in a new place and is not the owner of the property or a tenant there, then it is necessary to provide the consent of the owners of the property at the place of future registration.

The application is reviewed within three days.

If you simultaneously register at a new address, then the old registration entry does not have to be removed. If the old and new housing are located in the same service area, this will be done automatically during the registration of new registration at the place of residence.

In order to be deregistered simultaneously with registration in a new place, you must provide:

  • passport;
  • 2 applications – on registration and deregistration;
  • document on the ownership of the housing, where he is going to register if the applicant is the owner;
  • consent of the owner of the apartment, if the applicant is not the owner.

According to the above scheme, it is impossible to check out of the apartment through the MFC “to nowhere”. To check out of the apartment without further registration, you will have to appear before the authorities personally or to a trusted person.

Required documents

What should you take from the documents? The list of required documents is given in clause 26 of the Admin. FMS regulations, which include:

  • passport;
  • application in form No. 6 (both parts);
  • documents for the apartment;
  • written consent of the owner;
  • if the housing is municipal, then the written consent of all adults.

The owner, in addition to his consent, must also present identification.

The application deserves special attention - form No. 6, on which the upper part is an application for registration, and the lower part, the so-called tear-off coupon, is for cancellation of registration at the previous address.

Both the applicant and the one who provides the roof for permanent residence sign Form No. 6 with their own hands, and then the employee has the right to certify their authenticity with his signature and the seal of the accounting authority.

Where to submit documents? Papers are submitted to a “single window”; this is specially done to ease the fate of citizens. Now there is no need to submit each paper to a separate office: all issues are resolved by a specialist who conducts the reception in a “single window” , and is also obliged not to delay the visitor for more than 15 minutes (clause 38 of the Administrative Regulations).

If the papers are not complete, then they are allowed to be delivered, and in this case the applicant will spend no more than 10 minutes communicating with a specialist (clause 38 of the Administrative Regulations).
