Bureaucratic difficulties: what documents need to be changed when changing registration?

June 25, 2020

Adviсe

You will have to replace documents related to real estate and report the change of name to the Pension Fund, management company, bank, certification center that issued the electronic digital signature, and the chairman of SNT

A change of surname is not a basis for terminating or changing previously acquired rights and obligations: documents on education, qualifications and work remain valid, property rights remain unchanged and debts do not disappear. However, the person will have to replace the documents and report the change of name to interested parties, for example, the employer, bank or bailiffs, if enforcement proceedings have been initiated, etc. If this is not done, then government agencies may impose fines, for example, for late replacement of a passport, or apply sanctions under agreements with counterparties, for example, the bank will require early repayment of the loan. There may also be difficulties in exercising your rights, for example, when selling property or collecting debts under writs of execution.

In this article, we will look at which documents do not need to be changed after changing your last name and which need to be reissued in order to continue to use and manage real estate.

What documents need to be changed if you change your place of residence?

We registered in a new place, moved and began to settle down. However, there is one unfinished business left - documents. Read more about which documents need to be amended below:

  1. Identity documents.
  2. Military ID.
  3. Vehicle registration certificate.

Documents that do not require replacement, but require updating data in the registry:

  1. SNILS.
  2. Certificate of ownership.
  3. Driver license.
  4. Compulsory medical insurance policy.
  5. Technical passport (PTS).
  6. Bank cards and accounts.
  7. Account number.
  8. TIN.
  9. Birth certificate (for citizens under 14 years of age).

Replacement of documents is the key to quality service in authorities and institutions. Remember this.

Normative base

Instructions on the need to update documents when changing address are contained in the following documents:

  1. Tax Code, Article 84.
  2. Law No. 196-FZ on vehicle registration issues.
  3. Law No. 326-FZ as it relates to health insurance policies.
  4. Law No. 210-FZ, which deals with the provision of public services.

In some cases, we may be talking not only about legal provisions, but also about internal departmental documents that clarify existing legal norms.

Do I need to notify authorities and institutions about the new registration address?

Your primary task when changing your place of residence is to contact the Ministry of Internal Affairs and notify it of the change of permanent residence or registration.

MVD (Ministry of Internal Affairs)

You must enter new data in your passport here , as well as update the information in the certificate of ownership and compulsory health insurance policy.

A document that plays an important role in your life, because not a single procedure in government institutions is carried out without it. It must contain truthful information, because employees of other services will rely on it when providing you with certain services. Therefore, the first place you need to visit after moving is the Ministry of Internal Affairs.

If desired, the passport can be replaced during the procedure for changing registration at the MFC or the passport office of the Criminal Code, but the principle of operation of these places is inextricably linked with the same Ministry of Internal Affairs (read about how to change your registration through the MFC here, and here you can find out how do this through State Services). They will collect the data necessary to replace the document and send it to the migration service. So the whole process will take 6 days instead of 3. During this time, you will be issued a temporary identity card.

Do I need to change the certificate of title? This document confirms the fact of ownership of the living space and does not need to be replaced, but it is necessary to make amendments to the unified state register database in order to update the data. This process will take 3 days. To do this, provide the following documents to the employees of the MFC or the reception department of Rosreestr:

  • passport with new registration and arrival address sheet;
  • receipt of payment of state duty (350 rubles).

In the compulsory medical insurance policy you are unlikely to find complete information about yourself, but most often you are asked for the series and number of this document. All this is done so that when entering these numbers in a database search, more information about you can be obtained. Information about you must be reliable, so the process has a deadline of 1 month.

Reference: if previously it was mandatory to notify the insurance service about changes in certain personal data, today this is done by employees of the Ministry of Internal Affairs. As soon as you register in a new place, they will notify other services about this in the form of a newsletter.

This significantly reduces your time spent replacing papers.

Military registration and enlistment office

Contact the military registration and enlistment office at your place of registration and provide them with your old military ID along with your application. The military registration and enlistment office will take further actions itself (it will send a request to remove you from the register of one institution and register you with another, within 5 days you will be transferred).

traffic police

If you have a car, it must be registered in your name. The traffic police will have to replace the certificate. Do not forget to take with you your passport (with registration at your new place of residence), vehicle passport (PTS) and compulsory insurance policy. When you fill out an application to replace the vehicle registration certificate, attach the old certificate to the application.

A new document will be issued to you on the same day. You can contact the tax and insurance company with this document to correct it. Replacing a certificate requires payment of a state fee, it will be 500 rubles.

Tax

From Federal Law No. 129-FZ of 08.08.2001 “On state registration of legal entities and individual entrepreneurs”, para. 5 hours 4 tbsp. 5 it follows that if you are an individual or legal entity, the body regulating the registration of citizens undertakes to independently enter new information about you into the state register database based on the information provided by it no later than 5 days.

All other government services also have access to this database, which simplifies life and saves time when replacing documents. It turns out that the Ministry of Internal Affairs will notify the tax office about the change of your registration, and the inspection, in turn, will itself notify the Pension Fund and the Social Insurance Fund about the change of residence of the citizen without his participation.

Bank

Notifying the bank is necessary to update your personal information and notify you of current rates.

Attention: replacement of cards is not required; they are changed only for more significant changes.

The bank that serves you is not one of the places for which the tax office is responsible for notifying you, so you will have to do this yourself.

Clinic

Usually you receive certificates at the clinic at your place of residence - this is convenient and allows you to distribute the number of people approximately equally between the institutions of the locality. Therefore, after moving, you need to visit the territorial clinic and be assigned to it.

To do this, you need to do a few simple but time-consuming steps:

  1. First, visit your “old” clinic and notify the employees of the refusal of their services by writing a corresponding application addressed to the chief physician for the issuance of an outpatient card.
  2. When he signs the paper and you receive the card, you will need to write an application for service to the clinic at the place of your new registration. Likewise, after the application is signed by the head physician, you can seek help from a medical institution.
  3. Do not forget to bring photocopies of documents (passport and compulsory medical insurance policy) to the new clinic and attach them to the application to justify the reason for the transfer from one clinic to another.

Insurance Company

The insurance company also needs to be notified of a change in place of registration. There is no need to pay for this, just write an application and you're done.

Social Protection Center

You should definitely visit the Social Protection Center if you receive benefits delivered to your home. If you receive benefits via a bank card or during a personal visit, then it is advisable to complete the procedure. There, similarly, you will be asked to write a statement indicating new data.

Where will you need to contact?

Changing the place of registration requires mandatory contact with the following authorities:

  • to the official employer;
  • to the military registration and enlistment office;
  • to the traffic police (if you own a vehicle);
  • to the bank where the loan was taken out or the deposit was made (most often this need is specified in the agreement with the banking institution);
  • to the Pension Fund if a citizen is applying for a pension.

Let's take a closer look at the documents that will still undergo changes.

What to do if you are an individual entrepreneur?

The individual entrepreneur does not need to additionally notify anyone that he has changed his registration; it is enough to contact the Ministry of Internal Affairs, which will send updated data to the tax office, then the Federal Tax Service will make changes to the Unified State Register of Individual Entrepreneurs. Federal Law No. 169-FZ of July 1, 2011 abolished the obligation to report changes in the passport and change of residence address. Now they are provided by the registration authority in the following electronic form, which simplifies the process of changing registration.

Inspectorate employees will make changes to your registration data, forward the registration file, and notify the Pension Fund of the Russian Federation, the Social Insurance Fund and the Compulsory Medical Insurance Fund.

In what cases is permanent registration changed?

Citizens can change their registration in various situations. Buying a new apartment or moving are just a few of them. You must be removed from permanent registration on the following grounds:

  1. After the person liable for military service was called up for compulsory military service.
  2. If, according to a court verdict, a citizen is serving a sentence in prison.
  3. In the event of death or when a person is declared dead in accordance with a court verdict.
  4. The person has gone missing and there is no information about him for six months or more.
  5. In the event that permanent registration was previously made on fictitious grounds.
  6. This happens to people who have been evicted by a court order.

Another reason to change documents is a voluntary change of permanent registration address.

Responsibility for untimely updating of data

When replacing identity documents, you will not be fined if you have completed all the necessary steps described above in accordance with the legislation of the Russian Federation and are registered at the place of your new registration.

You may be fined if you fail to make timely changes to:

  • military ID (500 rubles);
  • vehicle registration certificate (1500-2000 rubles).

If you are facing the procedure of changing your registration, we suggest that you read about what documents are required for this and in what time frame you must register after discharge.

Changing your registration today will not create any big difficulties for you. The Federal Assembly simplified this process and shifted responsibility to workers in other services. The main thing is to take into account some subtleties and not create problems for yourself.

About permanent residence

There are two types of registration: permanent and temporary . Sometimes it is called registration. Temporary becomes mandatory in cases where a citizen comes to a new place for a period of more than 90 days. If this is not done, he will face a fine.

A person who does not have such registration may encounter a variety of additional problems - from difficulties in getting a job to the inability to place a child in a kindergarten at the place of his actual residence. The temporary registration document is a certificate of the appropriate type.

ATTENTION! When carrying out temporary registration, the constant does not change. It is permissible to live outside home for many years by renewing your registration. Permanent registration is recorded on the corresponding page of the passport.

How to save on replacing documents after changing your last name

There has long been a State Services portal where you can fill out an application to change many of the documents listed above.

To obtain them, you no longer need to visit government agencies several times and stand in queues each time. You can do all this from home. To do this, you just need to register on the official portal, upload the required set of documents online and come to the desired institution to receive the documents on the specified date and time.

In addition, you can save a lot. As a rule, when submitting an application through the State Services service, you will receive a 30% discount on the state fee approved by law.

What to do with a pension certificate

As mentioned above, SNILS does not belong to the category of papers required for adjustment when changing residence. The recipient of payments only needs to notify the Pension Fund about the changes:

  • submit the appropriate application;
  • present a passport with a stamp with a new address.

This procedure is mandatory if a citizen wants to receive pension payments at his residence address. Based on the new data specified in the application, additions will be made to the fund database.

There is no state duty for the service; making adjustments on average takes 2-3 days.

Is it possible to drive with old data?

According to the law, without re-issuing documents, of course, no. Above we presented the official interpretation, according to which any motorist is obliged to change their STS and PTS within 10 days after changing their registration.

On the other hand, it is simply impossible for an ordinary inspector on the road to see this violation... To be more precise, in theory this can happen, but in practice it happens extremely rarely.

The fact is that the traffic police officer will only be able to see the violation by looking at the new registration stamp in your passport. But the driver actually has no obligation to hand over his passport to him for verification. There are only private insurance, STS and OSAGO insurance in standard cases.

Therefore, the opportunity to avoid a fine given above is also relevant with the possibility of driving with an old STS and PTS in a car.

Lawyer's recommendations

Replacement of documents and their updating are important obligations. Violation of them may result in fines. And in some cases, out of ignorance, you will have to overpay, for example, to banks.

Should I change bank cards when changing my registration?

The answer depends on how much your registration has changed. As a rule, the same service tariffs apply within the same region. And when traveling to another region, they may increase. In addition, when withdrawing cash and transferring to “local” cards, a commission is charged.

To avoid unnecessary payments, it is recommended to contact the bank and find out the details of the tariff plan and cost of service. At significant costs, get a new card. But, as a rule, this is not required.

Exceptions to the rules

If I changed my registration, do I need to re-register my car? Yes, and this must be done as soon as possible. This is due to the fact that after moving the citizen will use invalid documents for the car. This is prohibited by current law.

There is one exception to the rule - a change of actual place of residence. Citizens who have moved but have not changed their place of registration should not re-register a vehicle. Every modern citizen should remember this.

Military ID

The responsibilities of men include military registration. Having changed their place of residence, they must attach themselves to the military commissariat serving the area of their new residence and present a passport.

The military registration and enlistment office will independently send a request for deregistration at the previous place of residence. The period is one working week, the service is provided free of charge.

Compulsory medical insurance policy

The compulsory health insurance policy does not need to be changed; it is valid throughout the country, regardless of where its owner lives. However, there is a small nuance. On the reverse side there are lines with marks affixed by the insurance company.

After moving and getting a stamp in the passport, the insured person must report to the insurer (anyone, regardless of which company issued the policy). An insurance company employee fills out an application, which the client signs, and, based on the information taken from the passport, enters the information into the regional database.

These actions facilitate settlements between medical institutions and insurance companies, relieving the former of interregional requests. For the insured person, the absence of a mark is not a basis for refusal to provide medical services .

Informing the financial institution

Informing the bank when changing residence is at the discretion of the citizen. Depending on the status of a person, there are certain features. For example, the borrower is obliged to notify the bank:

  • about the new address,
  • about changes in contact information (phone number, email, etc.).

The financial institution responds to such a request within 3-10 days. You can contact the lender in person, by phone, or by sending updated information by letter.

It is not necessary to notify the bank if your registration address in one city has changed. But in case of fundamental changes such as registration in another region or region, new credit and payment cards are issued.
