Form 8: what kind of certificate is this and when might it be needed?

Requirements for registration at the place of residence apply to all Russian citizens, regardless of their age. It is also important for a child to have registration, because without it it will be difficult to get into kindergarten or school, as well as receive free medical care at the place of residence.

In addition, registering a child will allow you to quickly obtain ownership of municipal housing.

What is a Form 8 certificate and why is it needed?

Since a child under 14 years of age does not have a passport, he is given a document confirming registration at his residence address. This certificate of registration is Form 8.

In addition to it, there is also a certificate in Form 3 about the temporary registration of the child.

The registration certificate is issued only in one copy. A duplicate can be issued only if the original is lost, but, as with the loss of other important documents, you will have to spend a lot of time preparing a copy.

The certificate in Form 8 indicates:

  • Full name, date of birth and other personal data of the child.
  • Registration address.
  • Data of the organization and employee who issued this certificate.
  • Documents giving grounds for registration.
  • Date of registration.
  • Validity period of registration and stamp of the authority that issued the certificate.

When presenting a certificate at certain institutions, you must also present a birth certificate. Without it, the certificate in Form 8 is considered invalid.

After receiving the certificate, the child does not have the right to refuse:

  • Visiting a kindergarten or school at your place of residence.
  • Registration at a clinic serving the area.
  • Receiving benefits and maternity capital.

How to order a STD-R certificate upon application

To obtain a certificate, an employee must:

  1. Write an application addressed to the employer;
  2. Specify the document format;
  3. Receive a certificate within three days.

Who is eligible to receive?

The following are entitled to obtain a registration certificate in Form 8:

  • Parents or guardians of the child, provided that they are registered at this address or have grounds for registering other people at this address (are home owners).
  • A legal representative who has a warrant to move into public housing.
  • A parent who registers with the child, subject to permission from the apartment owner.

In any case, it is important to document the right to live in the apartment where the child will be registered and the consent of the owner of the property.

Conclusions:

1. Certificates are issued to the employee upon his application. The application must indicate exactly what information should be contained in the certificate.

2. Certificates issued are signed by the head of the organization or an authorized person and certified by the seal of the organization (if any).

3. Certificates issued are recorded in a special journal and issued to the employee against signature.

Where can I get a certificate of registration at the child’s place of residence?

There are several authorities you can contact to obtain a child registration certificate:

  • Department of the Ministry of Internal Affairs.
  • Passport Office.
  • Management Company.
  • MFC.

The registration procedure is approximately the same in all institutions, but the fastest way is to apply to the MFC.

MFC

This center is authorized to accept documents and issue registration certificates in Form 8. An employee of the institution should spend no more than 15 minutes on receiving and checking documents. You can sign up for filing in advance by phone or online, which allows you to avoid wasting time in queues.

After accepting the documents, the applicant receives a special coupon, using the number of which you can track the registration process on the MFC website.

Is it possible to obtain a certificate online?

The State Services portal allows you to sign up for a specific date and time to visit the MFC and submit a registration application and all the necessary documents. It will not be possible to complete the entire procedure online, since the law requires the personal presence of the applicant to submit original documents.

In what form should STD-R be issued?

An employee can choose the document format that is convenient for him. You can receive STD-R in paper or electronic form. The paper certificate is certified by the seal of the organization, the signature of the manager or personnel employee. If the document is issued in the form of an electronic file, it will need to be signed with an enhanced qualified electronic signature (ECES). You can purchase such a signature only at a certification center that is accredited by the Ministry of Digital Development.

UC "Kaluga Astral" has all the necessary licenses for the production of "Astral-ET" and "1C-ETP". An electronic signature allows you to certify digital documents and make them legally significant.

Required documents

The registration procedure is possible only if you have a number of documents:

  • Applicant's passports. In cases where the father is unknown or his name is not documented, then the mother’s passport is sufficient. The same rule applies to newborn children, who must be registered within 30 days from the date of their birth.
  • Marriage or divorce certificate.
  • Title documents for real estate.
  • Notarized power of attorney, if registration is carried out by an authorized person.

In addition to these documents, the registration authority may require the written consent of the second parent, a certificate of the status of the personal account and an extract from the house register. But these papers are needed only in certain cases. Usually, to obtain a certificate in Form 8, a standard package of documents is enough.

How to order STD-R at State Services

A certificate with information similar to STD-R is obtained not only from your employer. This can be done through the citizen’s Personal Account on the Pension Fund website or the State Services electronic service. In both cases, the individual will receive an extract from the electronic labor record. The document is called STD-PFR

The employer provides information about its employees to the Pension Fund from January 1, 2021. The data is compiled and sent according to the SZV-TD form. The agency stores the information received and generates it at the request of citizens through State Services or the Pension Fund website.

To submit digital reporting to the Pension Fund of Russia in the SZV-TD form, we recommend using “Astral Report 5.0”. This is an online service that will allow you to generate and submit electronic documents from any PC and from anywhere in the world with Internet access.

The report reflects all personnel activities that occurred in relation to the employee during the reporting period. The certificate also indicates the format of the work record book that the employee uses.

To order the form, you will need to register on the State Services portal. The login and password you use will also be suitable for logging into your personal account on the Pension Fund website. Information is generated online and stored in the “Case History” section. The document can be downloaded in pdf format, printed or saved to an electronic device.

Validity and cost

The period for consideration of the application and execution of the document varies depending on the authority to which the child’s parent applies.

When applying directly to the department of the Ministry of Internal Affairs, 3 days are allotted for registration. When submitting documents through the passport office or MFC – 7 days, since they transfer the documents to the registration authority.

Sometimes it is necessary to send a request to another region or additionally check the submitted documents. In this case, the registration period may be extended.

When submitting original documents (and this is mandatory), the applicant is given a receipt of their receipt.

There is no state fee for such a child registration procedure.

Who can apply for the form?

Not all citizens can apply for a child registration certificate; the following category of persons has this right:

  • The child’s parents (mother, father), who are, by law, the official representatives of the minor citizen. Moreover, they must be registered in this living space or be the owner;
  • Directly the owner of the apartment or house; for this he does not have to be registered here;
  • An official representative of the parents or property owner with a power of attorney that complies with state standards.

Nuances of registering a newborn

The legislation of the Russian Federation does not establish strict deadlines during which a newborn must be registered. There is only an indication that during the first 30 days of his life, the mother can register the child without the consent of the father.

At the same time, if the mother, for good reason, cannot register, the father can do this at the address where he and his mother live together or in her apartment.

After the 30-day period, a child can be registered only with the consent of both parents or guardians.

Another feature is that to register a child, it is not necessary to take into account the living space standards per person in a specific apartment.

Is STD-R different from STD-PFR

The STD-PFR form displays information about the employee’s activities with all employers, while the STD-R includes data from the last place of work. The STD-PFR certificate completely duplicates the information contained in the electronic work book.

According to 439-FZ, companies had to switch to electronic labor from 2021. Employees working until December 31, 2020 retained the right to maintain paper labor records. For individuals who began working on January 1, 2021, the employer has the right to create a work report only in electronic format.

Can registration be refused?

Registration of a child is rarely denied, because the law has simplified this procedure as much as possible for minors. There is no need to obtain permission from other residents or even the owner of the apartment if one of the child’s parents is registered in it.

But still there are refusals. Their reasons may be:

  • Registration in emergency and dilapidated housing.
  • The parent does not agree to registration.
  • The property has been seized.
  • There are no documents from the mandatory list.
  • Absence of a power of attorney if registration is carried out by an authorized person.

If you disagree with the refusal to issue a certificate of registration of the child at the place of residence, you need to obtain a written version of it to contact higher authorities.

Unified form of certificate of residence and the data contained in it

Like all official data, a certificate of residence is issued on a special form, unified form No. 9. This form is used most often, but sometimes unified form No. 8 is also used. The difference between these two forms is that form 9 contains more complete information relating to residential real estate. It contains the following information:

  1. Date and number, since such certificates are subject to mandatory registration;
  2. Name of the institution or organization that issues this certificate;
  3. The seal of the organization that issued the certificate, as well as the signature of the person responsible for its issuance, as well as for the accuracy of the information contained in it. Without these details, the issuing authority will not be valid.

Data about the residential premises and the people living in it, specified in the certificate:

  1. The address where the residential premises are located, its square footage, status (room, apartment, house), number of rooms.
  2. Information about the owner of the residential premises, even if he is not registered at this address; if there are several owners, then, as a rule, all of them are indicated, sometimes indicating the share of their ownership.
  3. Data on currently registered citizens, the date of their registration. If necessary, their relationship to the owner of the property or the responsible tenant is indicated if the housing is municipal.

Data on those previously registered, the dates of their registration and deletion, as well as the reasons. Sometimes this data is not provided, or is provided only for the last few years. It all depends on why a certificate of residence is needed.

Sometimes a citizen may be refused to receive a certificate; a common case is when the House Management refuses due to existing debt on utility bills; such actions are illegal and can be appealed in the manner prescribed by law.
