What responsibilities does a passport officer perform in a management organization?

The passport office in the management organization is a unit that acts as an intermediary between citizens and the Federal Migration Service. The position of a passport officer requires attention and a responsible approach to work.

Under the management agreement, the management organization, on the instructions of the owners, undertakes the obligation to carry out the work and services specified in it within the agreed period (Part 2 of Article 162 of the Housing Code of the Russian Federation). Issuing certificates and maintaining registration records of premises owners is a mandatory condition of the management agreement for apartment buildings. These responsibilities in the management organization are performed by the passport office - a separate division whose tasks include registration and registration of citizens at the place of residence, deregistration, and initial registration of identity documents. The position of the employee who performs such duties is called a passport officer.

The passport officer in the management organization is responsible for:

  • checking documents submitted by residents;
  • registration of citizens according to the law;
  • maintaining passport records;
  • issuance of certificates/statements in the prescribed form;
  • maintaining a file cabinet both in paper and electronic form;
  • drawing up reports.

In addition to these responsibilities, the management of the management organization may assign other functions related to accounting and documentation to the passport officer, for example, maintaining a register of owners of premises in apartment buildings.

The main function of the passport officer of the management organization is mediation between residents and the Federal Migration Service. The passport officer transfers all documents received from citizens to the territorial department of the Federal Migration Service. The passport officer has a high level of responsibility to each party. He must provide reliable information to the Federal Migration Service and is responsible for the safety of documents of residents of apartment buildings.

Passport and registration records of citizens are regulated by:

  1. Decree of the Government of the Russian Federation of July 17, 1995 No. 713. This is the main document that approves the rules for registration and deregistration of citizens of the Russian Federation at the place of stay and place of residence within the Russian Federation.
  2. Federal Law of June 25, 1993 No. 5242-1. It establishes the rights of citizens of the Russian Federation to freedom of movement, choice of place of stay and residence within the country.
  3. Part 2 art. 162 of the Housing Code of the Russian Federation, which determines the obligation of the management organization to provide the owners of premises in apartment buildings with the work and services provided for in the management agreement.

The management organization may not hire a passport specialist, but enter into an agreement with the Passport Service. In this case, the MA, and not each owner individually, will pay for the services of the Passport Office. The management organization includes these costs in the tariff for the maintenance and repair of the common property of the apartment building. They cannot be shown as a separate line on the receipt.

Branches of the Federal Migration Service carry out registration of citizens through structural units in accordance with Decree of the Government of the Russian Federation dated July 17, 1995 No. 713. Managing organizations carry out the initial reception of documents from citizens for registration and deregistration at the place of stay and place of residence, preparation and transfer of documents to the registration authority , and also maintain and store apartment registration cards at the place of residence.

Place of stay and place of residence:

  1. The place of residence is the place where the citizen resides temporarily. These can be hotels, sanatoriums, holiday homes, boarding houses, campsites, tourist centers, hostels and other residential premises that are not a permanent place of residence.
  2. The place of residence is considered to be a residential premises where a citizen lives permanently or most of the time: on the right of ownership; under a rental agreement; under a social tenancy agreement; on other grounds provided for by the legislation of the Russian Federation. Citizens are required to register at their place of stay and place of residence with the registration authorities.

Staying in premises that are not the citizen’s place of residence is allowed for no more than 90 days. After this period, the citizen is obliged to contact the officials responsible for registration.

In this case you need to provide:

  • Identity document.
  • Application in the prescribed form for registration at the place of residence.
  • A document that is the basis for temporary residence in the specified residential premises - an application from the person who provided the citizen with the residential premises, a certificate of state registration of ownership of the residential premises, a court decision recognizing the right to use the residential premises.
  • Another document confirming the existence of the right to use the residential premises.

Registration of citizens at a location is carried out for a period determined by agreement with the persons who provided residential premises.

Actions of the passport officer when registering a citizen at the place of stay:

  • accept the citizen’s application and documents necessary for registration;
  • check the completeness of the submitted documents in the presence of the applicant;
  • submit to the registration authority documents with arrival address sheets, drawn up in two copies.

The registration authority reviews the documents provided by the passport officer, checks the information specified in them and issues registration at the place of stay. Then the FMS body transfers the registration certificate at the place of stay and the citizen’s identity documents to the managing organization or to the citizen personally. If the management organization has received the registration certificate, it must transfer it to the registered citizen.

A citizen who has changed his place of residence is obliged, no later than seven days from the date of arrival at his new place of residence, to provide the officials responsible for registration with:

  1. Identity document.
  2. Application in the prescribed form for registration at the place of residence.
  3. A document that is the basis for moving into a residential premises - an application from the person who provided the citizen with the residential premises, an agreement, a certificate of state registration of ownership of the residential premises, a court decision recognizing the right to use the residential premises.
  4. Another document confirming the right to use the residential premises.
  5. If a citizen has been deregistered at his previous place of residence, he must provide a departure address sheet issued by the registration authority at his last place of residence.

The registration procedure at the place of residence takes place in several stages:

  • the citizen provides the passport office of the managing organization with the documents necessary for registration;
  • at the passport office they check the completeness of the submitted documents in the presence of the applicant;
  • The passport officer makes entries in the registration and apartment cards, house register, arrival address sheets and statistical registration forms;
  • The passport officer of the management organization transfers the documents to the registration authority; the registration authority reviews the documents, checks the information specified in the application and issues registration at the place of residence;
  • The state accounting body transfers documents to the administrative authority or to the citizen.

If the documents are transferred to the MA, she can only hand them over to the registered citizen.

If the residential premises is not the citizen’s place of residence, he is considered deregistered from the moment of expiration of the period specified in the application for registration at the place of residence. The situation is different with hotels, sanatoriums, holiday homes, tourist centers, boarding houses and campsites - the citizen remains registered until the moment of departure. And in medical institutions, a citizen is deregistered upon discharge.

A citizen should be deregistered if:

  1. change of place of residence - on the basis of a citizen’s application for registration at a new place of residence or an application for deregistration at the place of residence;
  2. conscription for military service - based on a message from the military commissariat;
  3. conviction to imprisonment - on the basis of a court decision that has entered into legal force;
  4. declared missing - on the basis of a court decision that has entered into legal force;
  5. death or declaration of death by a court decision - on the basis of a death certificate;
  6. eviction from an occupied residential premises or recognition as having lost the right to use residential premises - on the basis of a court decision that has entered into legal force;
  7. discovery of untrue information or documents that served as the basis for registration - on the basis of a court decision;
  8. unlawful actions of officials when deciding the issue of registration - on the basis of a court decision.

A note on the removal of a citizen from registration is placed in his passport on the day the documents are received by the registration authority.

Possible reasons for failures
