Conditions for providing land to a large family

Who can receive a free plot of land from the state

What is the queue for obtaining a land plot?

The queue for receiving a land plot is a certain kind of procedure for providing land to social groups in order of priority.

It should be noted right away that queuing can occur both on a general basis and due to preferential status.

The preferential category of citizens, for natural reasons, has a significant advantage in obtaining a land plot, while citizens who are in line on a general basis can wait for years for their land plot.

On June 14, 2011, the Federal Government of the Russian Federation prepared and adopted Law No. 138-FZ “On Amendments to Article 16 of the Federal Law “On Promoting the Development of Housing Construction” and the Land Code of the Russian Federation.” This law established and introduced new conditions for the provision of land plots, and also established a list of documents necessary to obtain land for the purpose of building a house.


But the most important introduction of the law is the program to provide young and large families with land ownership.

Based on the program, numerous local regulations were issued, for example, in Moscow and the Moscow region, on the procedure for allocating land to large families based on the adopted changes.

The law is in force as of January 2021, has not been formally repealed and has its own characteristic features regarding the queue for receiving land plots.

Reasons for refusal of a land plot for large families

There can only be two reasons for refusal: your family is not covered by the law or the terms for providing services in this region have expired. In addition, there are the following restrictions:

  • Land plots are not issued to large families in Moscow; I don’t think there is any need to explain “why”. However, one can lay claim to the Moscow region and, partially, to the territory of New Moscow. Please check the specific list of plots before submitting an application at the Moscow Department of Land Resources;
  • The land plot must be free from disputes of third parties and not be a state reserve;
  • After receiving the land, within 1 year you must begin development (lay at least the foundation of a house). Otherwise, the plot may be seized;
  • All additional costs associated with registration, land surveying, obtaining a building permit and carrying out work on connecting to utility networks are at your expense.

Is it possible for a large family to immediately acquire land ownership?

It will become easier for large families registered in the Nizhny Novgorod region to obtain land that can be used for the construction of a residential building: Governor Gleb Nikitin introduced a bill proposing changes to the procedure for providing land plots.

Now the law provides ownership of a plot of land for the duration of the lease agreement or for the duration of the construction of a residential building. The existing conditions turned out to be far from ideal, since there are many examples where people did not have time to complete construction within the allotted period, eventually losing their land and becoming debtors. Therefore, the ministry responsible for property relations presented a version of the bill, according to which families with a large number of children will immediately begin to receive an allotment of property without the obligatory condition of signing a lease agreement.

The authorities of the Nizhny Novgorod region are faced with the task of providing allotments until 2021 for all large families registered before the beginning of 2021. Next year, about 1,700 plots will be allocated, which is about 40% of the total number of families in the queue. The region's leadership has no doubt that there will be no problems with the distribution of territory, and there will be enough land for everyone.

If the law is adopted, the likelihood of which is very high, the site can be used as collateral, and the process of obtaining a construction loan will be significantly simplified.

Legal basis

The provision of free plots of land for ownership is based on the following provisions:

  1. Land Code – in particular, Art. 39.5 Cases of providing a land plot in state or municipal ownership to a citizen or legal entity for free use, Article 39.10 Providing a land plot in state or municipal ownership for free use
  2. Regional regulations. For example, the Law of the Saratov Region of 2015 No. 5-ZSO “On some issues of providing land plots that are in state or municipal ownership for free use by citizens.”
  3. Federal programs to promote resettlement in certain regions of the country . The most famous of them is the Far Eastern Hectare.
