Is it possible to get federal maternity capital if you apply for regional maternity capital?

The regional MK program started working in 2011. The certificate can be issued for the third and subsequent children in the family, while the conditions at the federal level apply to firstborns and future newborns.

One family can participate in two programs simultaneously. For example, federal maternity capital was provided for the second newborn, but with the birth of the third baby, regional state support will be provided. The programs have different sources of funding: the first operates thanks to the federal budget, while the second is financed from the budgets of the city, region or region, so the opportunity to participate in both programs exists.

Is it possible to sell land received through land capital?

After receiving monetary compensation for land capital, parents of a large family are obliged to begin fulfilling the requirements of the state: building a summer house or arranging a garden.

In the event that the main purpose of buying a summer cottage is to be able to run your own household, or to start construction. It is enough to lay the foundation, and this will be enough to fulfill the conditions of the land certificate.

But it also happens that citizens do not want to use it for such purposes at all; in this case, it is possible to sell the plot. The law does not prohibit doing this.

By choosing the second option, i.e. When selling a land plot, lawyers recommend selling land only to those citizens who will not plan to receive land capital. After all, if the authorities find out that compensation was issued for this site, then you need to understand that the new owner will definitely not receive monetary compensation.

In which regions does the maternity capital program operate in 2021?

Adoption or the birth of a third or future children in Kuban gives the right to receive state support in the amount of approximately 130 thousand rubles. The Krasnodar region allocates money for this purpose from its budget. The family can spend the help only after the child’s third birthday, by improving housing conditions and gasification. The money can be left for a child’s education or used to pay off a mortgage loan from this account. The latter condition does not require waiting until the age of three.

Astrakhan allocates about 60 thousand rubles from its budget for the same purpose. An additional condition applies here: mandatory residence in the area of ​​operation of the capital for at least three years. It is important for parents not to have a criminal record. To receive capital you need to obtain low-income status. Registration of maternity capital is possible until the child turns three years old.

The Kaluga region pays families with two children 50 thousand rubles, and for the birth of a third child adds another 100 thousand. There are no restrictions on the period of stay, no restrictions on spending. The spending of funds is not controlled in any way; the money is simply transferred to the mother’s account.

The Ryazan region offers maternity capital in the amount of 72 thousand rubles. To spend this money, you need to wait until the baby is one year old. There are restrictions: purchase or renovation of housing, connection to utilities.

The Tula region offers families 150 thousand rubles. The spending of this money is regulated by local law, but the list is quite wide:

  • Correction of living conditions.
  • Repair and connection of engineering.
  • Education.
  • Treatment.
  • Purchasing a car.

The Arkhangelsk region offers 105 thousand rubles as capital. Basic conditions:

  • The appearance of a third and upcoming newborn in the family.
  • Residence in the region for at least three years.

The expenditure of maternity capital funds is not regulated.
The Kaliningrad region pays parents 50 thousand rubles for the birth of their third and subsequent children. The only important condition for a family is low income. The money can be received in a single payment or in monthly payments. An innovation that has appeared in recent years: student capital, which is paid to those who give birth to a baby during their studies. The funds from this payment can only be spent on improving living conditions, paying for medicine or necessary goods for the baby. Money is not transferred immediately, but only after confirmation of expenses.

The Voronezh region offers families with three or more children 150 thousand. Residence in the region must be at least 12 months; an income not exceeding two times the monthly minimum is important. Spending is regulated, but it is quite broad. In addition to correcting the living conditions and gasification, there is also treatment. The region has adopted a capital program for the second child. for women under 28 years old - 200 thousand, but here spending is not regulated in any way

In Komi, the capital amount is 150 thousand, provided to all families, even with the first child. The spending options are quite wide; for example, you can spend money on redevelopment.

The Bryansk region offers families with a third and subsequent children 200 thousand rubles. The third and subsequent twins are offered a double amount of capital. Current restriction: residence in the region for at least a year. Family income is not important for registration, but expenses are quite wide. At the same time, living conditions can be improved at any time from the moment the baby is born, but everything else requires waiting until the child’s third birthday.

The Tambov region offers family capital to the third or subsequent child in the family in the amount of 100 thousand rubles. Spending only means improving living conditions. Current restriction: permanent residence in the region.

In the Oryol region, maternity capital is paid only to large families - 133 thousand. You must live in the region continuously for at least three years, but it is not necessary to wait until your child’s third birthday to claim money. In addition to basic expenses, there is the possibility of purchasing agricultural equipment.

The Khabarovsk Territory pays families with two children 185 thousand, and adds another 250 thousand for a third child. There are no restrictions on receiving or spending.

The Irkutsk region offers 103 thousand rubles for the third and subsequent children. The amount can be used in parts or in full. For money you can improve living conditions, get an education, treat a disabled child.

The Krasnoyarsk Territory pays 132 thousand after the birth of the third and subsequent children. The money is simply transferred to the account; there are no restrictions on spending, but you cannot withdraw the entire amount at once.

In Tuva, a regional certificate is offered only for the fifth and subsequent children. The payment amount is 54 thousand. Spending is not limited, but as local statistics show, most families try to use this money to improve their living conditions, pay off the mortgage, or pay for their children’s education.

Can a land certificate be used to purchase land for individual housing construction?

In order to properly manage a land certificate, it is necessary to take into account many nuances and subtleties of this process. According to the Presidential Decree, a document giving the right to receive a plot of land on preferential terms will be provided starting in 2021. In accordance with this regulatory act, every large family living in St. Petersburg is given the opportunity to receive a land plot for individual development free of charge.

The state guarantees the provision of additional assistance to parents raising three or more children in the following forms:

  • land certificate (a document that provides the opportunity to allocate a plot for the construction of a residential building);
  • land capital in the amount of 300 thousand rubles, the intended purpose of which is the acquisition of a plot of land for the construction of a residential building.

Large families have the right to independently choose how to receive government support as part of a social program to improve housing conditions. Families who have the opportunity to purchase the land they like on their own at their own expense, with subsequent reimbursement of part of the amount spent by the state, choose a program for the provision of land capital.

Citizens who do not have this opportunity apply for a land certificate and subsequently exchange it for a plot of land worth no more than 300 thousand rubles.

  • large families are given the opportunity to choose how to receive government support;
  • the plot of land selected as part of the social program must be located on the territory of the Russian Federation;
  • funds are provided from the city budget fund of St. Petersburg;
  • a land certificate is issued in the name of a specific citizen who has the right to receive a plot of land; transfer or sale of the certificate to other persons is prohibited;
  • the document granting the right to receive a land plot is not indexed;
  • a certificate is allocated in the amount of 300 thousand rubles (this amount is not provided in monetary equivalent, a document is issued that allows you to purchase a plot);
  • To obtain a land certificate, you must contact the authorized body with the appropriate application and documents confirming your right to receive state assistance.

In the application for issuing a certificate, be sure to indicate the type of construction for which you plan to receive land (individual housing, dacha).

In which regions do you need to report on the expenditure of regional maternity capital funds?

Regional support gives families quite broad opportunities. The intended use of funds is usually limited geographically and money can only be used where the certificate was received. It is better to clarify specific conditions and reporting procedures directly with the social security authority at your place of residence. There are significant differences in individual regions of the country.

In most regions, maternity capital funds can be used to improve living conditions and use money for education and treatment. Reporting is provided depending on expenses. If the mortgage was paid off using the funds, a banking agreement is submitted to the social security authority. If construction work was carried out, then it is necessary to provide certificates for the purchase of building materials. If the money is allocated for training, provide an agreement with a university or private preschool institution.

Land acquisition procedure

In any case, you will have to spend your own money to purchase land, so

the plot is drawn up under a purchase and sale or lease agreement on conditions common to all situations.

Moreover, it can be owned by both private individuals (legal entities or individuals) and the administration of the locality.

You can spend maternity capital only on a house that will be located on this land - and it can be either finished or under construction.

In the latter case, to do this, you need to contact the Pension Fund with an application for receiving funds and a package of necessary documents.

The specific set of papers depends on the situation, however, usually required:

  • statement;
  • applicant's passport;
  • copies of documents for the plot (lease agreement, purchase and sale agreement, certificate of ownership, cadastral passport and plan);
  • copies of documents for the house (if there is one on the site);
  • a copy of the building permit (if the construction of the house is just planned);
  • a copy of the agreement with contractors (if you contact them for services);
  • certificate for the right to receive maternity capital.

The exact list of documents can be clarified in a specific branch or on the official website of the Pension Fund.

After submission, the documents are reviewed for a certain time, after which the pension authority makes a decision - to provide funds for this purpose or to refuse it. Before starting construction and submitting documents, you should consult with Pension Fund employees in order to assess your chances of success in advance.

If the decision was positive, then two options are possible:

  1. Funds are transferred immediately. This option is available if construction takes place with the help of a special company providing such services. In this case, the money is transferred to her account in full before the procedure begins.
  2. Funds are paid in two stages. This method is used when parents decide to do the construction on their own. In this case, only half of the amount is initially transferred to their account. This usually happens within two months after treatment.

The rest of the money can be received after a certain period (six months), provided that there is evidence of construction work carried out on the site. To do this, you will need to contact the authority that issued permission to carry them out, with confirmation of the work already done on the site.

If the bulk of the activities are completed, the applicant will receive the remaining money.

Other ways to obtain a plot of land from regional authorities free of charge

Providing land for free use is possible for various reasons, for example:

  • Individual housing construction.
  • LPH.
  • Peasant farm.

That is, the land can be issued by the administration for free use for building a house, running a subsidiary plot, or doing business in the form of farming.

At the same time, the Land Code of the Russian Federation, subparagraph 6 of paragraph 2 of Article 39.10, does not stipulate any special restrictions regarding the acquisition of plots. Free use for the purposes of individual housing construction, private household plots, peasant farms is determined for a period of 6 years. This rule does not apply to every area. Municipal entities are determined by the law of the Russian Federation. The document lists not only districts and regions, but also settlements.

Who can count on receiving free land in the regions

The list of beneficiaries is not as large as the list of regions, but quite a lot of people fall into this category.
For example, free use of land is possible only for those citizens who have a certain education and work in the relevant type of activity. Important! Land plots are provided to specialists only for individual housing construction and private plots.
It is impossible to engage in peasant farming on this basis. In addition to young professionals, the following categories of citizens were included in the benefit program:

Program “Far Eastern Hectare”

This program can be used by any citizen of the Russian Federation, even those who do not live in the Far East. A plot of land in the region can be obtained with an area of ​​1 hectare, its use free of charge for five years. At the end of this period, the land plot is not confiscated, but a lease or free full-fledged ownership is issued.

However, not everything is as simple as it seems. Receiving land for free use presupposes mandatory farming on the entrusted plot. At the same time, the characteristics of land use are constantly monitored by a special commission. Based on the nature of the use of the land, a further decision is made: transfer of the land to lease or ownership.

How to buy a plot for a land certificate

Land certificate owners will not be able to get real money into their hands. The inability to cash out compensation is caused by the state’s desire to clearly monitor the intended use of the assistance provided. The local administration can provide two types of certificates:

  • with restrictions on the characteristics of the site - the plot must have an area of ​​0.12 - 0.15 hectares, its cost must not exceed the size of the certificate (from 2021 it is 369.8 thousand rubles);
  • without restrictions - the family can choose the plot itself, its cost or part of it will be compensated due to the presence of a certificate.

It is also possible to purchase a house on credit and then pay off the debt using a land certificate.

The certificate is valid for 3 years. The amount indicated in it will not be indexed. The document cannot be extended or exchanged, so every family that has received the right to compensation is interested in the purchase of the plot being made as soon as possible.

Certificate holders independently choose the land. If it is not possible to pay the seller in cash, program participants face difficulties, since in order to transfer funds the seller must provide a purchase and sale agreement. In fact, the seller must give up his plot only for a promise to transfer money. Therefore, buying on credit often looks more attractive, although it is more expensive.

To receive compensation under the Certificate after purchasing a plot, its owner must:

  1. Contact the MFC of the region where the land is being purchased.
  2. Receive an extract from the USRN for the new owner.
  3. Submit an application to the local MFC where you received the land certificate, attach a package of documents including a passport, an agreement confirming the purchase of the plot, an extract from the Unified State Register of Real Estate, and a land certificate.
  4. Within a month, the money will be transferred to the certificate owner’s account.

Some real estate buyers are worried that the money may not be transferred. In practice, such situations do not happen. Always after submitting documents, funds are transferred to the account of the certificate owner.

However, there is no need to let your guard down. It is worth concluding a deal to purchase a plot of land only when the certificate is already in your possession. Otherwise, you risk getting into an uncomfortable situation after a refusal to issue compensation.

Large families are eligible to receive a free plot of land in many regions. For the birth of a third child, you can receive monetary compensation, which can be used to purchase a plot of land in:

Is it possible to replace a land plot with cash compensation?

In the same regions listed above, you can replace the possibility of obtaining land with money. To do this you need:

To receive compensation, you usually need to contact local administrations or MFCs. Payments in most cases are one-time and are transferred to the details specified in the application. The authorities are given 20 working days to make a decision, and another 10 days are allocated to transfer funds. Receipt of compensation by a family entails automatic exclusion from the queue for a land plot.

What is a land certificate

To improve the demographic situation, all families with three or more children have the right to receive a plot of land intended for housing construction. In practice, the implementation of the program differs greatly from the expected capabilities. The sites provided by local authorities are located far from large populated areas and lack basic utilities. As a result, even those who can obtain a plot of land are unable to actually develop it and build a house.

The land certificate fueled interest in the implementation of the state program. This practice is not used in all regions. However, the successful initiative is gradually being picked up by more and more areas. In essence, a land certificate is compensation that is issued for the purchase of a plot of land or a finished residential building. Its amount increases every year through indexation, but it is approximately equal to the size of maternity capital.

Each potential participant in the program must understand that he has the right to receive a certificate or refuse it, and expect to be issued a free site. The cost of the land plot will definitely be more than monetary compensation. However, the land received cannot be returned to the state or exchanged. The only thing you can do if the location of the plot is not at all suitable for you is to try to sell it. However, the liquidity of land without electricity, water and access roads is very low, and it will be difficult to sell it.
