According to the Ministry of Internal Affairs, in March 2021, at the time of the introduction of quarantine measures in Russia, about 3.5 million foreigners were registered. Some of them managed to return home over the next months, but not all. Decree of the President of the Russian Federation No. 274 and its amendments suspended the periods of temporary stay, permanent and temporary residence in 2021. But how are things now? Do I need to renew my migration card due to coronavirus? Who can legally stay in the Russian Federation with “expired” documents, and who faces consequences for this? Let's try to figure it out.

Length of stay and fines

The initial migration registration of visitors is carried out for a period of up to 3 months (it does not matter which country a particular foreigner is a citizen of). Carrying out such a procedure allows you to stay in the Russian Federation legally for the mentioned period.

When it expires, you need to:

  • Travel outside of Russia;
  • Extend your registration until the full expiration of the period specified in the legislation.

Such an action can only be carried out if there are grounds. It is noteworthy that citizens of some countries can obtain initial registration for 1 year if they have an employment contract concluded with an employer located in the Russian Federation.

Information from the Ministry of Internal Affairs dated September 30, 2021

From October 1, 2021, some provisions from the decree of the President of the Russian Federation of June 15, 2021 cease to apply. Explanations on the legal status of foreign citizens in Russia from October 1, 2021 are presented on the official website of the Russian Ministry of Internal Affairs.

  1. Foreign citizens who have not regularized their residence status by September 30, 2021 and have not submitted an application to the relevant authorities are considered illegally staying in the territory of the Russian Federation.
  2. The ban on the expulsion of such violators from the territory of the Russian Federation has been lifted. They may be expelled outside the Russian Federation.
  3. For persons who have regularized their status before September 30, the suspension of permitted periods of stay and registration on the territory of Russia continues to apply.
  4. After the official opening of transport links with the state, citizens of this country located on the territory of Russia will be given 90 days to be able to travel outside of Russia without violating the terms of their stay in it.

Reasons for extension

Short-term registration for a person staying on a visa cannot be extended, but it is possible to legally increase the period of stay for a visitor who has entered visa-free.

The reasons that serve as the grounds are stated in Federal Law No. 115, based on the norms of which it is possible to extend the temporary registration of a foreign citizen in the following cases:

  • The foreigner is waiting for documentation for temporary residence;
  • The newcomer successfully entered the university;
  • A foreigner is waiting for a work visa extension;
  • An employment contract has been concluded with the employer;
  • A patent is issued (if we are talking about labor immigrants);
  • The visitor receives the status of a HQS;
  • There is a wait for a work permit.

The extension procedure is not regulated individually - when it becomes necessary to carry out a similar procedure, a short-term residence permit is issued again. Thus, the visitor gets the opportunity to legally stay in Russia for another three months or more.

Established periods for the legal stay of a foreigner in the Russian Federation

Upon arrival in Russia, all foreigners must register for migration in accordance with the regulations of the Russian Federation.

There are three statuses of a foreign citizen (or stateless person) in Russia:

Procedure for extending temporary registration

In order for a foreign citizen to have the opportunity to stay in the Russian Federation after the expiration of 3 months, the necessary actions must be taken by the receiving party. You must begin the renewal procedure 7 days before the end of the initial registration period.

All actions must be performed in the following algorithm:

  1. Make an official statement. It is drawn up in any form and includes the migrant’s full name, date of birth, passport details, citizenship and place of registration. When drawing up, it is necessary to specify the reasons for the extension, as well as attach documents that will serve as a basis;
  2. Collect a package of documents. This process must be approached responsibly, since the lack of certain papers will cause unnecessary difficulties and delays;
  3. Contact the FMS office and submit a completed application with the collected package of documents;
  4. Wait until the competent authorities consider the grounds and study the documentation and make a positive or negative decision.

In the second case, foreign citizens will be expelled abroad if, at the time of refusal, the initial registration period has completely expired.

At the same time, violators will not be able to re-cross the border of the Russian Federation legally, even if there is an invitation or conclusion of an employment contract.

Where to contact

As mentioned above, you can obtain an initial registration and renew it at the territorial office of the FMS. To avoid wasting time, you can use the State Services portal.

To do this, you need to perform several actions in the following algorithm:

  1. Login;
  2. Find the catalog of services, go to the section called “Passports, registrations, visas”, click on the column “Registration of citizens”;
  3. Select the category called “Registration of a citizen at the place of residence”, find the electronic version of services, click on the appropriate button;
  4. Fill out a special application. At this stage you will need to enter personal data;
  5. Check the entered information;
  6. Enter information regarding place of birth, registration, stay;
  7. Identify the owner of the apartment;
  8. Give reasons;
  9. Register citizenship;
  10. Indicate the reason for arrival;
  11. Select a FMS office to send documents;
  12. Agree to data processing and send an application.

It is considered for three days, then the applicant receives a notification. If a negative response is received, the reasons for which a particular foreigner was refused to extend the initial registration are attached to the notification.

The cost of temporary registration directly depends on the period for which it is issued, for example:

  • If we are talking about 3 months, then you will have to pay from 400 to 800 rubles. upon registration in an apartment and 1000 rubles. - in a private house;
  • When you need to register for 6 months, you need to pay 800 rubles. upon registration in the apartment, 1900 rubles. - in the private sector;
  • If you need to obtain registration for 1 year, then to obtain registration in an apartment you need to pay about 10,000 rubles, in a hostel - from 1,000 rubles.

Differences in cost are due to differences in utility tariffs when living in the private sector, apartment building or hostel. Considering this, you can choose the best option for the price. However, cheap housing is often unsuitable for families with small children.

Extension of a migration card by crossing the border

Until March 2021, foreigners from visa-free countries often used such a semi-legal way to extend their stay in Russia as crossing the border in order to obtain a new migration card. Reasons for refusal and ways to mitigate it

Officially, the legislation of the Russian Federation does not stipulate the grounds for refusing temporary registration of foreign citizens.

However, the competent authorities may refuse to obtain registration if:

  1. A newcomer wants to register in a residential building with too small an area. In such a situation, you need to find a more suitable apartment;
  2. The provided package of documents does not contain any papers. A similar problem can be solved by quickly collecting the missing documentation;
  3. The rules for obtaining temporary registration were violated by a foreigner who was deported to his homeland. As a rule, such an action entails an entry ban for a certain period. It will not be possible to solve the problem before it expires.

Migration registration of foreigners

Every migrant arriving in Russia is required to register at the place of stay. This is stated in Federal Law No. 109 of July 18, 2006 (see link at the end of the article). Migration registration is completed by the receiving party after receiving the required documents from the guest: a passport with a border crossing mark and a migration card with a stamp of the Russian Border Service.

According to the law on migration registration, the receiving party is the citizen or organization where the foreign citizen lives or works. The receiving party is:

Registration certificate

  • A citizen of the Russian Federation with permanent registration and/or owning residential premises (a foreigner is registered at this address).
  • Legal entity (company in which a foreign citizen works: Russian or a representative office of a foreign company).
  • International organization.

Documents for registration

To register at your place of residence, you must provide:

  1. Completed arrival notification form. and sample filling in PDF. Fill out the form by hand in block letters or on a computer. Abbreviations and abbreviations may not be corrected or used. The form is signed by the receiving party, and the legal entity puts a stamp.

The papers are provided directly to the migration service department or sent by mail. You can also issue a notification of arrival through multifunctional centers. There is no state fee for issuing a notification. If registration takes place through the post office, then the cost of postal services is approximately 250 rubles.

The detachable part of the notification form with the stamp of the migration service is handed over to the foreigner. He keeps this paper throughout his stay in the Russian Federation and presents it along with his passport where required.

Registration at the place of stay is issued for the duration of the visa, and for citizens of visa-free countries - for 90 days. When this period expires, a citizen of a foreign state is obliged to leave Russia.

Reasons for refusal

Situations cannot be ruled out when employees of the Main Directorate for Migration of the Ministry of Internal Affairs of Russia may refuse applicants. Among the main reasons are:

  • shortcomings in the provision of documents - the information is incorrect, not all documents are available;
  • the application was sent with errors;
  • false or incorrect information about yourself;
  • the identity certificate is no longer valid;
  • violation of the rules of stay in our state;
  • housing where temporary registration is issued is seized or mortgaged;
  • the applicant lied about the grounds for extending his stay in the country;
  • the citizen was fired or expelled from the university.

The presence of at least one of the above grounds entails a refusal of the application and a requirement to leave the territory of Russia in accordance with the rules.

Fines for late registration

Usually the fine is 2-7 thousand rubles. Its amount is significantly influenced by circumstances. If registration in a new place is not renewed due to a valid reason, the person may not be held accountable. In case of repeated violation of migration laws, a person may be deported from the country and banned from entering for a certain period.

An expired document no longer has legal force and is therefore invalid. Article 19.15.1 of the Code of Administrative Offenses of the Russian Federation is applied to its owner. It provides for a fine for the violator himself and for the owner of the home in which he lives.

A fine is also issued in cases where a citizen was already registered, but did not renew the document in a timely manner. Since the Federal Migration Service takes up to 7 working days to process your application, you should submit your application in advance.

If a citizen has already expired his application, but wants to stay in the country, he must still contact the FMS and explain why he did not renew his registration in a timely manner. If the person has not committed any other violations, there will still be a fine, but he will avoid deportation.

In each situation, the final decision is made only by the inspector after carefully checking all the circumstances. He has the right to decide what to do with the citizen - limit himself to punishment in the form of a fine or oblige him to leave. Usually, in the case of the first violation, the person is met halfway.

It is important to remember that the loss of this document is also punishable. If this happens, you should immediately contact the migration service, this will help prevent a fine.

Punishment is also provided for legal entities. In large cities, the fine for them is 50-750 thousand rubles.
