Russian legislation provides for a type of deferment for receiving a housing subsidy. That is, if desired, the serviceman who is entitled to this subsidy may not apply for it immediately, increasing his length of service and, accordingly, increasing the number of square meters of living space allotted to him in the future. Naturally, this is a factor that is attractive to those families who do not spend large sums on living in rented housing, otherwise the benefits of delaying receiving a housing subsidy will be questionable.

The mandatory requirement for a minimum of 10 years of service has been canceled for the category of “discharged from service and in need of improved housing conditions”, for persons included in the list of those in need of housing before the beginning of 2005 or those who were included in this list after the beginning of 2005, if it concerned forced relocation.   • for the size of the entire area of ​​the premises, the rights to which are registered in the hands of the military man and/or persons classified as members of his family;
  • for the entire residential area, which is occupied by military personnel and/or persons classified as members of their family under the terms of the social tenancy agreement, if in relation to this area the designated citizens have not formalized an obligation to terminate the social tenancy agreement, with the subsequent vacation of housing and its transfer to the authority, who provided such real estate;
  • for the total living area, by the amount by which, as a result of actions performed by military personnel and/or persons classified as members of their family and transactions of a civil nature, the actual size of the living area was reduced or in relation to which alienation was carried out. Such alienation must be carried out within five years from the date of such actions or conclusion of transactions.

What does the subsidy program involve?

Housing subsidies are one-time payments to certain categories of citizens for the purpose of purchasing finished and building new residential premises. This type of government support is targeted - it can be provided exclusively for obtaining real estate.

Main provisions of the program:

  • provided to clearly defined categories of employees in need of housing;
  • if a military man dies without being able to take advantage of the subsidy, the right to receive it passes to members of his family;

Housing subsidies will become closer to market prices

Many people are concerned about this question: what will be the size of the subsidy for military personnel for the purchase of housing in 2021? We answer that, first of all, it will depend on how many members the family has, how many years of service the military man himself has. Well, the final amount is calculated according to the established formula. All this is written down in Russian Government Decree No. 76 dated March 3, 2014. This document also specifies standards for housing area:

  • For a single military man this is 33 square meters;
  • For a married couple – 42 square meters;
  • If there are three or more members in the family, then 18 square meters for each.

The state has approved a standard by which the amount of financial assistance to the military will be calculated - this is the average cost of a square meter of housing in the country.     Combat veterans can be considered not only military personnel who have fully served their contract, but also those who have been transferred to the reserve.

    Article 3, clause 1, clause 1, Federal Law “On Veterans”:

    Combat veterans include: military personnel, including those transferred to the reserve (retired), those liable for military service, called up for military training, members of the rank and file and commanding officers of internal affairs bodies and state security bodies, employees of these bodies, employees of the USSR Ministry of Defense and employees of the Ministry of Defense of the Russian Federation, employees of institutions and bodies of the penal system, sent to other states by government bodies of the USSR, government bodies of the Russian Federation and who took part in hostilities while on duty in these states, as well as those who took part in accordance with decisions of government bodies authorities of the Russian Federation in hostilities on the territory of the Russian Federation.

    Payments for certain categories of citizens are usually indexed once a year . Until 2021, benefits for combat veterans were subject to indexation twice a year.

    Since February 2021, amendments have been made to legislative acts that have reduced indexation periods to once a year.

    According to preliminary calculations by Rosstat, inflation for 2021 will be 5.8% , therefore, from February 1, 2022, the monthly allowance for combat veterans will also be increased by 5.8%.

    The amount that is withheld by the Pension Fund for social services can be received by the citizen in cash equivalent. To do this, he needs to contact the territorial office of the Pension Fund with a package of documents to draw up the appropriate application.

    After refusing to receive a set of social services in kind, the amount that was withheld for the NSO is added to the amount of EDV.

    Many citizens of the appropriate category are faced with the problem of determining what is more profitable for them - to receive a set of social services in cash or in kind.

    As the practice of many branches of the Pension Fund of the Russian Federation shows, most of the “beneficiaries” prefer to receive their benefits in rubles.

    So, if the cost of medicines does not exceed 700 rubles per month, then veterans prefer to receive funds in cash.

    According to the latest changes, the set of social services in 2022 includes:

    • provision of medicines ( 987.38 );
    • vouchers to sanatoriums ( 152.75 );
    • free travel on public transport ( 141.81 ).

    Citizens have the right to receive NSO in rubles in whole or in part, choosing for themselves only those items of expenditure that they really need.

    Since payments to combat veterans are considered by tax authorities to be the income of an individual, income taxes were withheld from them.

    However, on April 13, 2021, the Constitutional Court of the Russian Federation issued a resolution according to which payments received by veterans are not subject to taxation until appropriate changes are made to the Tax Code.

    The Pension Fund does not have the right to withhold interest from the EDV, paying the amount in full.

    Article 217, Tax Code of the Russian Federation:

    The following types of income of individuals are not subject to taxation (exempt from taxation): state benefits, with the exception of temporary disability benefits (including benefits for caring for a sick child), as well as other payments and compensations paid in accordance with current legislation. At the same time, benefits that are not subject to taxation include unemployment benefits, maternity benefits.

    According to the ruling of the Constitutional Court of the Russian Federation, payments received by combat veterans are classified as state benefits. And they cannot be taxed.

    If a combat veteran is presumed dead or killed, his family members are entitled to receive the monthly payment in his place.

    When applying to the Pension Fund, relatives must have with them documents confirming a close relationship with the deceased, a combat veteran’s ID card and an identification document of the applicant.

    • officers who signed their first contract after 1998 and live with their families;
    • petty officers, non-commissioned officers, midshipmen and warrant officers, soldiers and sailors who signed a contract after 1998 and live with their families;
    • military personnel who received military education after 1998 and received an officer rank after graduation. It should be noted that at the place of service they live with their families.

    All of the above military personnel have the full right to privatize real estate that was provided from the municipal fund. A distinctive feature is the fact that privatization can be used for any family member.
