Announcement for neighbors about apartment renovation

We ask you to listen to our problem, highlight some of the legal aspects of the issue and, if possible, give advice on how best to proceed in this case.

The fact is that on January 27, 2009, there was a severe flood in our apartment. At this time we were not at home, since at the moment we are not living in this apartment, due to renovations (the apartment is in a new building). The last time we were in the apartment was on Sunday, January 25th. On January 27 at 16-50 we received a call from neighbors that our apartment was flooding. One of us (the husband) was on site 15 minutes after the call. The apartment was flooded ankle-deep with hot water, but there was no longer a leak since the hot and cold water risers were shut off, according to the neighbors. At about 5:30 pm the plumber on duty came, he did not find the cause of the leak, they turned off the water in the apartment and turned on the water in the common riser. During this entire time, we pumped out the water on our own. After pumping out the water, we left the front door open to let off steam and dry the apartment, and left ourselves, leaving the keys to the neighbor on the floor. Later, a neighbor from below called us, making a claim for damage to his apartment. Since the door to our apartment was open, he was able to get into it with the plumber on duty (without our knowledge) where they found the cause of the flooding - a rupture in the flexible hot water supply in the bathroom under the sink (they took photographs). The next day, a commission was created from the service organization at the request of the neighbor below. At approximately 10 am on January 28, the commission and a neighbor entered our apartment (without our knowledge - the neighbor on the floor opened the door because he could not reach us) and drew up an inspection report (attached below) confirming the accident in our apartment and with an inventory apartment leaks below.

Please pay attention to the following points:

1) The rupture and leakage occurred during technical work with the hot water supply by the service organization, as evidenced by the advertisement that we photographed. (Maintenance work was carried out from 15 to 17 hours on January 27, 2009)

2) On January 28, the service organization told us that there could be no water hammer, since they did not drain hot water from the riser, and resumed the flow of hot water at 17-00 on January 27, 2009. However, according to the report of the plumber on duty, at 16-15 they turned off the common riser! Why, if the water was turned off until 17-00?

3) The inspection report for the apartment on the floor below, dated January 28, states that the floor in the entire apartment is flooded with water! (Which indicates that the neighbor below, by not removing the water, aggravated the damage caused to both his apartment and the apartments below!)

4) Also, according to the neighbor on the floor, the plumber on duty, when determining the cause of the accident, identified a factory defect in the flexible hose (which was not indicated in the report). We have saved the sales receipt.

5) Please also take into account that our apartment has special reducers installed against pressure surges and all pipe joints are soldered. All plumbing work was carried out by qualified specialists, but unfortunately we do not have any documents confirming this. But the installation of this particular hose was carried out by the foreman of the organization servicing our house before January 1, 2009. According to this foreman and the current service organization, there are no documents left from that organization. But this master is ready to confirm in court (if the case comes to him) the quality of the work he performed.

I would like to get your opinion on this situation, since the neighbor below is going to call an independent expert and sue us. Is there a chance to prove our innocence and what do you think is required for this?
