Where to go and how to get a plot of land for large families for free?

The legislative framework

In the Russian Federation, the receipt of a land plot by large families with three or more children is regulated by Federal Law No. 138, signed by the President of the Russian Federation on June 14, 2011.

Based on a national law, the development of private housing construction is stimulated and significant support is provided to large families.

The authorities of local regions and autonomous districts have adopted legislative acts that, taking into account the conditions and capabilities of the regions, are implementing this project.

Based on the laws of local administrations, families with three minor children have the opportunity to purchase land plots that can be used for their intended purpose.

The law also applies to single fathers and mothers with many children who are raising children, including adopted children, who have not reached the age of majority.

What does the decision depend on and how long to wait for it?

Citizens will receive a response, positive or negative, within 30 days. But local authorities can change this period at their discretion to a shorter one. Therefore, when submitting documents, you should clarify the deadline for making a decision on this issue. It is believed that the plot should be allocated to the family within a year, but in reality this is not always true.

The decision depends on whether the family and its members meet the conditions for the provision of land plots, as well as whether they have provided a complete package of documents.

What to do in case of refusal?

In any case, the refusal is supported by reasons. It must clearly describe the reason for the decision. Therefore, if possible, you should try to correct this defect. After this, you are not prohibited from applying again.

Possible reasons for refusal:

  • Error in application or certificates. Any typo, correction, or inaccuracy will make the document invalid. Therefore, such an oversight needs to be eliminated. Except in cases where false information was provided intentionally.
  • There is not enough time for registration. You can try to attach documents about registration at your previous place of residence. Information is provided either by the Criminal Code or by the Main Department of Migration Affairs of the Ministry of Internal Affairs at this address. As practice says, this is possible.
  • If one of the parents has been deprived of parental rights and one or more children are under the guardianship of the state. This situation can only be changed by restoring parental rights.
  • Changing the citizenship of someone in the family.

You can read more about the grounds for refusal to provide a land plot in this article.

What to do if approved?

Procedure for a positive outcome:

  1. Find out your number in the general queue and the number of plots issued per year.
  2. Next, you need to monitor your progress based on the information received.
  3. When the turn comes, a special commission will select and offer the family a certain plot.
  4. Carry out all the necessary procedures for preparing documents for the site. All burdens, including financial ones, are placed on the recipient. The procedure is determined by regional authorities, so it is better to contact a practicing local lawyer for advice.

Dimensions and types of intended use of land

According to the law, all members of a large family enjoy equal rights to the property given to them. The size of land plots, as well as the types of their intended purpose, are established by local authorities, in relation to regulatory legislative acts.

The established sizes of territories allocated to families in densely populated areas can range from six to fifteen acres, but in the rest of the country it is possible to provide larger plots and this is stipulated in the laws of local governments.

Legislative acts of some regions of the Russian Federation provide for the size of allotments provided to large families, depending on the age of the child, as well as the number of children growing in the family.

Land areas are provided to large families with benefits for the purpose of:

  • construction of residential and utility buildings on the site;
  • gardening;
  • growing crops;
  • livestock farming;
  • farming;
  • carrying out dacha construction.

Attention! If there are three children, the provision of a plot is carried out only once; with a further increase in the family, land plots are no longer provided for free use.

  2. If approved, the family receives a certificate that will confirm their status.

The municipality is in charge of accepting applications, and it will also decide on placement in the queue. The collected documents are submitted along with the application. You can submit the necessary papers to the MFC.

The application contains the full name of the head of the family, his personal data, series and number of passport, TIN number, and also indicates the intended purpose of the site.
    Attached to the application are copies of the passports of both spouses, a copy of the certificate of large families, copies of birth certificates of children, an extract from the house register, a certificate from Rosreestr about the absence of land plots in the property.

    Documents are left in the reception area for consideration at the next session.

  9. The survey results are submitted to the cadastral chamber for registration of the territory, as well as issuance of a cadastral passport to the owner. In 20 days the document will be ready.

According to the basic law of the Russian Federation, the land must be transferred to the family no later than one year from the date of filing the application.

What documents are needed for a large family to obtain land from the video:

We described in more detail what documents are needed to obtain a land plot for a large family, as well as how to fill out an application for the provision of an allotment in this article.

What papers are needed to issue land?

Let's consider the list of documents for obtaining land for large families:

  • application for land provision;
  • parents' passports;
  • children's birth certificates;
  • act of marriage or divorce;
  • certificate of registration;
  • extract from the Unified State Register;
  • a certificate stating that the parents are not deprived of their rights;
  • certificate of a large family.

But the list of documents for obtaining a plot for large families is not limited to this.

For families with adopted or taken into custody children, it is necessary to provide a certificate from the guardianship and trusteeship authorities.

Attention! All minor children must be included in the passport of at least one parent. If there is no such entry in it, this can be done at the passport office on the basis of the submitted birth certificates of the children.

To obtain land, you need to make a photocopy of all completed pages of your passport, including registration, marriage and children.

For all children under 14 years of age, photocopies of birth certificates are provided. If the child is already 14 years old, a photocopy of his passport is required. If you have adopted children, you will additionally need photocopies of adoption certificates. When guardianship of a child is registered, a guardianship act and a photocopy of it are presented.

A certificate of registration or divorce is also provided. If such a document has been lost, you can restore it by submitting a request to the registry office, if you have the spouses’ passports and a receipt for payment of the state fee in the amount of 350 rubles. The same applies to the restoration of divorce papers.

A certificate of registration can be obtained from the MFC or passport office. The condition for the provision of land is the presence of registration in Russia for a period of at least 5 years for all family members. If the certificate from the MFC indicates a shorter period of residence, then you need to send a request for the previous place of residence so that the total period of stay in the Russian Federation is at least five years.

An extract from the Unified State Register must be ordered in advance for each parent from Rosreestr. It is produced within 3 working days. It indicates all real estate owned, or the lack thereof.

A certificate of non-deprivation of parental rights is issued by the guardianship authorities at the place of residence. A certificate for a large family confirms its status. In case of loss, it is obtained by sending a request to the MFC or to the social protection department, providing birth certificates, parents’ passports, a marriage document, a photograph of one of the parents for whom the certificate will be issued.

Suspension of consideration of an application

In order to make an administrative decision on the allocation of an allotment to a large family, local authorities are given a period that does not exceed thirty calendar days.

In most cases, such a decision is made much faster, which allows the family to get on the waiting list.

Suspension of consideration of an application for land may be due to the fact of providing inaccurate data suggesting a change of citizenship, registration or place of residence of one of the spouses.

Consideration of the allocation of land may also be refused due to deprivation of the rights of one of the parents, as well as one of the members of this family being supported by the state.

The consideration may be suspended due to lack of registration of relations between spouses, delay in passport exchange, or inaccuracy in documents.

A negative decision received from the administration must be justified, and the reason for the refusal recorded in writing.

Sometimes decisions are postponed due to the withdrawal of land from circulation on the basis of regulations that are regulated by the Land Code of the Russian Federation, Article 27.

We received land as a family with many children, what to do next?

So, you received a plot as a large family, what to do next? The land area registered free of charge for a family depends entirely on the specifics of the contract drawn up. The agreement contains a condition stipulating the construction of a house on the allocated territory, and if this obligation is not fulfilled, the land can be taken away by court decision.

Therefore, immediately after receiving ownership of the land, it is necessary to begin construction of a residential building.

Registration of land ownership

Real estate built on the site in accordance with the concluded agreement is subject to registration.

The transfer of a residential building into the ownership of the owner is the basis for re-registration of the allocated territory itself as personal property.

It is in the agreement concluded between the two parties that all the conditions for allocating the territory for free use are stipulated, the terms for the construction of housing are stipulated, the procedure for transferring the site into the ownership of the owner is taken into account, and also separate articles indicate the right of the new owner to dispose of his property.

Sale of land

Land provided for free use cannot be sold until, under the terms of a long-term lease agreement, the land and the residential building built on it are transferred into ownership.

Important! The sale of the allotment can only be carried out after its legal registration.

We told you more about whether it is possible to sell a plot allocated to a large family and how to do it legally correctly here.

Housing and monetary compensation

The administrations of many cities and densely populated regions of the country are faced with the problem of issuing free land plots to families due to the lack of suitable land plots for housing.

According to the amendments adopted in March 2015 to Federal Law No. 138 of June 14, 2011, families with a legal right to the territory can be allocated apartments at the expense of local regional budgets.

To obtain an apartment, a family submits an application to the local administration responsible for providing housing and awaits a decision.

Having received a positive response, he provides documents to be placed on the queue.

The list of documents required to obtain a preferential apartment is completely identical to the one that a family needs to obtain land plots.

Also, very often you can hear the question from citizens: “How can large families get money instead of land?” Receiving monetary compensation is provided for by law, but has not received local legal regulation due to the financial capabilities of local regional budgets.

The law stipulates that the amount of compensation cannot exceed the cadastral value of land plots, but these decisions remain within the competence of local administrations. Some of them, according to the resolutions of the regional Dumas, compensate the preferential category of citizens with one-time subsidies in the amount of 200,000 rubles.

You will learn how to receive monetary compensation instead of land from the video:

Land plots in Moscow

Free provision of land plots in Moscow is carried out on the basis of laws adopted by the city administration to citizens of the Russian Federation who:

  • have three or more minor children;
  • parents are officially married (if the family is complete);
  • have lived in the city for at least ten years;
  • do not own other land territories;
  • submitted a corresponding application to the administration.

All necessary information is confirmed by certificates and copies of official documents. This is a necessary condition for registering land for a third child in Moscow. After a positive decision, the family is put on the waiting list.

Many large families, of course, expect to receive land to build a house in the city.

But the possibilities of providing land plots in the city today are significantly limited.

The queues practically do not move forward and people are offered plots in the suburbs of the capital, where the conditions and requirements for obtaining land plots are somewhat different from those in the capital.

Families wishing to receive land in the capital region must:

  • have three or more minor children;
  • Russian citizenship;
  • reside within the Russian Federation for at least five years;
  • be officially married (if the family is complete);
  • do not own other land territories;
  • children from 18 to 23 years old serve in the Republic of Armenia for military service or study in Russian educational institutions.

Exclusive right

Large families live in Russia and have been using the land provided to them for long-term lease for a long period of time (find out about the provision of land plots to large families in this article). Such families enjoy the exclusive right to receive a land plot of no more than fifteen hundred square meters as their property.

To become the owner of a plot, the head of the family must submit an appropriate application to the local administration and wait for the issue to be resolved.

As a rule, land users do not have to wait long; administrative decisions bring good news for tenants. If the outcome is positive, the tenant receives the land free of charge.

Administration of the city district of Shchelkovo, Moscow region

The conditions, norms and procedure for providing large families with land plots are determined by the law of the Moscow region dated 06/01/2011 No. 73/2011-OZ “On the free provision of land plots to large families in the Moscow region” (published on 06/04/2011 in the newspaper “Daily News.
