Technical passport of an object and building is a document drawn up based on the results of the primary current or extraordinary inventory. The technical passport contains the main technical parameters of a building, apartment, non-residential premises, private household. In Moscow, a technical passport is a mandatory document for approval of redevelopment in an apartment building. What is a technical passport

The legal concept of a technical passport is contained in the Housing Code of the Russian Federation (), order of the Ministry of Land Construction of the Russian Federation dated 04.08.1998 N 37 “On approval of the Instructions on accounting of housing stock in the Russian Federation” ().   • initial data on the technical parameters of the object are collected as a result of inventory;
  • inventory includes the study of design documentation, surveys, measurements, drawing outlines, filling out floor plans and statements of premises;
  • based on the results of the inventory, sections of the technical passport are filled out (their content is determined by Order of the Ministry of Land Construction No. 37);
  • the object’s passport is included in the inventory file, which is stored in the BTI or other organization that carried out the inventory.

Before the transition to the cadastral registration system (2013), the technical passport of a premises or building was one of the main documents for real estate. It is used when making transactions, agreeing on changes in the characteristics of objects, and in a number of other cases. In Moscow, the inventory and certification of real estate is carried out by the State Budgetary Institution "MosgorBTI".

At the moment, the main document required for accounting and registration of real estate is the technical plan of the cadastral engineer. However, the BTI technical passport is still used when undergoing some procedures. For example, according to Art. 25 of the Housing Code of the Russian Federation, a prerequisite for approving the redevelopment of an apartment is to contact the BTI and make changes to the technical passport. A similar rule is specified in Moscow Government Decrees No. 106-PP and 508-PP.

Expert commentary. According to Resolution No. 106-PP, the State Budgetary Institution “MosgorBTI” is authorized to carry out inventory and technical accounting of all objects in the capital. From the inventory file of the MosgorBTI, an extract from the technical passport, floor plans, a BTI certificate, and other documents are issued. The form of the certificate depends on the purposes for which it is taken. For example, a BTI certificate may be issued about the technical characteristics of the object, inventory value, actual condition, etc.

How much does registration cost?

If the owner draws up the document himself, then his only cost will be payment of the state fee. It is 1200 rubles. It must be paid on the day of application to the BTI. The receipt must be attached to the documents, otherwise they will not be accepted.

If the submission of papers is carried out through the MFC, then payment is also made at the same institution through the terminal.

Additional costs may arise when contacting specialized agencies providing intermediary services. The cost of their work depends on the area of ​​the room and can average from 2 to 10 thousand rubles. For urgency you will have to pay about 3-15 thousand rubles.

The main documents based on the results of the inventory are a technical passport for an apartment or other object, a floor plan and an explication. In fact, floor plans and explications are appendices to the technical passport. However, they can be obtained from the inventory file in the form of separate documents.   • technical passport for a house, building or premises - a general document that contains the technical indicators of the object;
  • floor plan - is an appendix to the technical passport, contains a description and location of all premises on the floor of the building (according to the order of the Ministry of Land Construction No. 37, the floor plan is drawn up for each floor of the building, starting with the basement);
  • explication (statement) of the premises - an appendix to the technical passport, which is formed from the contents of the floor plan, includes the calculation of the areas of the premises.

From the inventory file, you can request a registration certificate with all attachments or a separate document and extracts. When changes are made to technical passports, the content of floor plans and explications will simultaneously change. The floor plan is always presented in the form of a drawing, which indicates the boundaries of the premises and notes from specialists. The explication of the premises is drawn up in the form of a table, filled out in accordance with the order of the Ministry of Land and Construction No. 37.

What buildings are considered non-residential?

Non-residential real estate includes:

  1. separately located buildings related to the service sector (gas stations, cafes, restaurants, studios, car washes, laundries, shopping and entertainment centers);
  2. buildings for domestic purposes (warehouses, bunkers, hydroelectric power stations);
  3. physical culture and health complexes (indoor areas and stadiums);
  4. industrial buildings (factories, factories, laboratories).

How is the technical data sheet used?

A technical passport can be obtained for a building, premises, house, individual housing construction. To undergo cadastral registration and registration, a technical passport of an apartment or other object is not required. The document must be used in the following cases:

  • to make changes to the characteristics of the object after reconstruction, redevelopment, redevelopment;
  • to obtain initial data for design, surveys, inspections of the building;
  • for scheduled or extraordinary inventory of fixed assets of an enterprise;
  • to obtain loans from banks when the object will be the subject of collateral;
  • in other cases, depending on the goals and objectives of the owner.

When making transactions, a technical passport is not needed. However, it can be requested voluntarily to check the presence or absence of illegal redevelopment. For example, if the technical passport for an apartment contains a floor plan with red lines, they must be eliminated. To do this, you need to legalize the work performed - order a technical report and technical plan, contact the housing inspectorate or go to court. Only after eliminating the red lines will Rosreestr enter the correct characteristics of the apartment into the Unified State Register. How to obtain a technical passport from the BTI

If the inventory was previously carried out in the BTI, the registration certificate will be stored in the inventory file. It can be requested by the owner of the property or his authorized representative. A passport for an object just put into operation can be obtained after the initial inventory. The procedure for inventory and registration of technical passports is regulated by Order of the Ministry of Land Construction No. 37, Resolution No. 106-PP:

  • the owner receives documents on putting the building into operation, transfers them to the BTI or another organization, and enters into an inventory agreement;
  • specialists study documents and go to the site for inspections;
  • During the surveys, measurements are made of the external boundaries of the building, internal premises and structures;
  • during measurements, outlines are drawn reflecting the proportions of the premises and describing the measurement results;
  • Based on the results of measurements and outlines, sections of the technical passport are filled out, a floor plan and explication are drawn up.

The inventory number of the object is indicated on the title page of the technical plan. After passing cadastral registration in Rosreestr, the cadastral number of the object will be added to the title page. The passport is valid for 5 years, but an extraordinary inventory will be carried out after each change in the characteristics of the object.

Expert commentary. According to Decree No. 508-PP, the technical passport of the apartment must be submitted to the housing inspectorate simultaneously with the project. However, if information about the house is entered into the capital’s real estate register, a BTI passport will be requested as part of an interdepartmental exchange. After receiving the commission acceptance certificate from MZhI, you need to submit this document to the BTI to make changes to the technical passport for the apartment.

Types of fire extinguishers

The design of the fire extinguisher is also of paramount importance. There are:

  • Air foam devices. They are filled with foam.
  • Aquatic. Their filler is carbon dioxide.
  • Gas fire extinguishers. They are filled at the factory with refrigerant.
  • Powder.
  • Mixed type.

Moreover, there are portable models, whose maximum weight is 20 kg, and there are mobile ones, with a powerful chassis. Their weight can reach 4 centners. According to regulations, the maximum distance that can separate a fire extinguisher and a probable source of fire is 20 meters. Accordingly, between two places where fire safety equipment is located is 40 meters. Red lines in the technical data sheet

If the BTI floor plan contains red lines on the diagram, we are talking about an uncoordinated redevelopment. The Housing Code of the Russian Federation and Resolution No. 508-PP make it possible to legitimize the work actually performed. To do this, you need to confirm that the redevelopment did not pose a threat to the reliability, strength and stability of the building, and complies with building codes and regulations. These points will be checked during the legalization process.

The owner’s algorithm for eliminating the red lines of the BTI registration certificate is as follows:

  • if the work was not carried out on load-bearing structures, it is necessary to order a project and a TEP certificate (technical and economic indicators) from our company;
  • you need to order a technical report on the condition of load-bearing structures from the authors of the house or from the State Budgetary Institution “Expert Center”, if the work on them entailed drawing red lines (when drawing up this document, compliance with all SNiP, GOST, SP will be checked);
  • you need to order a technical plan from the cadastral engineer, which will describe the actual condition of the premises and the characteristics after the redevelopment;
  • the document must be submitted to the housing inspectorate for legalization;
  • with a positive decision from the Ministry of Housing, you must contact the BTI to make changes to the technical passport of the premises;
  • The final stage of legalization will be an application to Rosreestr to make changes to the Unified State Register.

After completing this procedure, the BTI floor plan will not contain red lines, so the technical passport can be submitted to the bank or used for other purposes.

Expert commentary. The administrative procedure for legalization may result in the issuance of a refusal decision by the Ministry of Housing. Such a refusal can be appealed through the Moscow City Court. To defend your interests in court, it is advisable to involve an experienced lawyer and obtain the opinion of a cadastral engineer. During its lifetime, each fire extinguisher must first undergo inspection for commissioning, then it undergoes three types of inspections:

  • Full. Usually carried out on the initiative of the manager, by a separate order.
  • Planned annual. External inspection, inspection of trips, check for possible leaks, remove products with low pressure in the cylinders or those that have reached their fifth service life. Sometimes, if necessary, selective opening of powder products (at least 3% of the total quantity) is carried out to determine the condition of the filters, the composition of the waste agent (dispersity, the presence of lumps and the ability to destroy them, moisture content, flowability). If the requirements regarding these parameters are not met, then the entire batch of fire extinguishers for this period is replaced throughout the entire enterprise.
  • Planned quarterly. They are relevant only for large manufacturing enterprises or organizations whose premises have a fire hazard class of A or B. There is nothing serious here: an external inspection, an inspection of the installation site.

Important point! The date of the last inspection is noted not only in the log, but also on the fire extinguisher itself.

To do this, tags are attached to them. If the equipment is carbon dioxide or powder, then, in addition to this information, the tag should contain the mass of the charge and the cylinder. Each equipment must be accompanied by an instruction manual. She will tell you which fire extinguisher needs to be checked. For example, the service life of OPAN-50M fire extinguishers is 10 years. But this does not mean that they do not need to be checked every year.

Approval of redevelopment in the technical passport

After completing the redevelopment project, you need to order a BTI technical passport and submit the documents to the housing inspectorate. When the work in the apartment is completed and the Ministry of Housing issues an acceptance certificate, you can contact the BTI and make changes to the technical passport for the house. This procedure includes the following activities:

  • BTI specialists study documents on the redevelopment, including the project;
  • measurements of the premises are taken, new characteristics and dimensions are determined;
  • changes are made to the relevant sections of the technical passport and inventory file.

The updated technical passport will indicate the date of the last inspection, i.e. at the request of the owner. The BTI registration certificate can be obtained in hand in the form of a copy or an extract, but it is not needed for cadastral registration.

Is it necessary to have such a form?

The logbook for fire extinguishers, in accordance with existing legislation (specifically, paragraph 478 of the Fire Regulations adopted by Government Decree No. 390 of April 25, 2012), can be drawn up in a free (arbitrary) form. However, the laws clearly state the requirements that it must meet. The form available for download contains everything you need to comply with these requirements: details of the organization, timing of inspections of each fire extinguisher, etc.

Thus, despite the fact that the given form is not unified, its use will be optimal in any of the organizations, since it contains and describes all the fundamentally important points that inspectors from regulatory organizations pay attention to during inspections.
