According to the Russian Federation Regulation No. 354 dated May 6, 2011, the provision of utility services is the supply to consumers of any utility resource individually or 2 or more of them in any combination to ensure favorable and safe conditions of use residential, non-residential premises, common property in apartment buildings. The utility service also includes municipal solid waste (MSW) management services.

Utility resources are those used for the provision of public services and consumed during the maintenance of objects in the apartment building:

  • cold water
  • hot water
  • Electric Energy
  • gas
  • thermal energy
  • coolant in the form of hot water in open heating systems (hot water supply)
  • domestic gas in cylinders
  • solid fuel in the presence of stove heating

Wastewater is also considered a municipal resource.

What relates to public services, as noted above, is determined by the category of the structure and its needs. And the following can represent the interests of all residents and guarantee the receipt of housing and communal services:

  • management companies;
  • cooperative;
  • residents' association;
  • the resource provider itself.

Payment for housing and communal services is carried out depending on the type of communications. If the provision is recorded by a meter, then the number of units of the resource used and the price per unit of service are taken as the basis. Formula:

(monthly resource consumption * tariffs) – benefits = amount to be paid.

In relation to other resources, mandatory payments can be established according to the following algorithm:

  • based on the number of registered citizens;
  • based on the square footage of the room.

Housing and communal services according to Decree of the Government of the Russian Federation N 354

The provision of utility services in apartment buildings and private residential buildings is carried out in accordance with the Rules for the provision of utility services to owners and users of premises in apartment buildings and residential buildings, approved by Decree of the Government of the Russian Federation of May 6, 2011 N 354 (hereinafter referred to as the Rules).

According to paragraph 4 of the Rules under Resolution No. 354, the consumer can be provided with the following types of utility services:

  • Cold water supply to residential buildings
  • Hot water supply for residential buildings
  • Drainage of residential buildings
  • Electrical supply for residential buildings
  • Gas supply to residential buildings
  • Heating of residential buildings
  • Municipal solid waste management

Rules for the provision of utility services:

  • regulate relations between providers and consumers of utility services;
  • establish the procedure for concluding contracts for the provision of utility services, as well as the rights and obligations of the parties;
  • establish a procedure for quality control of provided public services;
  • establish a procedure for determining the amount of payment for utility services using metering devices and in their absence;
  • establish a procedure for recalculating the amount of payment for certain types of utility services during the period of temporary absence of citizens in the residential premises they occupy;
  • establish a procedure for changing the amount of fees when providing utility services of inadequate quality and (or) with interruptions exceeding the established duration;
  • determine the grounds and procedure for suspending or restricting the provision of public services;
  • regulate issues related to the onset of liability of providers and consumers of utility services.

In accordance with paragraph 3 of the Rules, the conditions for the provision of utility services to a consumer in an apartment building or in a private residential building are:

  • Utilities are provided starting from the moment established by the housing legislation of the Russian Federation, namely: to the owner of the residential premises and the persons living with him - from the moment the ownership of the residential premises arises;
  • to a member of a housing or housing-construction cooperative and persons living with him - from the moment the housing or housing-construction cooperative provides residential premises;
  • to the tenant of the residential premises and persons living with him - from the date of conclusion of the rental agreement;
  • for the tenant of residential premises and persons living with him - from the date of conclusion of the lease agreement;
  • The composition of the provided utilities is determined depending on the degree of improvement of the apartment building or private residential building
  • The provision of utility services is carried out around the clock (for heating utilities - around the clock during the heating season), that is, uninterruptedly or with interruptions not exceeding the duration that meets the requirements for the quality of utility services
  • The provision of utilities is carried out in the required volumes within the technical capabilities of in-house engineering systems
  • The quality of the provided utility services meets the requirements given in Appendix No. 1 to the Rules
  • The technical condition of in-house engineering systems and in-house equipment meets the established requirements and is ready for the provision of utility services.
  • The provision of utility services to the consumer is carried out on the basis of a paid agreement containing provisions for the provision of utility services, on the terms provided for by the Rules, including the provision of emergency dispatch service for an apartment building in accordance with the provisions of Section IV of the Rules.

    According to subparagraph “p” of paragraph 31 of Section IV of the Rules, the Utility Service Provider is obliged to provide the consumer with the addresses and telephone numbers of its dispatch and emergency dispatch service in the manner specified in the contract.

    Emergency dispatch service for an apartment building is regulated by Chapter IV of the Resolution of the Government of the Russian Federation of May 15, 2013 N 416 “On the procedure for carrying out activities for managing apartment buildings.”

    The rights and obligations of the utility service provider are established by Section IV, and the rights and obligations of the consumer by Section V of the Rules.

    Issues of suspension or restriction of the provision of utility services are regulated by Section XI of the Rules.

    State control over the compliance of the quality, volume and procedure for the provision of utility services with the requirements established by Decree of the Government of the Russian Federation of May 6, 2011 N 354, is carried out by authorized housing supervision bodies of the executive power of the constituent entities of the Russian Federation in accordance with Article 20 of the Housing Code of the Russian Federation.

    Now any citizen can view information about the activities of their management company and information on a specific house.

    This is regulated by Decree of the Government of the Russian Federation of September 23, 2010 N 731, which management organizations operating in the field of management of apartment buildings are required to comply with.

    • information about verbal reprimands, written orders, fines or disqualifications (if any).

    In other words, management companies must have a website and be registered on the official website of the Housing and Communal Services Reform project. Failure to comply with these requirements will result in penalties.

    Additional services under the management agreement are approved by the OSS

    The trial court based its findings on the following legal requirements:

    • The general meeting of premises owners is the management body of an apartment building. Decisions at the general meeting are made on issues within the competence of the meeting and put to a vote (Article 44 of the RF Housing Code). If the decision at the OSS is made in the prescribed manner, then it is binding on all owners in the house, even those who did not vote (Article 46 of the Housing Code of the Russian Federation).
    • At the OSS, the owners approve the list of works and services under the management agreement, the conditions for their provision and implementation, as well as the amount of their financing (clause 17 of the RF PP No. 491).
    • Security and concierge services are additional services for the maintenance of common property, the decision to provide which is made at a general meeting of owners of premises in the house.

    The management company presented the OSS protocol in court, at which the owners decided to include additional security and concierge services in the list of works and services under the management agreement. At the same time, the tariff approved by the OSS does not allow for a concierge at each entrance, which, according to the MA, the owners were warned about at the meeting. Therefore, the duty officer is located only in the central entrance, where the fire safety system and unified intercom network consoles are installed.

    Since the plaintiff did not challenge the legality of the said minutes of the general meeting of owners, the court of first instance rejected the owner’s claim. The additional concierge service was approved by OSS within the framework of the law, the owner is obliged to pay for it in accordance with Part 1 of Art. 153 Housing Code of the Russian Federation.

    The plaintiff filed an appeal, noting that the MA did not prove the provision of services of adequate quality. The Court of Appeal did not find any violations in the first instance decision and did not consider the owner’s arguments to be grounds for overturning the first decision.

    What does the list of housing and communal services for citizens include?

    Retention period for utility bills

    Payment for housing and communal services is calculated in two ways:

    • according to the readings of individual metering devices;
    • according to consumption standards, calculated according to approved methods, depending on the quantity prescribed for the living space.

    Installed individual metering devices must be sealed before being put into operation. It is the responsibility of consumers to regularly provide information about meter readings to the management or utility company. The owner is responsible for the integrity of the seals and timely verification of meters.

    Electricity

    Electricity supplied to apartments is paid according to the readings of installed meters. Consumers are forced to pay for the energy spent on servicing common areas - lighting of staircases, entrances, attics and basements, and the operation of elevators.

    Legislation limits the maximum duration of interruptions in the supply of resources:

    • two hours monthly if the facility is powered from two independent sources;
    • days for the specified period, if the source is the only one.

    The supplier is obliged to provide electricity with the established parameters, without voltage drops.

    Hot and cold water supply

    With cold water supply, the consumer is provided with water purified from harmful elements and pathogens.

    Interruptions are allowed for a month, with a total duration of no more than:

    • eight hours - in ordinary cases;
    • twenty-four - in case of a large-scale accident.

    For a hot water supply system, the requirements for the duration of interruptions are similar. Additional conditions require compliance with the temperature regime:

    • when the water temperature is below plus forty degrees, the consumer can pay for services at cold water supply tariffs;
    • Heating above seventy-five degrees is not allowed.

    In the absence of common house communication systems, access to a public water stand must be provided.

    Heating

    Heating must ensure that the air temperature in the room is maintained at least eighteen degrees above zero. During the month, the total duration of interruptions in heat supply should not exceed twenty-four hours.

    The following restrictions have been established for one-time interruptions in heat supply:

    • at a room temperature above twelve degrees - no more than sixteen hours;
    • within the range of ten to twelve degrees - up to eight hours;
    • from eight to ten - within four hours.

    The size of the payment is affected by the total area of ​​the heated room. Tariff plans are approved by regional regulations.

    Water disposal

    Houses must be equipped with sewer lines that ensure the removal of consumed water. The drainage system is carried out to ensure proper environmental standards. The sanitary and epidemiological situation in the region largely depends on the condition of sewage drains.

    The tariff is set by a resolution of local authorities, but is calculated on the basis of approved national methods. The amount of payment depends on the total volume of cold and hot water consumed.

    Solid Waste Disposal

    Garbage removal is included in housing payments. Payments for solid waste disposal are calculated according to the area of ​​the apartment. But this situation raises a lot of questions among the population.

    Most residents believe that it is more appropriate to determine expenses depending on the number of registered people in the apartment. With this accrual procedure, a methodology similar to the accrual of utility bills will be used.

    ODPU fee

    ODPU is a common house metering device. These funds are used to determine the amount of payments for energy resources spent on common property:

    • the amount of resources on individual meters in apartments is subtracted from the ODPU readings;
    • the resulting difference is divided equally between registered residents.

    As a result, the management company gets the opportunity to pay suppliers for energy resources additionally spent on maintaining the common household facilities.

    Additional services

    In addition to the mandatory communal services, the management company or other organizations may offer additional services:

    • cable television or internet;
    • radio;
    • intercom;
    • paid parking, etc.

    The owner of the living space has the right to choose whether or not to use the specified amenities.

    Services and work for the maintenance and repair of the common property of an apartment building, paid by citizens as part of the fee for the maintenance and repair of residential premises , do not include :

    a)
    maintenance and repair of doors
    to apartments, doors and windows located inside residential or non-residential premises that are not public premises;
    b) insulation of window and balcony openings
    , replacement of broken glass windows and balcony doors, insulation of entrance doors in apartments and non-residential premises that are not common areas;
    c) cleaning and cleaning of land plots
    that
    are not part of the local area - common property , as well as their landscaping and care of landscaping elements (including lawns, flower beds, trees and shrubs).
    In addition, other services may include services that ensure the safety of citizens

    in the house, including the installation and operation of locking entrance devices, CCTV cameras, maintenance of shift services and entrance attendants.

    Other services that may be provided to citizens - owners and tenants of premises in apartment buildings may include household services

    :

    • reconstruction of individual antennas and collective reception systems; • technical maintenance of collective television reception systems; • repair of the collective television reception system; • repair of elements of distribution networks of collective television reception systems; • repair of individual antennas; • repair of antenna equipment for individual use (amplifiers, converters, etc.; • replacement of the reduction cable of an individual antenna; • measurement of the level of the television signal at the reception location; • repair of electric bells; • repair of electric meters; • conversion of electric meters from one voltage to another; • production and repair of electric water heaters; • repair of home heating boilers; • repair of wooden cornices; • comprehensive (partial) repair of houses and apartments at the request of the population; • repair of all types of floors; • strengthening of door frames; • change of mortise and rim locks, hardware; • equipment built-in wardrobes and mezzanines; • production of carpentry building parts and products; • production of reinforced concrete building parts and products; • cladding and insulation of doors, insertion of inspection eyes; • development of design estimates for the construction and reconstruction of residential and non-residential buildings; • consultation with a specialist on repair and construction work; • installation of a radio station for multi-program wire broadcasting over national local telephone networks; • use of individual radio points; • replacing the socket with a new type of socket; • installation, rearrangement and reconnection of the radio point to the radio broadcast network; • replacement of radio wiring; • troubleshooting a radio broadcast.

    In order to ensure favorable living conditions in an apartment building, in addition to mandatory work, owners can instruct the management organization to provide them with services other than services for the proper maintenance of common property in an apartment building, i.e. other services

    . Such services (work) are provided in premises that are not the common property of an apartment building, for example, apartments, rooms, loggias, balconies, land plots.

    Other services listed above in an apartment building may include:

    — communication services in terms of providing citizens with wired radio and television services; — services for installing security alarms, home security (including private security services); — services for preferential insurance of residential premises and general property of an apartment building.

    Other services must be paid (additionally) by the owners or users of premises in an apartment building who use these services, simultaneously with payment for the maintenance and repair of residential premises (common property of an apartment building) and utilities in accordance with the agreements concluded by such persons for their provision (or a management agreement apartment building, or with organizations providing them).

    In the case of organizing settlements for the population and legal entities through the GKU IS system or the State Budgetary Institution of the MFC of the districts, payments for these other services are included in the monthly single payment document (UPD) generated for individuals.

    Other services are provided either to all owners and users of premises in an apartment building, or to a portion of the owners. In the case of the provision of services to a separate part of the owners and users of these services, persons who do not want to use such services have the right to refuse payment for them in accordance with the established procedure. For example, do not pay:

    — preferential insurance of residential premises by not including this payment in the total amount of paid services and work under the EPD using a mark in specially designated fields (places) of this document; - wired radio broadcasting (television) services in the manner established by the Moscow city radio broadcasting (television) service, which involves a written request from the owner or user of the premises in an apartment building with a statement of reluctance to use these services and disconnecting this premises from wired radio broadcasting or cable television networks.

    Why can you file a complaint about the provision of utility services?

    Utility users who are not satisfied with the quality of the supplied resources in 2021 have the right to file a complaint against the management company, HOA, cooperative or organization providing utility services. As a rule, there are a number of reasons for this:

    • Interruptions in the supply of cold and hot water exceeding the legally established duration. Lack of water supply for more than 24 hours is grounds for contacting the organization that manages the apartment building.
    • Supply of cold water of inadequate quality (containing harmful chemical elements and microorganisms). In this case, it is advisable to support your appeal with the opinion of an independent expert who examined samples taken from the internal water supply system.
    • Interruptions in electricity and gas supply for a period of time exceeding legally established standards.
    • Supply of gas of inadequate quality and in quantity insufficient for comfortable consumption by all users.
    • Delay in heating supply. As a rule, the heating season begins at a time set individually for each region, however, a sharp decrease in the average daily temperature is a good reason for a premature start to the season.
    • Supply of low temperature hot water (less than 40C).
    • Untimely or incomplete removal of solid waste.
    • Unjustified increase in the tariff rate for utilities.
    • Incorrect calculation of the amount indicated in the payment receipt. An inflated fee for using the CG is a violation of the rights of users, therefore the correctness of the calculation of the next payment must be checked by both the employees of the implementing organization and the user.

    Utility service complaints in 2021 relate solely to the resources listed above. Claims regarding the state of internal communications, common areas and the design of apartment buildings refer to complaints about the provision of housing services.

    Utility service provider

    The provider of utility services may be (clause 8 of the Russian Federation Regulations dated May 6, 2011 No. 354):

    • UO
    • HOA
    • RSO

    The management authority begins to provide CG from the date specified in the decision of the general meeting on the selection of this management company or from the date of concluding the management agreement for the apartment building.     Requirements for the procedure for including additional services in a management agreement

    Management organizations, intending to provide additional services to the owners of premises in the house, must conduct an OSS and put the following questions, in addition to the mandatory ones, to a vote:

    • approve the inclusion of the service/work in the list of works and services under the management agreement, and the start date for the provision of such services;
    • set the amount of the service fee per month depending on the area of ​​the property, the number of people, a fixed amount for each apartment, etc.;
    • approve the conditions for the provision and performance of additional services, which will be reflected in the contract with the contractor;
    • approve the form for confirming the quality of services provided (work completion certificate, other document), the frequency of its signing and the person authorized to sign the certificates;
    • give the management authority the authority to enter into contracts for the provision of additional services on behalf of the owners of premises in the house.

    The decision of the OSS must be communicated to all owners in accordance with Part 3 of Art. 46 Housing Code of the Russian Federation. Only after this the MA has the right to conclude an agreement with the contractor for the provision of the service and include the payment for it in the payment documents.

    In order to avoid conflicts, the management organization should carefully approach recording the facts of the proper provision of additional services, including by maintaining records and journals. If the service is provided by a third party, the MA must strictly ensure that the contractor fulfills all obligations specified in the contract.

    3. In the list, indicate your relationship to this residential property: owner, tenant, tenant.

    Personal account management

    How to calculate a payment receipt in LC?

    Today you don’t need to independently calculate the consumed resources, but rather submit monthly meter readings to your housing and communal services. The accounting department itself will make all the necessary charges and send a receipt for payment. Some subscribers check each charge point.

    Pay for housing and communal services

    For gas, debts can be found out on the Internet on the websites of gas supplier companies. The portals first require registration in your personal account. The personal gas account is specified in the contract and the receipts sent.

    In Surgut, it is necessary to find out the status of payment from management companies. DEZ RZhP does not provide data via the Internet; on the portal, consumers enter meter readings and find out where rent is paid.

    The procedure for resolving controversial issues between residents and the management company

    If the management company refuses to carry out work or does not perform it in full or of poor quality, consumers, on the basis of Law No. 2300 “On the Protection of Consumer Rights,” can draw up a written complaint in two copies.

    1. One paper is sent to the local management company. It is necessary to ensure that the complaint is registered and receives the status of an incoming document. The second copy remains with the complainants.
