Registration at the place of residence is called permanent registration, and at the place of stay - temporary. Their main difference is the time frame. Permanent registration does not have them at all, and temporary registration is valid for a certain period .

  • Registration period has expired
  • Extension of temporary registration
  • Where to submit documents?
  • Statement
  • Registration deadlines and state fees
  • What to do if the certificate is lost?

Registration period has expired

A temporary move to another locality must be supported by registration if the duration of stay there is more than 90 days . This information is contained in Federal Law No. 5242-1. Registration is issued for a certain period, after which it becomes invalid. The duration of this period is set individually, by agreement between the owner of the residential premises and the person in whose name the registration is issued.

In accordance with the Civil Code of the Russian Federation (Articles No. 683 and 685), there is a limitation on the minimum period, which must be at least 6 months, and also on the maximum - no more than 5 years.

What can be taken as a basis

Let's start with the fact that the renewal of registration of a foreign citizen detained in the Russian Federation at the place of stay will not be carried out unless there are sufficient reasons for this.

RVP example

In 2021, if a guest decides not to contact the GUVM, after 3 months of his stay in the country have expired, he becomes a violator to whom sanctions are applied. Failure to comply with the terms of stay without reason is punishable administratively.

Obtaining a temporary residence permit

Please note that a temporary residence permit is necessary for representatives of those countries with which Russia has entered into agreements on a visa-free regime. Guests from other countries must adhere to visa requirements.

The grounds for obtaining permission to stay in Russia may include:

  1. Admission to a university in the country.
  2. Obtaining a patent.
  3. Obtaining the official status of a highly qualified specialist.
  4. Documented expectation of a residence permit or receipt and extension of a temporary residence permit.
  5. The prospect of extending a working visa.
  6. Waiting to receive permission to work in the country.

For citizens of Kyrgyzstan, Armenia, as well as Belarusians and Kazakhs, the basis for obtaining an extension may be the conclusion of an employment contract with one of the Russian companies.

If the guest arrived on a visa, the application to extend the registration of such a foreign citizen will not be considered.

Extension of temporary registration

After the registration period expires, the right of temporary residence in the given territory is terminated . How can I renew my registration?

It would be correct to call this procedure not the renewal of an existing registration, but the registration of a new one.

Therefore, the algorithm of actions that need to be performed is the same as for initial registration. You should definitely take care of the consent of the apartment owner, as well as his personal presence when submitting the application. As a basis, you must present a certificate of ownership of housing, a rental agreement or the official consent of the property owner.

When applying for registration, you need to ensure that you have the necessary documents:

  1. Applicant's passport;
  2. Consent of the owner of the apartment, in the case of several owners - consent of each of them, in writing;
  3. A document that serves as the basis for the use of residential premises - ownership or a lease agreement;
  4. A temporary registration document that was issued earlier and has lost its legal force.

General provisions of the registration procedure for foreigners in Russia

The need to register foreigners arriving in Russia for more than a week and wishing to stay longer arose when the influx of visitors from the CIS assumed catastrophic proportions.

The economic situation in many neighboring countries, even 25 years after the collapse of the USSR, remains deplorable. This forces citizens of neighboring less prosperous countries to look for a better life.

You can learn about the registration rules from the video below.

Flow of people arriving in Russia

Along with law-abiding Ukrainians, Moldovans, Belarusians, Uzbeks, etc., criminal elements from these countries and those who intend not to work, but to engage in fraud or beg, come to the Russian Federation. As for employment, here too, as they say, Russia is “non-rubber”.

In order to regulate the flow of visitors for a long time, in 2007, at the government level, it was decided to tighten control over the flow of arrivals into the country and limit the period of stay of foreigners on the territory of the Russian Federation.

What is the registration procedure?

In general, the procedure is called migration registration at the place of stay. All its stages are regulated by law.

Primary registration is required if a foreigner intends to stay in Russia for more than a week.

It is not the guest himself who turns to the Main Directorate for Migration Affairs of the Ministry of Internal Affairs, but the Russians in whose living space he has settled. The documents required for registration of a foreign citizen arriving in the Russian Federation and its renewal are provided by the visitor.

The initial submission of information about a new arrival, as well as the renewal of a permit, begins with the submission of an almost identical list of papers. The only difference is that in the first case, refusals are an exception to the rule, in the second they are a frequent and completely natural phenomenon.

According to the Law, both individuals and organizations that operate legally on the territory of the Russian Federation can receive guests from near or far abroad.

Where to submit documents?

The first option is to submit the application and collected documentation directly to the Federal Migration Service. In addition, in almost every corner of Russia you can find Multifunctional Centers (MFCs), which help citizens with the preparation of many documents and benefits.

And also, it is possible to use the most modern technologies and express your desire to register through the State Services website. To be able to use the services of the site, you must register on it. And the last option is to send documents to the Migration Service office by mail.

Instructions for registering

  1. The first step is submitting documents. If you apply to the Migration Service or the MFC, they are submitted in person and copies are attached to them. When registering through Gosuslugi, electronic versions of documents are sent.
  2. Next, you need to wait a little - usually a three-day waiting period is required. However, depending on the situation, it can be extended to 8 days. In the case of the option of submitting an application electronically, within three days information should be received with the date when you need to visit the FMS office.
  3. The final stage is a visit to the Federal Migration Service or MFC to obtain a registration certificate (form No. 3). For those who submitted documents online or in person to the FMS, a certificate will be issued at the migration service department. If the application was accepted by the MFC, they will also issue the result.

Consequences of delay

If a foreigner has not been registered within the prescribed time frame or has not renewed his existing registration, he will have to face some unpleasant consequences. These include:

  • a large fine is imposed for overdue temporary registration;
  • if the delay is only a few days, then any punishment can be avoided if the person promptly leaves the country;
  • if the delay is significant, then even when crossing the border a violation will be detected;
  • if the lack of registration is discovered by FMS or police officers, the foreigner is forcibly deported to his home country;
  • In case of a repeated violation or a long stay in Russia without registration, a ban on entry into the country may be imposed altogether.

If measures in the form of a ban are applied to a foreigner, then if in the future he wants to visit Russia again, he simply will not be able to cross the border. Therefore, a fine for late registration is considered not too harsh and severe a punishment. Before traveling, every foreigner should make sure that there is no prohibition, and information can be obtained on the website of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs.

Statement

Employees of the selected organization will issue an application form (form No. 1), which must be completed. an electronic version of the application on the State Services portal .

You can also use a sample if necessary to avoid mistakes. There should be no corrections in the document.

Information that the application must contain:

  • The organization to which the application is sent;
  • personal data of the applicant: full name, permanent registration address, passport details;
  • the address of the premises in which he plans to temporarily reside;
  • grounds for temporary relocation;
  • details of the property owner: full name, passport details
  • signature of both parties, as well as the date.

Amount of fine

If registration is expired, what fine will foreigners have to pay? The amount of such punishment depends on the region where the person is located. The minimum charge for such a violation is 2 thousand rubles.

The maximum fine is 7 thousand rubles, and in cities of federal significance the punishment is considered the most severe. Therefore, foreigners must approach mandatory registration responsibly in order to avoid paying a large fine for overdue registration. You can find out exactly how much money will have to be transferred directly from the Main Migration Department of the Ministry of Internal Affairs.

Registration deadlines and state fees

three days are enough to register . It is possible to shorten this period, up to one day, and extend it for up to 8 days. It all depends on the completeness of the collected documentation.

For citizens of the Russian Federation, according to the law, there is no provision for paying a state fee in order to register at the place of residence or stay.

The only expenses that you may incur are paying a fine for staying with a registration that has expired.

Who has the right to do this?

Who has the right to renew registration? Of course, these are citizens of our country who live outside their place of permanent residence and, for objective reasons, cannot leave it.

This is due to work or study, and in some cases, treatment in medical institutions.

In addition, foreign citizens may also apply for an extension of temporary registration for a number of reasons listed in the paragraphs above.

Do foreigners who do not live at the place of registration face a fine?

There are frequent situations when foreign citizens register at one address, but actually live in another property. For such a violation a fine may be imposed on the basis of Art. 18.1 Code of Administrative Offences. But according to the Constitution of the Russian Federation, every person, regardless of nationality and citizenship, can move freely around the country, so being in another residential area is not a violation.

Therefore, foreigners can temporarily stay in the apartment of friends or relatives, or go to another city as part of a tourist group. If there is evidence that the absence from the apartment where the person is registered was temporary, punishment can be avoided.
