Types of extracts from the Unified Real Estate Register (USRN)

In connection with changes in real estate registration from 2021 and the merger of the State Real Estate Cadastre and Rosreestr, from January 1, 2021 in Russia, an extract from the Unified State Register has been replaced by an extract from the Unified State Register of Real Estate.

Most of the information contained in the state register of rights to real estate is publicly available and can be obtained by any person in the form of an extract from the Unified State Register of Rights to Real Estate and Transactions with It (USRP).

From such a document you can get:

  • information about registered rights of citizens to real estate;
  • information about copyright holders and real estate;
  • existing restrictions and encumbrances;
  • history of transfer of rights to a specific object, etc.

Such an extract can be obtained in written or electronic form from the Multifunctional Center (MFC) or the local branch of Rosreestr by submitting a request to it. To do this, you must submit a passport and a document confirming payment of the state fee, the amount of which depends on the applicant’s identity and the form of the extract received. specific validity periods for the extract; however, it is considered that it will be valid within a month from the date of its issue.

Extract on registered rights to an apartment

State registration of rights to real estate is the only valid evidence of the existence of any right to an apartment (Clause 5, Article 1 of the Federal Law of July 13, 2015 No. 218-FZ “On State Registration of Real Estate”). Information on registered rights to residential premises is contained in the Unified State Register of Real Estate (USRN). According to paragraph 1 of Art. 62 Federal Law dated July 13, 2015 No. 218-FZ “On state registration of real estate”, such information can be provided upon request of interested parties in the form of an extract from the Unified State Register of Real Estate .

EGRN information (with the exception of data to which access is limited) is publicly available , which is why any person can receive an extract of registered rights to a specific apartment.

As a rule, the need to obtain such an extract arises when making real estate transactions, registering a deed of gift or inheritance, dividing property and other property disputes, for provision to creditors or as evidence in court.

In this case, it is necessary to pay attention to the fact that:

  • Information about registered rights to an apartment represents information about the copyright holder of a specific property, as well as the type of right registered in the Unified State Register and the size of the copyright holder's share in this right.
  • In addition to information about registered rights, the extract must also contain a description of the characteristics of the apartment (address, total area, number of rooms, floor, etc.), an indication of existing restrictions and encumbrances, information about current legal claims and declared rights of claim, as well as objections to them (clause 7 of article 62 of the Federal Law of July 13, 2015 No. 218-FZ).

The register of rights may contain other information about the apartment of interest and its owner, in particular:

  • content of title documents;
  • generalized information about the rights of an individual;
  • information about the legal capacity of the copyright holder, etc.

However, this information is limited to public access and can only be provided to an exhaustive list of entities:

  • owners and their representatives;
  • local authorities;
  • law enforcement agencies, etc.

An extract on the rights to an apartment can be provided to a citizen in the form of an electronic document or on paper. The legal force of documents, regardless of the form in which they are presented, is equivalent .

What does an extract from the Unified State Register for an apartment look like?

This document has a specific form, which is established by Order of the Ministry of Economic Development of Russia dated March 22, 2013 No. 147 “On approval of document forms in which information contained in the Unified State Register of Rights to Real Estate and Transactions with It is provided.”

  • the address of the object of interest, its area, floor location in the house and purpose;

  • encumbrances imposed on the property, if any (if any, the basis for this restriction is indicated: mortgage or other);
  • cadastral number assigned during registration, designated cadastral value.

In other words, this document contains information that was previously displayed in different sources: in the cadastral passport and an extract from the Unified State Register, but now all the basic information is in a single extract.

Information about the transfer of ownership of the apartment

Information on the transfer of ownership rights to a specific apartment is information in the Unified State Register containing the “history” of the transfer of rights to a specific property, indicating all registered copyright holders who owned the apartment in the chronological order of ownership, indicating the date of registration and the date of transfer of rights to each of them.

Previously, the specified information was among the information to which general access was limited, and it was provided only to certain categories of subjects. However, information about the transfer of rights from October 1, 2013 was excluded by the legislator from the restrictions and today is publicly available .

Thus, information about the previous owners of the apartment can be obtained not only by copyright holders, law enforcement and regulatory authorities, but also by any other persons, including potential buyers .

Information on the transfer of ownership rights to an apartment is presented to the interested party in the form of a separately executed document - “Extract from the Unified State Register of Rights to the Property”.

The document provided to the citizen must contain the following data :

  • name and purpose of the property, cadastral and inventory numbers, area and address of the property of interest;
  • about each of the apartment owners according to the order specified in the state register;
  • the type of right registered for each of the former owners, the date of registration and the size of the share in the right for each of them;
  • date and number of the record of termination of the right of each owner;
  • current information about the currently registered right to an apartment;
  • on documents that are the basis for state registration of the transfer and termination of rights to an apartment.

The information contained in such an extract is current at the time the interested party submits a corresponding request to the registration authority.

Where and how to get an extract from the Unified State Register

The issuance of extracts from the Unified State Register is carried out by the Federal Service for State Registration, Cadastre and Cartography ( Rosreestr ). To obtain the necessary extract, the interested person must submit a request in the established form to the Rosreestr body.

The procedure and deadlines for providing information from the Unified State Register, forms of extracts and requirements for their format, request forms and the list of documents attached to it are determined by Order of the Ministry of Economic Development No. 180 dated May 14, 2010.

You can submit a request to receive the extract you are interested in:

  • in person to the territorial body of Rosreestr;
  • through Multifunctional Centers (MFC);
  • by sending a request to the Rosreestr body by mail;
  • through the Unified Portal of State Services;
  • by filling out a special form directly on the Rosreestr website.

The submitted request must be accompanied by a passport and a receipt for payment of the state fee for issuing the extract.

In case of personal submission of the request, the applicant must receive from the registration authority employee a receipt confirming the acceptance of the documents, indicating the date of their acceptance.

This period is calculated from the moment the request is received by the Rosreestr branch. Thus, when submitting a request through the MFC, the period for providing information to the Unified State Register may exceed five days.

After the specified period, the interested citizen can receive an extract with the information contained in it in any way convenient for him:

  • personally or through a representative in the bodies of Rosreestr;
  • by email or post;
  • at the MFC.

If it is impossible to provide information from the Unified State Register because it is limited or because it is not in the register, the Rosreestr authority issues a decision to refuse to provide information, which is communicated to the applicant in the manner specified in the request. The decision to refuse must be justified, otherwise it can be appealed in court.

Example

Citizens B. and K. intended to conclude a transaction for the purchase and sale of an apartment. Analyzing the real estate documents presented by B., K. drew attention to some features of the extract from the Unified State Register, due to which he had doubts about its authenticity. In order to avoid a deal with a fraudster, K. decided to obtain such an extract on his own, for which he submitted the necessary application to the local branch of Rosreestr, along with which he presented a copy of his passport and a receipt for payment of 200 rubles. state duties.

After some time, K. received by mail the required extract, according to which B. was not the sole owner of the apartment, but had only ¼ of the ownership of it. Based on the information received, K. canceled the transaction and filed a corresponding statement of fraud with the internal affairs authorities.

What is the difference between a paper statement and an electronic one?

Paper and electronic statements have the same legal force and contain a complete list of information about the property. But there is a main difference between them – the printing format. A blue wet stamp is affixed to the paper document and certified by the signature of the manager. The electronic statement is sent with a digital signature and stamp.

State duty when receiving an extract from the Unified State Register for an apartment

As already mentioned, in order to receive an extract from the Unified State Register, the interested person must attach to the request for information a document confirming payment of the state duty . This could be a payment receipt, check order, payment order, etc.

The specific amounts of the state fee charged for providing information from the Unified State Register are established by Order of the Ministry of Economic Development No. 650 dated December 16, 2010. The amount of the state fee will vary depending on the required extract, as well as the form in which it is provided.

According to it, the fee for providing information and making extracts from the state register is charged in the following amounts:

  • For an extract in the form of a paper document received upon request submitted at the location of the property: government agencies and individuals. individuals - 200 rubles, organizations - 600 rubles.
  • For an extract in paper form received following an extraterritorial request (submitted to an authority in violation of the territorial principle): government agencies and individuals. individuals - 300 rubles, organizations - 900 rubles.
  • For an extract in the form of an electronic document received upon request at the location of the property: government agencies and individuals - 150 rubles, organizations - 300 rubles.
  • For an extract in the form of an electronic document received upon an extraterritorial request: government agencies and individuals - 200 rubles, organizations - 400 rubles.

Payment of the state fee is carried out before submitting documents, however, it can be made no later than one month from the date of filing the request for information.

If it is entered after the request is submitted, the day of its submission is considered the day the registration authority receives the receipt . If the obligation to pay the state fee is ignored, the request is considered not received and will not be considered.

Fee for providing information

For providing a paper statement, a state fee of 200-900 rubles is charged, and an electronic one - from 150-300 rubles. The service itself is considered free. Everything is processed quite quickly in 2-3 days. The paper version may take longer - about a week. The cost also depends on the status of the requested person. For legal entities prices are much higher.

For registration of real estate or land in the register, the state duty is paid in a much larger amount. Prices for this service can reach 2-22 thousand rubles. Registration can only be carried out by the owners or their legal representatives.

Validity period for an extract from the Unified State Register for an apartment

Domestic legislation does not contain any specific provisions regulating the validity period of documents containing information from the state register of rights to real estate. Based on this, and also on the fact that such an extract from the Unified State Register is not a regulatory act, its validity period is determined based on the relevance of the information it contains.

In turn, the information contained in such a document will be relevant until changes are made regarding the rights to the apartment, information about which is contained in the extract.

Thus, the validity period of a particular extract will depend on changes made to the register.

But it is necessary to take into account some features:

  • Organizations (banks, notaries) that require the provision of statements as part of certain packages of documents independently establish the terms of their validity. As a rule, such periods do not exceed 1 month from the date of issue of the extract.
  • Citizens fear for the “legal purity” of apartments and possible fraudulent actions, which is why when conducting real estate transactions, as a rule, they require extracts issued no later than two weeks before the transactions.
