The nuances of providing housing subsidies for military personnel

In this article we will look at who is entitled to a housing subsidy for the purchase or construction of military premises. And also which citizens discharged from military service and other categories have the right to receive cash payments from the state for the purchase of housing. We will show the formula for calculating the corresponding payment. Here are examples of housing subsidy calculations. Let's talk about the housing subsidy calculator for military personnel.

A subsidy for the acquisition or construction of residential premises (living premises) provided to military personnel - citizens of the Russian Federation and other persons in accordance with the Federal Law “On the Status of Military Personnel” - this is the full name of the above payment, hereinafter referred to as a subsidy.

Legislative framework for 2021

The criteria by which Russians are considered to be in need of improved housing conditions are formulated in the Housing Code of the Russian Federation (Articles 51, 53, 57). If a serviceman needs social assistance for housing, the Federal Law of May 27, 1998 N 76-FZ “On the status of military personnel” gives him the right to receive a subsidy.

The rules and procedure for calculating the amount of housing subsidies are also legally stipulated (Resolution of the Government of the Russian Federation of February 3, 2014 No. 76).

From January 1, 2021, all payments to military personnel are indexed, including the amount of housing subsidies.

The nuances of providing housing subsidies for military personnel

One of the questions that is often asked here on the site is, of course, housing issues.
Especially what features are expected for military personnel who are going into the reserves or on a long-service pension, as well as combat veterans, if they have not yet received their own personal housing. Almost an entire article’s worth of information has been collected, based on the main and additional questions of the “suffering”. Here's what you need to know and avoid mistakes so that people from this category of people get the coveted square meters.

Questions: 1. I am a soldier, with the rank of corporal. In the near future I will retire due to the age limit with 23 years of service. My husband (now ex), also a military man, previously received an apartment from the RF Ministry of Defense for himself, me and my daughter in the Moscow region, 57 sq.m., then he privatized it for himself and his daughter. Resigned due to health reasons. We recently had another son. Can I, until I am fired, claim to receive an additional share of my son (new family member) in money?

2.
The contract ends in June 2021. Age 50 years old, military personnel.
I am on a housing subsidy (I am not provided with housing), can I be fired from the RF Armed Forces or do I have the right to continue serving without a contract until they provide me with a housing subsidy. Thank you! The answer to these questions:

According to Article 15 of the Federal Law of May 27, 1998 N 76-FZ (as amended on March 1, 2020) “On the status of military personnel,” military personnel and citizens undergoing military service under a contract during their military service are regulated by the right to improve their living conditions, taking into account norms, priority and social guarantees established by federal laws and other regulatory legal acts of the Russian Federation.

The main condition for obtaining a house or apartment is inclusion in the list of those in need of housing.

The following categories of military personnel have the right to contact the housing department on this issue:

• appointed to a position in a military organization after receiving the appropriate education and officer rank;

• officers who signed a service contract after January 1, 1998;

• warrant officers, sergeants, foremen, soldiers, midshipmen and sailors;

• with 20 years of experience or more;

• if you have more than 10 years of service in case of dismissal for health reasons, reaching the established retirement age or due to layoffs.

To acquire the right to own residential premises or a housing subsidy, you must have served 20 years of total military service.

Upon dismissal at the end of the contract and with the specified length of service, it will be possible to consider the issue of need for housing, but only at the place of military service.

In addition, such persons, after the birth of their second child, are entitled to maternal family capital, in accordance with Article 3 of the Federal Law of December 29, 2006 No. 256-FZ “On additional measures of state support for families with children.”

And the right of military personnel to housing after the end of their service is defined in Art. 15 Federal Law No. 76 “On the status of military personnel”, i.e. One of the following guarantees is provided:

-or a financial subsidy for the purchase or construction of housing;

-or square meters in kind – according to social for hire or ownership.

If a military spouse has an apartment that is not joint property, then she (as in the question received from a military lady) can apply for housing.

Documents must be submitted to the commissariat or housing/support department that will confirm the lack of ownership rights of the serviceman to the living space.

Typically, the standard accounting area for obtaining housing (and taking into account need) for many regions is 18 square meters for 1 military man. m. If, for example, there are 4 people in a military family (adults and 2 children, for example), then the area of the apartment should be at least 72 square meters. m.

Such a right to receive a subsidy and issue a housing certificate (HHS) can only be exercised if the employee submits documents on time to make changes to the housing register. If you are retiring from the Armed Forces and want to receive free housing from the state, make sure that you have the necessary length of service, check your information in the housing registry, and do not write a letter of resignation of your own free will.

If you ask for a subsidy

, then in this case there is a HIGHER probability of a quick solution to the housing problem.

An application for a one-time cash payment (LCP) for the purchase or construction of housing is the fastest way for a military man to improve his living conditions; This payment is called a “housing subsidy”. The price per square meter is determined at the federal level.

A military man retiring or joining the reserve must: be on the housing register; open a bank account; submit an application to the JO (Department) for payment of a subsidy instead of providing an apartment; find housing on your own and complete the deal. The JO calculates the amount of the subsidy independently. For the calculation, the standard of living space, the price per square meter of housing and the correction factor are taken. The standard living space for one person is 33 square meters. m., on two - 42 sq. m. etc.

If a military man and his family leave a service apartment or gated community, the petition is submitted immediately to the city administration.

After the funds are transferred to the employee's current account, it is removed from the housing register.

So such people need to decide whether to ask for a subsidy or wait for an apartment. But to do this, you need to get on the housing registry BEFORE your dismissal in order to BE RECOGNIZED there - this is mandatory.

The main condition for receiving a subsidy or EDV is also being included in the list of those in need of housing for such categories of military personnel.

Certificate for CERTIFICATE

provides the opportunity to independently choose the location and type of housing. To receive a housing certificate, military personnel must meet the following criteria:

- upon dismissal due to deterioration of health or organizational and staffing measures - having 10 or more years of service;

- in case of leaving the communications service for family reasons - 20 years of service;

-registration as a person in need of an apartment or improved conditions;

-moving from a military camp or official housing.

The certificate provides an equal share in the apartment to each family member. The amount in the document depends on the market value of 1 square meter in the region and the coefficient established by the Government of the Russian Federation. Additionally, a certificate of placement in the queue for housing and consent to be removed from the list after issuing the certificate is attached.

The serviceman applies to the commissariat with documents. The authority transfers the papers to the municipality. If a military man and his family leave a service apartment or gated community, the petition is submitted immediately to the city administration.

One-time payment (EDV)-

for the purchase and construction of housing, in addition to the norm (18 sq.m. per 1 family member), it also involves an INCREASE in the amount of financial assistance due to an
adjustment factor
. Its size, depending on length of service, is:

1.85 – for 10 – 16 years of service;

2.25 – for 16–20 years of work;

2,375 – up to 21 years of service in a military position.

After 21 years of service, 0.075 is added to the coefficient for each additional 12 months in service. The maximum indicator size is 2.75.

An example of calculating the EDV for a service member who applied: A one-time payment (EDV) - for the purchase/construction of housing, in addition to the norm (18 sq.m. per 1 family member), also involves an INCREASE in the amount of financial assistance due to an adjustment factor - the size depending on your length of service will be (21 years of service is 2.375 and +0.075 x 2 years will be 2.525). That is, the amount of financial assistance (if you have to wait a long time for the apartment or you are not going to leave for another region) is 18 sq.m x 2 people (= cost) plus an increase by this coefficient.

A serviceman can be dismissed without providing housing for several groups of reasons.

Even one thing is enough to refuse:

1.

The first group of grounds is the reason for dismissal. Dismissed persons cannot demand square meters: at their own request; on negative grounds; having been laid off and not having the necessary length of service.

2.

The second group is military personnel who are not included in the register for receiving housing: they did not submit an application for registration on time; deregistered due to the discovery of a deliberate deterioration in living conditions; those who violated the procedure for being registered and did not appear to receive housing; those who have already received housing from the state in one of the provided forms (social rent, subsidy, certificate, etc.).

The listed categories of employees are not entitled to free military housing after dismissal, but they still have the opportunity to submit documents for housing registration in local municipalities.

There are several other categories of reservists and retirees who can be dismissed from service before the issuance of housing or subsidies, but they remain on the housing register after exclusion from the staff.

The state undertakes to provide them with an apartment or a subsidy (cash/payment) even after exclusion from the unit. For example, it is allowed to dismiss a military man who leaves the locality where he is serving and applies for housing in another city or locality.

In this case, the reservist or retiree is excluded from the unit’s staff, their housing registration documents are sent to the housing department at the new place of residence, and this Department is already responsible for issuing living space to the arriving reservist.

It is also possible to dismiss employees without housing who are participants in the savings-mortgage program.

If, for example, a military man retires, leaves the locality where he is serving, and APPIES for housing in another city or locality.

In this case, the reservist or retiree is excluded from the unit’s staff, their housing registration documents are sent to the housing department at the new place of residence, and this Department is already responsible for issuing living space to the arriving reservist.

Placing in a queue: for this you need to submit documents:

=report;

=copy of bank account certificate for 5 years;

=extract from the house register about the number of registered family members (and who is included in them);

=certificate of length of service/experience;

= paper confirming the availability of additional housing (if it is for the husband, then documents about this + a certificate of divorce must be attached).

These papers are sent to the commissariat at the location of your unit. The institution registers the applicant and sends the decision to the unit commander and local administration.

The final list of military personnel who apply for an apartment is formed by the municipality.

The following grounds exist for registering officers:

:

-lack of living space or availability of housing with an area less than the established norm;

- renting an apartment under a social lease agreement, if there is a chronic illness of a family member and this interferes with living together;

-accommodation in a dormitory or service apartment;

- the apartment does not meet the criteria established for residential premises.

The decision to grant the status of a person in need or to refuse registration is made within 30 working days from the date of submission of the application.

If a serviceman has not submitted all the documents, he will not be included in the register!

A notice is sent to the unit commander with a request to present the missing papers.

Within 3 working days, the boss delivers the letter to the applicant against signature. Missing certificates must be submitted within 1 month.

I have described to you the order and algorithm of actions you need to do. And what conditions and grounds are needed for this. First, check your information in the housing registry

, and
DO NOT write a letter of resignation of your own free will
- so that this does not be a reason to fire you WITHOUT housing!

Then proceed according to this algorithm:

a) it remains possible to submit documents for housing registration in local municipalities;

b) you will remain on the housing register after being removed from the state. Then the state undertakes to provide an apartment or subsidy (cash/payment) even after exclusion from the part.

And one more main criterion: if 5 years before filing a report, a serviceman committed actions that worsened his living conditions, he will not be recognized as needing housing.

Explaining the subtleties

The main list of subsidy recipients includes military personnel with long years of service (20 or more). But those who were discharged from military service earlier, in some cases, can receive social assistance in providing housing.

The “hereditary” right to take advantage of the subsidy is retained for members of his family if the military man himself was unable to realize it because he died (both during service and after dismissal).

Grounds for dismissal without provision of housing

Upon dismissal, those military personnel who voluntarily left service in the Russian army before reaching 20 years of service will not be able to apply for a housing subsidy.

But these will not include cases where the dismissal occurred due to:

  • age has reached the maximum established level;
  • health status did not allow him to continue serving;
  • review of staff, other operational activities of the headquarters.

If the total length of service of a military pensioner who left the ranks of the Russian army was at least 10 years, he has the right to receive a housing subsidy from the state budget.

The influence of length of service on receiving a housing subsidy

The basis for calculating the amount of subsidies for the military is the formula standard for all such government programs:

current price per sq. meter X per standard square meter for the military.

Types and rules for applying for housing subsidies for military personnel

  • copies of passports of all family members without exception, as well as birth certificates if there are minor children;
  • a certificate from the military unit of the serviceman (this also applies to widows), which can confirm the number of years of required military experience;
  • a copy of the marriage registration certificate;
  • a copy of a certificate that can confirm the presence of other social benefits (this means, for example, a certificate for a large family, and so on).

More specifically, widows of deceased servicemen have the right to submit an appropriate application if they do not have their own living space and they urgently need help with this. When calculating the housing area assigned to them, the share of the deceased spouse will also be taken into account.

Approximate waiting times

The time frame for obtaining a housing subsidy varies at each stage. On average they are:

  • It takes a calendar month (30 days) to register as a person in need of assistance for the purchase of housing in RUZHO.
  • After the order to allocate funds according to the approved list, the serviceman is given 15 working days to open a special account for crediting subsidy funds.
  • When the account is opened, budget money is paid within 10 working days.

There is a “queue” waiting for budget funds to be allocated to a specific candidate. Sometimes you have to wait quite a long time, since there are many people who want to receive government assistance. The allocation of money to military personnel occurs as these targeted funds are received from the federal budget.

The full list of state “housing” social assistance for employees of the Russian army, in addition to subsidies, includes the provision of military public housing under a social rental agreement, and military mortgages on preferential terms. But over 70% of military personnel prefer purchasing or building their own housing using a budget certificate. In the next three years, it is planned to allocate another 113 billion rubles of budget funds for these purposes.

Housing Department of the Ministry of Defense of the Russian Federation

Among them were Secretary of State - Deputy Minister of Defense of the Russian Federation Nikolai Pankov;
Head of the Housing Services Department (DSD) of the Ministry of Defense of the Russian Federation Sergei Pirogov; Chairman of the Commission of the RF OP on problems of national security, socio-economic living conditions of military personnel, members of their families and veterans Alexander Kanshin; editor-in-chief of the newspaper “MK”, chairman of the Public Council under the Ministry of Defense of the Russian Federation Pavel Gusev. This statement was made by the General Staff of the RF Armed Forces in response to a question from one of the residents who had until November 14, 2011 to submit documents to the Housing Department. Currently, the AK-74M is the main model of small arms. The application is considered by the Housing Department of the authority according to the recommended sample (Appendix No. 2 to.

The procedure for recognizing those in need of housing

A serviceman who does not have his own property or the conditions that he has do not meet the standards can get on the waiting list. Registration can be carried out subject to special procedures. It is expressed in the following actions:

  1. Drawing up an application.
  2. Collection of necessary supporting documents.
  3. Submitting the entire package of papers to the appropriate organization.

Applications are reviewed by the Housing Department of the Ministry of Defense. This structural unit makes the final decision on the possibility of providing the applicant with a subsidy and its amount.

For the serviceman himself, collecting documents and writing an application is quite an important stage. It should be carried out with maximum preparation, so as not to be refused entry into the queue of those in need.

Submitting an application

Preparation of documentation involves filing an application with the Regional Housing Administration of the Ministry of Defense. It is written according to the established standard, which can be found on the official portal of the Ministry of Defense. A sample of such a form is also provided in this article.

The application must contain the following information:

  1. Details of the parties - to whom and from whom it is submitted.
  2. Document's name.
  3. Military rank and full name of the applicant.
  4. A request to be accepted into the ranks of those in need.
  5. Passport data.
  6. Personal number.
  7. Information about the serviceman's contract.
  8. Place of military service.
  9. Family composition, indicating the details of its members.
  10. Information about the availability of property.
  11. Consent to the processing of the provided data.

The document is certified by the signatures of the applicant himself and other members of his family who are adults.

An inventory is attached to the application, which contains a list of documents to be submitted and additional information, if any, is indicated. The inventory is also certified with a signature and date.

Required documents

All data specified in the application must be documented. To do this, the serviceman must collect and attach the following forms to the application:

  1. Applicant's passport.
  2. Identity card for adult family members.
  3. Birth certificates of children, if they have not yet reached the age of 14 years.
  4. Certificate on the status of financial personal accounts from the place of residence for the last five years.
  5. Marriage certificate or divorce document.
  6. Extract from the house register.
  7. If you have rights to additional social guarantees, you will need forms certifying their availability.
  8. Papers confirming the lack of property or the need to improve existing living conditions.

At his discretion, this list can be supplemented by the military personnel with those forms that allow him to prove need.

The benefits of the subsidy program are as follows:

  1. valid throughout Russia for persons who are entitled to subsidized housing for military personnel;
  2. the military is given the opportunity to independently determine the quality of housing;
  3. housing subsidies for military personnel are calculated based on the length of service;
  4. the area of the property may vary upward, since the amount of assistance may exceed the market value;
  5. the possibility of attracting maternity capital.

ATTENTION: Mandatory documents for housing subsidies for military personnel include: a passport of the potential owner, a paper confirming the marriage or its dissolution, a document indicating completion of service. Ask a military lawyer if you have a misunderstanding about collecting what you need and other unresolved problems.

General information about the subsidy

Preference for housing is a targeted program to improve the living conditions of citizens who serve in the army and those who have left the reserve.

Options for using allocated funds:

  • purchasing an apartment in a new building, secondary building;
  • purchase of a finished house under construction;
  • self-construction of real estate;
  • closing a mortgage in whole or in part, down payment on a home loan.

Benefits of the program:

  • a wide range of ways to use funds;
  • the possibility of purchasing housing in new buildings, in secondary housing;
  • choice of region for real estate purchase;
  • you can add the missing amount and purchase an apartment or house of any size;
  • The queue moves faster than the queue to get an apartment.

You can only receive a housing subsidy once.

Conditions according to standards

To calculate the EDV (one-time cash subsidy for military personnel), special standards are applied. In 2021:

  • per serviceman - 33 sq. m;
  • for a family of two people – 42 sq. m;
  • if there are more family members - 18 sq. m for each of them.

Thus, for a family of a military personnel with four people, compensation is due for the purchase of housing with an area of 72 square meters: 42+18+18. Based on this parameter, the subsidy amount is allocated.

But this is not the final calculation of the area; it also depends on some conditions. In some cases, a military man receives gratuitous assistance from the state, which is enough to buy an apartment without investing his own funds . This is possible if there is no social or privatized housing.

Additionally

According to the law (clause 2 of article 15.1 of Federal Law No. 76), a group of military personnel is determined for whom it is possible to receive additional square meters (15 or 25), above the existing standard. This applies to:

  • colonels, generals, marshals, captains of 1st rank, admirals;
  • commanders of military units;
  • teaching staff of military educational institutions or military departments of universities;
  • military personnel with academic degrees or titles.

Housing for civil servants of the Russian Ministry of Defense

“On approval of the Procedure for organizing and conducting search work by public-state associations, public associations authorized to carry out such work, carried out in order to identify unknown military graves and unburied remains, establish the names of those killed and missing in action in defense of the Fatherland and perpetuate their memory” Order Minister of Defense of the Russian Federation dated December 17, 2014.

The Heraldic Council under the President of the Russian Federation has approved a system of insignia for class ranks of the state civil service of the Russian Federation for federal civil servants of the Ministry of Defense of the Russian Federation. The main heraldic elements of the new insignia were five-pointed stars and running lights of red color, the gradation of which (the size and number of stars and lights) determines compliance with a particular rank of civil service.

Registration procedure

To resolve the housing issue, a serviceman in need must follow the procedure determined by the government of the Russian Federation.

  1. Collect the required documentation.
  2. Contact the regional housing department at the place of duty (or optionally for contract workers) in person, by mail.
  3. Wait for notification of the decision made. The period for reviewing documentation is 30 days. Notification of inclusion in the register of those in need is sent to the military unit within 3 days.
  4. Maintain the status of someone in need of housing until the end of the contract or reaching the age limit. All changes that affect exclusion from the register must be reported within 5 days.
