Who should seal seams in a panel house?

Major and current repairs allow you to preserve and maintain residential buildings in proper condition. Therefore, management organizations must carry out the necessary types of work in a timely manner. The facade of the building belongs to the common property of the building, so the decision to repair it is made at a general meeting of owners of the apartments in the building.

In accordance with Part 3, Article 154 of the Housing Code of the Russian Federation, panel construction involves sealing the seams after the house shrinks and from time to time as the plastic properties of the sealants are lost. Apartment owners pay for the management of an apartment building, its maintenance, current and major repairs of common property.

The maintenance of common property is one of the responsibilities of the management company, so they have no right to refuse to seal interpanel joints. Clause 4.10.2.9 of the Rules and Standards for the Technical Operation of the Housing Stock determines that control over the state of sealing of seams of external walls of fully prefabricated buildings, window and door units should be carried out for the first time - 3 years after sealing, subsequent ones - after 5 years.

This is interesting! Residents often have problems sealing seams on the façade of a building in the balcony area. Management companies refuse to cover up the seams, citing the fact that the balcony is private property and does not belong to the common property of the house. Official documents do not distinguish between panel joints between common property and private property. Therefore, seam repairs are carried out by the management company.

Sometimes there are urgent cases of repairing seams on the outside of the house - the seams are leaking, dampness and fungus appear in the apartment. You write an application to the management organization, but they either ignore the application or take their time. You can carry out the repairs yourself, but in order to recover the money spent from the management organization, you will need to justify the importance and urgency of the repairs, provide photographs, and invoices for materials. Supporting documents along with the application for a refund are provided to the management company. In case of an unmotivated refusal, the funds spent on repairs can be recovered through the court.

Current repairs are carried out regardless of the decision of the OSS

Management organizations and homeowners' associations responsible for maintaining the common property of apartment buildings should not wait for residents' requests to carry out routine repairs or the decision of the general meeting of owners.

The MA should remember that:

  1. Current repairs of the common property of apartment buildings should be carried out every 3–5 years (clause 3.2.9 of the State Construction Committee Resolution No. 170 dated September 27, 2003).
  2. The obligation to carry out repairs is assigned to the management agreement and the norms of the Housing Code of the Russian Federation, No. 384-FZ, RF PP No. 491, Resolution of the State Construction Committee No. 170 and does not depend on the presence of a decision of the general meeting of owners of premises in the apartment building.
  3. Carrying out current repairs, the financing procedure for which is defined in the management agreement, does not require an additional decision by the OSS. The obligation to carry out such work lies with the management organization, even if the owners refused to carry out routine repairs (appeal ruling of the Altai Regional Court dated 09/06/2017 in case No. 33-9061/2017).
  4. The court, when considering claims against the management company for failure to carry out repairs, does not take into account the arguments that the organization began managing the house recently and all the defects and violations of the maintenance of the common property existed previously. These circumstances do not relieve the management company managing the house at the time the owner applied to the court from the obligation to carry out routine repairs (appeal ruling of the Altai Regional Court dated 09/06/2017 in case No. 33-9061/2017).

For improper maintenance of the common property of an apartment building, the management authority may be held administratively liable under Part 2 of Art. 14.1.3 Code of Administrative Offenses of the Russian Federation for operating an apartment building in violation of licensing requirements.

The courts also satisfy the owners’ demands for compensation from the management organization for moral damages and payment of a fine for refusal to carry out routine repairs under Art. Art. 14, 15, part 6 art. 13 No. 2300-I “On the protection of consumer rights” (decision of the Podolsk City Court of the Moscow Region dated September 28, 2017 in case No. 2-2453/2017, appeal ruling of the Altai Regional Court dated September 6, 2017 in case No. 33-9061/2017).

Requirements for interpanel seams

The joints of house panels must meet the following requirements:

  • protection from moisture is achieved through the use of sealing mastics, ensuring surface preparation and compliance with the technology of their application;
  • protection from exposure to outside air is achieved by using sealing gaskets with a compression of more than 30 - 50%;
  • thermal insulation is ensured by installing insulating packages.

All butt joints that have leaks must be sealed from the outside with effective sealants by specialists from the management organization or a contractor company hired by them. Sealing work should be carried out as soon as possible while preparing the house for winter use.

The Technical Regulations for the Safety of Buildings and Structures determine that the safety of a building during its operation is achieved by technical standards. maintenance, timely inspections and checks of the condition of the foundation, structures and utility systems, as well as ongoing repairs of the building.

Filing a complaint to higher authorities

The refusal of the utility companies to seal the interpanel seams and ignoring the application should be filed with a complaint to higher authorities. Appeals to higher authorities are carried out according to the same scheme. Do not forget that the Housing Office often ignores the instructions of the State Housing Inspectorate. In this case, you should go to court or complain to the prosecutor's office.

You should be persistent in your demands and not remain silent in response to the inaction of the management company’s employees. Otherwise, the “communal chaos” will never end.

How to fill out an application?

In order for the application to be even considered, it must be filled out correctly. Everything matters: from a well-made hat to the date stamped by the secretary.

The application must describe the problem as accurately as possible:

  • where the damage is located (to the left of the window, to the right, etc.);
  • what problem does it cause (winding, cold, wet);
  • where and when it begins to appear (in spring, winter, during rain, it flows from the ceiling to the floor);
  • what furniture is located close to the problem area;
  • Do neighbors have the same problem?

The main task is to describe the problem as accurately as possible, despite the fact that audit and inspection are also the responsibilities of the management company. You need to come to the management office with the application and make sure that the secretary puts the date on it, the incoming number, and also signs for receipt. After all the notes have been made, you must make a copy. If the application is lost, the rights of the residents can be defended using a copy.

The number of such statements is of great importance: the more personal and collective complaints from residents, the faster the management company will begin its duties. But if requests are ignored or delayed for some reason, apartment owners have the right to appeal to a higher authority - the State Housing Inspectorate or Rospotrebnadzor.
