Providing information from the Unified State Register of Real Estate

When conducting any real estate transaction, a number of documents may be required to confirm its viability. One of them is an extract from the Unified State Register of Real Estate - this is a temporary certificate that confirms the registration of ownership rights to a property. It also shows the imposed encumbrances, restrictions, arrest (or lack thereof). But the information provided is relevant only at the time of receipt and can be changed at any time, so it will have to be ordered every time the need arises.

All information about real estate registered since 1998 is located in the State Register database and is available to any person or organization upon request. Basically, information is publicly available, with the exception of closed information, to which only property owners have access. Information may be provided on paper or by electronic mail.

When buying a house or apartment, the seller must present the buyer with such a document to confirm that he is the sole owner and has no co-owners, and that no restrictions or prohibitions are imposed on the property. Obtaining a USRN extract for real estate is not difficult and takes about a week, but sometimes circumstances arise when it is necessary to significantly speed up this process.

Legislation on the amount of duty

The Russian legal system contains several regulations governing the processes of storing and providing information by Rosreestrom. The main one is Federal Law of the Russian Federation No. 218 (dated July 13, 2015), which defines the main features of registering rights and entering information about them into a unified register.

The amount of fees charged for obtaining the necessary information from the Unified State Register is regulated by Order of the Ministry of Economic Development No. 291 (dated May 10, 2016). The document contains an indication of the exact amounts of fees charged depending on the type of information provided and the category of the applicant.

Attention! The procedure for making calculations and returning funds for the information provided is contained in Order of the Ministry of Economic Development No. 967 (dated December 23, 2015).

How much do individuals pay?

The amount of fees charged is the same for all of Russia and does not depend on the region. In 2021, the state fee for an extract from the Unified State Register for citizens will be as follows:

Rosreestr has launched an electronic service for obtaining information from the Unified State Register of Real Estate (USRN); any interested person can request publicly available information from the Unified State Register about a property, reports the press service of the Office of the Federal Service for State Registration, Cadastre and Cartography for the Moscow Region.

In accordance with 218-FZ, information from the Unified State Register of Real Estate upon a request sent through the electronic service is provided within three days. For the provision of information contained in the USRN, a fee is charged in accordance with the law.

In accordance with 218-FZ, the services of the Rosreestr website “Personal Account of the Copyright Holder” and “Personal Account of the Cadastral Engineer”, as well as the service “Reference Information on Real Estate Objects Online”, which provide up-to-date information from the Unified State Register of Real Estate about the property, have been improved. Tax benefits

Not a single regulatory or by-law provides for the provision of benefits when receiving information from the Unified State Register of Real Estate. There are also no discounts for organizations or individuals. Even if the owner makes a request for information about his apartment, the price remains unchanged. You can only save time if you submit a request through the official website of Rosreestr.

The law provides for several groups of persons who have the right to receive information from the Unified State Register free of charge:

  1. Law enforcement officers, if the request is necessary for official needs.
  2. Notaries.
  3. Bailiffs during the consideration of an open case for debt collection.
  4. Employees of the Pension Fund, if the request is due to official needs.
  5. Commissioners for Human Rights.

The following documents are attached to the request for restricted access information:

  • a copy of a document confirming the authority of the person who signed the request for information to act on behalf of a legal entity without a power of attorney, if this information is not in the unified state register of legal entities or this register contains information about another person, or if the authority of the person who signed this request is confirmed by a power of attorney, original power of attorney or its copy (for the applicant
  • a representative of a legal entity who is a copyright holder, mortgagee, a person entitled to inherit the property of the copyright holder under a will, a person who has received a power of attorney from the copyright holder or his legal representative)
  • a duly certified copy of the ruling of the arbitration court that has entered into legal force on the approval of the arbitration manager, bankruptcy manager, a duly certified decision of the control body on the appointment of a temporary administration of a financial organization (for the applicant - arbitration manager, bankruptcy manager)
  • a copy of the document confirming the powers of the legal representative of the copyright holder: for parents - the birth certificate of the copyright holder, for other legal representatives - a document issued by the authorized body (for the applicant - the legal representative of the copyright holder - an individual)
  • original power of attorney (or a copy thereof) issued by the copyright holder or his legal representative, as well as the general director of the Federal Fund for Assistance to Housing Development, acting on the basis of an order of the government of the Russian Federation (hereinafter referred to as the Fund) to the deputy general director of the Fund or the head of a branch or representative office of the Fund and confirming the powers of the person to whom such a power of attorney was issued to receive information, as well as a copy of the document specified in this paragraph confirming the powers of the legal representative of the copyright holder who issued the power of attorney (for the applicant - the person who received the power of attorney from the copyright holder, his legal representative or the Foundation)
  • original document (for example: letter, certificate) issued by a notary, including certified by him with his signature and personal seal, and confirming the right of a person to inherit the property of the copyright holder by will or by law (for the applicant - a person who has the right to inherit the property of the copyright holder by will or by law)
  • a copy of the agreement (other document of title) on the basis of which the mortgagor’s right was registered and a mortgage arose on the basis of law in favor of the applicant, if a record of this mortgage in favor of the applicant is not included in the Unified State Register of Real Estate (for the applicant - mortgagee)
  • a copy of one of the documents provided for in paragraph 3 of Article 16 of the Federal Law of July 16, 1998 No. 102-FZ “On Mortgage (Pledge of Real Estate)” (hereinafter referred to as the Law on Mortgage), which is the basis for state registration of the legal owner of the mortgage, if the mortgage is in the Unified State Register of Real Estate the applicant’s benefit is not registered (for the applicant – mortgagee)
  • in order to provide limited access information, the rights registration authority, if the applicant is a representative of a legal entity, requests from the federal executive body carrying out state registration of legal entities an extract from the unified state register of legal entities (information contained therein) in relation to such entities , if such an extract was not submitted by the applicant on his own initiative.

To a request for information in respect of which the applicant, in accordance with Part 1 of Article 63 of Law No. 218-FZ, has the right to provide it free of charge, with the exception of a request for restricted access information, as well as requests submitted by the Commissioner for Human Rights in the Russian Federation , the Commissioner for Human Rights in a constituent entity of the Russian Federation, the Commissioner under the President of the Russian Federation for Children’s Rights, the Commissioner under the President of the Russian Federation for the Protection of the Rights of Entrepreneurs, the Commissioners for the Protection of the Rights of Entrepreneurs in the constituent entities of the Russian Federation, attach the following documents:

  • a document confirming the applicant’s right to receive information free of charge, or a copy of such a document certified in the prescribed manner

Payment Methods

All applicants should note that payment must be made no earlier than after submitting a request and providing personal identification. The only exception to this rule will be situations in which the request is sent via Russian Post. Citizens can pay for providing the requested information in several ways:

  • Using the terminal at the MFC. Each center provides the opportunity to pay the required amount. To do this, you must enter the required details, which are contained on the official website. You can also find them at the reception.
  • By resorting to the Sberbank online program. Owners of the electronic account will only need to enter the requested data in the Rosreestr list (full name, series and passport number).
  • At the cash desk of the bank that accepts such payments.
  • Through electronic wallets. For example, Yandex Money, Qiwi wallet or WebMoney.
  • Through any ATMs installed in banks and shopping centers.
  • Using the State Services portal.

To find out the necessary details, you can also submit a personal request to Rosreestr, where, if desired, they will issue a receipt form (for citizens) or a payment order form (for organizations). You will need to make a payment for them. After completing the payment transaction, you must receive or print out a confirmation receipt yourself.

How do the deadlines for completing an extract depend on the type of request?

According to current legislation, the period for issuing a certificate should not exceed 3 working days from the date of registration of the request. When processing through the MFC, it increases to 5 days; if the response is delivered by mail, then the delivery time should also be taken into account. To speed up the process of receiving a response on paper, you can attach to the request an additional application addressed to the head of this department, indicating valid reasons for the urgency. In this case, you can expect the certificate to be completed within 1 day.

But to really save time, you just need to order an extract from the Unified State Register online on the official website of the Unified State Register, the Rosreestr service, the State Services portal or commercial specialized services. To submit an electronic application in the form provided, you must indicate the address of the property or cadastral number, leave your data, email address and method of receipt: paper and electronic format. After receiving the receipt and paying the state fee (and the services of commercial sites), you can expect to receive a response from 30 minutes to 3 days. If you contact the USRN website directly, the extract can be received on the day of application in the form of an electronic file.

However, you should know that the law provides for 3 days for the production of a paper form with a wet seal and it is unlikely to be obtained earlier. The electronic version requires much less time to complete, so if there are no complications, the document will be received fairly quickly. An electronic extract from the Unified State Register is sent to the applicant’s email in the form of an XML file and digital signature in SIG format. The document arrives in readable form and can be printed if necessary.

Extracts in paper and electronic form have the same legal force and are equally accepted for consideration in any authority. Therefore, if you urgently need to obtain information from the Rosreestr database, you should order an electronic document using Internet resources. Since you can submit an application at any time of the day and it will take much less time to wait for a response.
