Cadastral passport: obtaining procedure, validity period, details

On January 1, 2021, the Federal Law dated July 13, 2015 No. 218-FZ, aimed at creating a Unified State Register of Real Estate (USRN) and a unified accounting and registration system, came into force. The Unified State Register is being formed, which combines the information contained in the real estate cadastre and the Unified State Register. The Unified State Register of Real Estate will include, in particular, a register of real estate (real estate cadastre), a register of rights, their restrictions and encumbrances on real estate (register of real estate rights), as well as a register of boundaries. That is, instead of a cadastral passport, you now need to receive an extract from the Unified State Register of Real Estate.

A cadastral passport is one of the main documents when registering real estate transactions, including apartments. A document is issued for a period of up to five years; after this period, data on the property is considered outdated. In the case of an apartment, the validity of the cadastral passport is one year. The passport must be replaced only if the property is involved in legal transactions, that is, it is impossible to sell, exchange or donate an apartment with an outdated passport. Since 2013, the cadastral chamber has been involved in registration and issuance. A passport for an apartment is an extract from the State Rosreestr with a description of a specific property and is actually the result of a technical inventory and technical accounting of a property, such as an apartment, building or structure.

The cadastral passport for an apartment reflects the following information:

  • General characteristics of the apartment
  • Address of the object
  • Year of construction
  • Number of storeys of the object
  • Material of walls and ceilings
  • Heating type, etc.

Cadastral passport of a house: general concepts

Cadastral passport (hereinafter referred to as CP) is a document containing the necessary information about the house. It is also confirmation that the house is registered. According to Federal Law No. 221 “On the State Real Estate Cadastre”, real estate must be entered into the Unified State Register (USRN). All completed residential buildings on plots for individual housing construction, as well as garden houses on the territory of SNT, are subject to cadastral registration.

Let us remind you that until 2021, according to the law on “Dacha Amnesty”, owners of garden plots can privatize a house after receiving consent from members of the partnership or administration.

Any citizen or legal entity. a person can obtain a CP from the cadastral chamber, which is often simply called Rosreestr.

The Cadastral Chamber is a body subordinate to Rosreestr.

Important! Until 2021, the CP for a house was a separate document, but according to Federal Law No. 218 “On State Registration of Real Estate,” it was abolished from January 1, 2021. Now, instead of the KP, Rosreestr provides an extract from the Unified State Register of Real Estate, which contains more information than a passport. The new extract includes data from the State Property Committee and the Unified State Register.

The State Real Estate Cadastre (GKN), which issued the KP, and the Unified State Register of Rights (USRE) were merged into the EGRN (Unified State Register of Real Estate).

Thus, further we will talk about an extract from the Unified State Register of Real Estate (in the text – “extract”).

The extract contains the following information:

  • technical plan of the house (area, number of floors, layout, etc.);
  • cadastral number;
  • address;
  • presence of encumbrances (pledge, lease, arrest, etc.);
  • information about the owner.

It is necessary to register rights to the house and carry out any transactions with it.

Reasons why an extract will be required:

  1. Purchase/sale, donation, inheritance of a house, exchange. In this case, this document will be required to register the house to the new owner.
  2. Litigation. For example, if you need to prove ownership of a house.
  3. Reconstruction and redevelopment. According to the Land and Civil Codes, any changes to the house regarding its parameters and parts must be entered into the Unified State Register of Real Estate. And accordingly, you need to issue a new, current extract (read how to remodel a house).
  4. Data error. For example, the incorrect address of the house, area or full name of the owner, etc. is indicated.

The legislative framework does not indicate the validity period of the extract; it can be called unlimited. However, if some changes have occurred in the house (redevelopment or reconstruction), then it loses its relevance. That's why we need a new one. To do this, it is necessary to make changes to the Rosreestr database regarding the house. This procedure is similar to its initial receipt and requires the same actions.

Do not confuse the cadastral and technical passport of the house.

The registration certificate contains more information about the house (material of the building, walls, area of ​​the house and each room, plan, street, house number, etc.), but there is no information about encumbrances, owners and, most importantly, the cadastral number. The difference will be that obtaining a cadastral passport is possible only after the object is registered with the cadastral register.

When is it assigned?

The rules and conditions for obtaining are specified in Article 14 of Federal Law No. 218 “On State Registration of Real Estate”.

The basis for the appearance of a cadastral number may be:

  1. Acts of state executive authorities, city councils, village councils, within their competence, on conducting such accounting.
  2. State registration of property rights based on title documents.
  3. Acts on the privatization of residential premises.
  4. Relevant judicial acts that have entered into force.
  5. The creation or termination of the existence of a capital construction project.

If the apartment was redeveloped, there is an obligation to officially register such activity. The result is a new cadastral number with updated information about the new area.

Registration of an extract from the Unified State Register of Real Estate

Nowadays, there are more and more opportunities for paperwork. This extract is no exception. To receive it, you can choose one of the options:

  • Rosreestr;
  • MFC;
  • Rosreestr website;
  • State Services portal;
  • post office.

In all cases, personal application is not necessary. You can issue and receive an extract for a residential building through a representative who will act on your behalf on the basis of a notarized power of attorney.

Regardless of the chosen method of circulation, there is a single list of basic documents.

  • original passport or other identification document;
  • documents for the house (about ownership);
  • statement;
  • receipt of payment of state duty.

Additional documents:

  • power of attorney;
  • technical plan.

Reasons for renewal

The following reasons may serve as grounds for making changes to the document::

  • merger of several land plots into one;
  • fragmentation of one site into several;
  • error when boundaries overlap;
  • review of the purpose of use of the territory;
  • change of owner;
  • challenging the value assigned by the cadastre service.

Thus, the reasons for re-registration are changes to the boundaries of the land territory, a change of owner, or the resolution of any controversial issues regarding the value established by the state or the overlap of territories of adjacent plots.

Step-by-step instructions for obtaining a cadastral passport

As we said, there are 5 ways to format this important document. Let's take a closer look at each of them.

Through the territorial division of Rosreestr or MFC

Step 1. Collection of documents.

Prepare the required list of documents, write an application according to the established template, and pay the state fee.

Step 2. Visit to Rosreestr/MFC.

You need to visit the Rosreestr or MFC unit in the territory where the house is located and submit the documents to a specialist.

Step 3. Get a receipt.

The cadastral chamber or MFC specialist must issue a receipt stating that he accepted your documents and application. The receipt contains a list of accepted documents indicating the quantity. You will also be assigned a day when you can pick up your completed statement.

Step 4. Pick up your passport.

On the appointed day, you need to visit Rosreestr/MFC again to pick up the finished document.

You can also use a new service - visiting the applicant. To do this, an agreement is concluded with Rosreestr, and the extract will be delivered by a courier to your home or office. For WWII veterans and disabled people of groups 1 and 2, this service is provided free of charge, for all others there is a fee. The cost depends on the region.

First of all, you need to register on the official website of Rosreestr.

Step 3. Filling out the application form - information about the house and the recipient of the service

Having chosen, you must fill out an application with precise information.

Here you choose the method of receipt: on paper by post or electronically by e-mail.

An electronic statement has the same legal force as a paper one.

Step 4. Providing documents.

When completing the application, you will be asked to add documents. You must upload photos or scans of all documents from the list, including a receipt for payment of the state duty.

Step 5. Submitting a request.

After checking that the application is filled out correctly, you can sign it with an electronic signature (if you have one) and send the request.

Step 6. Receipt.

Through the State Services portal

Step 1. Collection of documents.

Step 2. User authorization.

Only a user with a verified account can order any service on this portal. This can be done at the MFC.

To receive the required document, log in to the website - enter your login and password for your account.

Step 3. Select a service.

After selecting a service, the portal will redirect to the Rosreestr website, where you need to fill out an application similar to the previous option.

Step 5. Receipt.

You receive the finished document using the chosen method.

Via Russian Post

Step 1. Collection of documents.

You prepare the required list of documents, make notarized copies, write an application according to the established template, and pay the state fee.

Step 2. Sending documents.

Send a package of documents through the post office to the address of the territorial division of Rosreestr. It is better to send by registered mail.

Step 3. Receipt.

You can also receive the statement by mail to the specified address.

Completing an application online has a number of advantages: registration is possible 24/7 and there are no queues, unlike visiting Rosreestr or the MFC.

How to assign online?

Use the service on the Rosreestr website “Reference information on real estate objects online”. To check the cadastral number, you need to go to the Rosreestr website .

  1. On the page, go down using the mouse wheel (turn it towards you) to the “Address” item.
  2. Select this item by clicking on the left mouse button. Make sure that the item is selected.
  3. In the first field, click with the mouse button (see above) on the text “Select subject”.
  4. A list of regions (regions, territories, republics) will appear. Select the desired region.
  5. In the next paragraph, select the district or city in the same way:
      When selecting a city, the next two fields are not needed.
  6. But if a region is selected, in the “Settlement” field we select a specific name. The choice is given: city, rural settlement, village.
  7. Street type. We choose the appropriate option: street, alley, avenue and others.
  8. The next item asks us to enter the name of the street in the text field. Using the keyboard, enter the name as it is.
  9. House number. Enter the number as a digit. If there are letter prefixes in the house number, enter them too and together. No separating dashes or other marks between numbers and letters. The fields “Body” and “Structure” are left empty.
  10. In the last field, enter the apartment number.
  11. Just below, click on the “Generate request” button.

Let us summarize the result obtained on the above page. The tabular form will reflect the address we are interested in and the cadastral number assigned to it in the next column.

There may be several of them - this indicates that cadastral work was carried out several times by the relevant engineer. And the first entry was made by the BTI at a time when residential premises were registered with the state and were not privatized. The second entry in the cadastre speaks of redevelopment . If it is not there, then the apartment was not registered in the cadastral register and the information is stored in the BTI.

Production time and cost

According to paragraph 9 of Art. 62 Federal Law No. 218 dated July 13, 2015, issuing an extract from the Unified State Register takes no more than 3 working days. 2 days are given to transfer documents from the MFC or process the application via the Internet. In this case, the maximum period for issuing a certificate is 5 working days.

But if you choose the method of receiving it through Russian Post, then you should take into account the delivery time - it can take up to 2 weeks.

As for the cost, to obtain an extract from the Unified State Register, it is necessary to pay a state fee, the amount of which depends on the method of obtaining the document and the type of applicant.

For legal entities:

  • on paper – 2200 rubles;
  • electronic version – 600 rub.

For individuals:

  • on paper – 750 rubles;
  • electronic version – 300 rub.
