Where and how to get a technical passport for an apartment

Registration passport - what kind of document is it?

It is an A3 booklet and consists of drawings, tables, as well as data in the form of text about the condition of the room.

It contains information about:

  • home owner;
  • location of the premises;
  • common living space and individual rooms;
  • inventory value of housing;
  • major repairs carried out;
  • redevelopment;
  • material of walls and ceilings, as well as their finishing;
  • engineering communications;
  • explications;
  • how old it was built, etc.

At the end of it, the date of issue, signature and information about the person who issued the document must be indicated.

It is issued for an indefinite period, but requires updating and reconciliation every 5 years. If this deadline is missed, no sanctions are imposed on the owner, but, for example, it will not be possible to sell an apartment with an “outdated” registration certificate. You will have to update the document quickly, and this is already a problem if you need to urgently sell your home.

That is, difficulties due to omission may begin after the fact, when this document has to be used officially somewhere.

Also, changes must be made to the technical passport if the layout of the apartment has changed. The responsibility for re-issuing documents in this case falls on the owner - it is he who must contact the relevant authority to reflect the changes made in the registration certificate.

Attention! If this is not done, then when checking the technical passport data for compliance with the real state of affairs, you will be fined in the amount of 1,500 rubles.

How to restore a purchase and sale agreement?

To restore the purchase and sale agreement, you can try to contact the seller - he should have a second copy, then make a copy and notarize it.

If it is not possible to contact the seller, then a duplicate of the contract can be requested from the Rosreestr and then also certified by a notary.

The third way is to immediately contact a notary (the one who certified the contract): he should keep a copy. If the housing was purchased in 1996-1998 or earlier, you can look for copies of documents in the city archive.

Why do you need a technical passport?

This document does not have any legal force when registering alienation transactions, but it is necessary to obtain a cadastral passport, without which no agreement on the transfer of real estate ownership can take place.

In addition, a technical passport is needed for:

  • obtaining permission for redevelopment;
  • transfer of residential premises to non-residential premises;
  • determining the inventory value of an apartment: may be required by a notary when resolving inheritance issues;
  • or for the bank that issues the mortgage.
  • calculation of apartment tax;
  • allocation of a share in kind in shared ownership;
  • at the request of the buyer to verify the data in the technical passport with the actual situation;
  • while proving ownership of an apartment in court;
  • home insurance.
  • Documents for obtaining a BTI technical passport

    As we have already said, without a technical passport it is impossible to make documents for registering property rights. So let's find out what documents are needed for the BTI for a registration certificate?

    You can obtain a technical passport at the Technical Inventory Bureau if you present the following documents:

    • A document proving that you are the legal owner of this property (purchase and sale agreement, certificate of inheritance, agreement of exchange, gift, etc.).
    • A certificate from the head of the housing office, the head of the cooperative or the chairman of the village council about the absence of debts.
    • Application letter on a special form
    • Certificate of registration of a legal entity (Copy)
    • Certificate from Statistics (Copy)
    • Power of attorney for registration of a technical passport, if registration is carried out by an authorized person.

    The technical passport is a very important document, so its preparation takes quite a long time.

    Which body is responsible for issuing and amending the registration certificate?

    You can obtain a new technical passport or make changes to an existing one at:

    • BTI . You should contact the local authority at the location of your home. Usually this is the BTI that is closest to your home. There are no other services where you can obtain a technical passport for an apartment, so due to their workload, preparing the document takes a lot of time.
    • MFC. However, this structure performs intermediary functions, that is, it simply transfers your application to the BTI and accepts a package of papers instead. The BTI employees, not the MFC, will prepare a new document, take measurements, etc.

    What are the documents for an apartment?

    Documents for an apartment can be legal, legal and technical. Legal rights include those that certify the emergence of ownership rights to real estate. This could be a purchase and sale agreement, a court decision, an agreement on shared participation in construction, a gift agreement, an exchange agreement, a certificate of inheritance, etc.

    Title documents are documents, respectively, that confirm ownership of real estate. Until 2016, such a document was a certificate of ownership. From July 15, 2021, the issuance of certificates of ownership was stopped, and all transactions began to be registered in the EGPH (Unified State Register of Real Estate) instead of the EGRP (Unified State Register of Rights to Real Estate).

    Technical documents include those that contain the parameters of an apartment, room or other real estate. These are, for example, technical and cadastral passports.

    What documents need to be submitted to the BTI

    In addition to a statement indicating the reason, the following documents should also be provided to the BTI to obtain a technical passport for the apartment:

    • passport;
    • a document confirming ownership of the object;
    • receipt of payment of state duty.

    This is a general list that can be individualized with additional documents depending on specific situations.

    During redevelopmentRequest from the Department of Architecture and Urban Planning
    Upon receiving an inheritanceCopy of the will
    When registering an object as collateralPledge agreement
    If a trusted person acts in your interestsPower of attorney certified by a notary
    For privatizationCertificate No. 7, rental agreement or warrant

    The BTI employee to whom you transfer the package of papers is obliged to issue you a receipt confirming their receipt. It is with her that you will need to appear when the registration certificate is ready.

    Documents for BTI

    As a rule, the list of documents is standard, but there may be some changes that depend on the characteristics of the property and the specifics of the work of the BTI.

    • Title document . It can be a purchase and sale agreement, an exchange agreement, a gift agreement, an inheritance agreement, a privatization agreement, and more. Such a document must be submitted in the original, and after the registration procedure it will be given to you. Along with the original, a copy of the title document is submitted, which must be certified by a notary. A copy after registration remains in the BTI.
    • Passport, IIN and their copies . Copies will be stored in the BTI archives, and the originals will be given to you immediately after checking the copies.
    • Real estate registration certificate . The original and a copy certified by a notary are also submitted. If there is no registration certificate, then you will have to make one; without it it is impossible to complete the registration of ownership.

    When the entire package of documents is ready, you give it to the registrar, who is responsible for receiving and registering incoming documentation. After checking your documents, the employee will give you a receipt for payment. After paying the required amount at the bank, bring the check and you will be given a day for issuing the title deeds. This procedure will take approximately three weeks.

    How much will you have to pay

    The total cost of a technical passport for an apartment from the state duty and payment for services provided by the BTI.

    1. The amount of the state duty (despite the prefix “state”) is set at the regional level, and therefore is not enshrined in any law. Approximately its size is 1000 rubles.
    2. BTI, being a government agency, has the right to conduct commercial activities, and therefore its services - specialists visiting your home to take measurements and evaluate changes made - are paid.

    How much you will have to pay for their services - you will be told after they are provided, when you come to pick up the finished registration certificate. The amount will depend on the area of the premises, the duration of the work being carried out, etc. The state fee is paid immediately: without it, the application simply will not be accepted.

    In addition, remember that if you turn to intermediaries, the cost of the registration certificate will also include the price of their services.

    Is it possible to restore a certificate of ownership?

    No, it cannot be restored. From July 15, 2021, certificates of ownership will no longer be issued. All transactions are now registered in the Unified State Register instead of the Unified State Register. Accordingly, all data from the Unified State Register was transferred to the new register. If you became the owner of real estate before 2021 and received a certificate in your hands, but lost it, you will need to issue an extract from the Unified State Property Register. To get it, you need to contact Rosreestr or MFC.

    If the property was purchased after 2021, then after registering the property right you received an extract from the Unified State Register of Real Estate. You can obtain a new extract by contacting the Rostreestr, providing a passport, a receipt for payment of the state duty and an application.

    You can also issue an extract on the Rosreestr website - to do this, you need to enter the cadastral number of the property or its exact address in the search field, and then select the corresponding value from the drop-down list. After this, you need to select the desired extract form and pay the state fee. An electronic statement, as a rule, is prepared in 15-30 minutes, in exceptional cases - up to 5 working days. The document will be sent by email.

    Technical plan in Moscow and the Moscow region

    A technical plan is a relatively new document, which, for the purposes of registering property rights and state cadastral registration of capital construction projects, has replaced a technical passport.

    In accordance with Federal Law of July 13, 2015 N 218-FZ On state registration of real estate;
    a technical plan is a document that reproduces certain information entered into the Unified State Register of Real Estate (USRN), and indicates information about a building, structure, premises, an unfinished construction project or a single real estate complex necessary for state cadastral registration and registration of ownership of such real estate object. A technical plan is required in the following cases:

    • for the initial registration of a property for cadastral registration and registration of ownership
    • when putting a completed property into operation;
    • when completing real estate transactions;
    • to take into account changes in the characteristics of an object after reconstruction, restructuring or redevelopment;
    • when registering the right to lease a part of a building, premises, structure.

    In addition, very often a technical plan is necessary for conducting judicial (controversial) proceedings.
    Types of technical plan
    Due to the fact that real estate objects have significant differences among themselves in purpose, technical and economic indicators and other characteristics, technical plans are of the following types:

    • technical plan of a residential building (individual housing construction, garden)
    • technical plan of an apartment building (MKD)
    • technical plan of an unfinished construction project
    • technical plan of a non-residential building (shops, warehouses, administrative buildings, etc.)
    • technical plan of structures (linear objects, utilities, roads, sites, etc.)
    • technical plan of residential and non-residential premises
    • technical plan of vehicle locations
    • technical plan for part of the building (premises) for registration of the lease agreement

    Documents required for the preparation of a technical plan
    The technical plan is drawn up by a cadastral engineer.

    Information in the technical plan is entered in accordance with current Russian legislation on the basis of the following documents submitted by the customer of cadastral work:

    • construction permits and design documentation, if this is an unfinished construction project, an apartment building or a non-residential building;
    • redevelopment project and acceptance committee report confirming completion of redevelopment for premises (apartments);
    • a declaration drawn up and certified by the owner of the land plot on which the building is located (house, garage, outbuildings, etc.);
    • a document on assigning a postal address to a property (an act of a state authority or local government);
    • notifications about the planned construction or reconstruction of an individual and garden house, as well as notifications about compliance with the requirements of urban planning regulations.

    The requirement to draw up a technical plan on the basis of a notification has been provided for by law since August 4, 2021 (Law No. 340-FZ of August 3, 2021). Our company will help the customer prepare a notice of planned construction/reconstruction or a notice of completion of construction/reconstruction of an individual housing construction project or garden house

    If the developer received permission to build an individual house before the date of entry into force of the above law, the existing permission is used to prepare the technical plan.
    What determines the cost of services for drawing up a technical plan?
    The cost of our specialists’ services will depend on a number of parameters:

    • Total area, configuration of external contours and other features of the property
    • Location of the property
    • Difficulties of work
    • Availability or absence of all necessary documentation
    • Terms and conditions of work performance

    The cost also depends on the number of customers who apply. If simultaneous land surveying of land plots is carried out for several owners, then for each of those who apply, the cost will be lower. To clarify the cost of land surveying work, please call the phone number listed on the website.
