At the same time, they can transfer the balance of the property tax deduction “to previous periods, but not more than three, immediately preceding the tax period in which the transferred balance of the property tax deduction was formed.”
However, in practice, it is often not clear what is meant by the transferred deduction balance and when and for what years the transfer can be made.
Let's consider the features of transferring deductions by pensioners in various situations.

The apartment was purchased in retirement
If a pensioner bought a home while already retired, he must wait until the end of the year (this will be the year the balance is formed), and then he will be able to transfer the deduction to three years preceding the year of purchase. Example: Stroganov V.V. retired in 2018, and in 2021 he bought himself an apartment. To receive a tax deduction, Stroganov must wait until the end of the calendar year. In 2021, he can submit documents for a deduction for 2021, and also carry forward its balance to the three years preceding the year of purchase (2020): 2021, 2021, 2021.
Since in 2021 and 2021 Stroganov V.V. no longer worked, he cannot receive a deduction for these years. As a result, in 2021 Stroganov V.V. can apply for a tax refund for 2021 and 2017.
How can a pensioner receive a property tax deduction?
In some cases, not only working citizens of the Russian Federation, but also pensioners can receive a tax deduction when purchasing.
Pensioners, as a rule, do not apply for a tax deduction, because... The pension is not taxed at 13%. However, there are several cases when a pensioner still has the right to receive it.
Pensioners receiving income
First of all, we are talking about pensioners who have any additional income in addition to a pension. Such income may include:
- income from renting out an apartment
- income from the sale of property
- additional non-state pension
- salary (if tax is withheld from it)
Thus, there is a fairly large group of pensioners who can receive a deduction when buying an apartment. True, any income must be documented, i.e. provide a certificate of income from your place of work, a contract for the purchase and sale of property or an agreement for the rental of housing, as well as documents about taxes paid on these transactions, for example, tax returns.
Transfer of deduction
Non-working pensioners can carry over the tax deduction. Since January 1, 2012, the law has provided for this possibility. A pensioner can transfer the balance of the property deduction to previous years, but not more than three years.
If a pensioner purchased housing before retirement or in the year of retirement, he can carry forward the deduction to the three years preceding his retirement.
For example, citizen A. bought an apartment in 2013 and immediately retired. In 2014, he applied for a deduction for 2013, but the amount of taxes he paid for 2013 was less than the property deduction. Since he will not work next year, citizen A. can contact the Tax Service with a request to transfer the deduction to the three previous years. However, if the pensioner has already received deductions for these years, the transfer will not be possible.
It is important to note that the number of years of possible deduction transfer is counted from the date of purchase of the property. For example, in 2012, citizen A. bought himself an apartment and in the same year he retired. In 2014, Yablokov submitted documents for the deduction. Because he did not do this immediately after the year of purchase of the apartment (the year the remainder of the deduction was formed), but missed a year, then he will be able to return the tax only for two years.
Work and pension
Until recently, working pensioners were not entitled to a tax deduction, but since 2014 this rule has been abolished. For working pensioners, the procedure for obtaining a deduction is no different from the standard one. You can learn more about how to submit documents to the tax office here.
The apartment was purchased before retirement or in the year of retirement
If a pensioner purchased housing and retired in subsequent years, then he can, without waiting for the end of the calendar year, exercise the right to transfer and receive a deduction for the last 4 calendar years. Letter of the Ministry of Finance of Russia No. 03-04-05/40681 dated July 12, 2016.
Example: In 2021 Chizhov A.V. I bought an apartment for 2 million rubles. At the beginning of 2021, Chizhov submitted a 3-NDFL declaration for 2021 to the tax office and received part of the property deduction.
In February 2021, Chizhov retired and had the opportunity to transfer the balance of the deduction. In March 2021, Chizhov submitted documents for a tax refund for 2021, 2021, 2021 (since he had already received a deduction for 2020).
However, if the apartment was purchased in the year of retirement, then to submit documents you will need to wait until the end of the calendar year.
Example : In mid-2021, Grushev I.A. bought an apartment and retired at the end of 2021. Since the apartment was purchased in the year of retirement, Grushev must wait until the end of the calendar year to receive the deduction.
At the beginning of 2021, Grushev can submit a declaration and documents for property deductions for 2021, 2021, 2021, 2021 (using the right to transfer the deduction).
It is also important to note that even if the retiree has already received a deduction for the years for which the rollover occurs, an additional rollover is not possible.
Example: In 2021 Yablokov V.V. bought an apartment. At the end of 2021 and 2021, Yablokov submitted documents to the tax office and received part of the property deduction (he returned the tax paid for 2021 and 2021).
In 2021, Yablokov retired. After retirement in 2021, Yablokov can exercise the right to transfer the deduction and return the tax paid for the last four years (2020, 2021, 2018, 2017).

Transferring deductions for a pensioner to previous years
The right to a property deduction occurs after obtaining ownership of housing. For the DDU, this is the moment of transfer of the apartment under the Transfer and Acceptance Certificate, and for the purchase and sale agreement, this is the moment of state registration of ownership.
After the entry into force of Federal Law No. 330-FZ of November 21, 2011, Part 2 of Art. 220 of the Tax Code of the Russian Federation, and from January 1, 2012, benefits were introduced for pensioners . Yes, there must still be ownership of housing, but now pensioners can receive a property deduction for the previous three years , regardless of when exactly ownership was obtained. This means that the pensioner’s deduction will include the years when he was still working.
We read paragraph 10 of Art. 220 Tax Code of the Russian Federation:
“For taxpayers receiving pensions in accordance with the legislation of the Russian Federation, property tax deductions provided for in subparagraphs 3 and 4 of paragraph 1 of this article may be transferred to previous tax periods, but not more than three, immediately preceding the tax period in which the carried forward balance was formed property tax deductions."
Thus, a pensioner can receive a deduction for four years, counting the year in which the non-carryover balance arose.
If you didn’t use it right away
According to the regulatory authorities, a transfer back 3 years is possible only if the pensioner applies for a tax deduction in the year following the year the balance was formed.
If the taxpayer applies for a deduction in subsequent years, the number of years to which the balance can be carried forward is reduced accordingly. This rule limits the possibility of receiving a deduction to only the last four calendar years. For example, in 2021, the 2021 deduction cannot be taken under any circumstances.
At the same time, in our opinion, regardless of how many years have passed since the purchase of housing and retirement, a pensioner always has the opportunity to receive a deduction (return tax) for the last four calendar years (since the last year can always be considered the year of formation of the balance, in which the pensioner received income).

In this article we will look at the procedure for obtaining a property deduction for pensioners. The fact is that pensioners have the right to carry forward the balance of unused tax deductions back three years. A lot of questions arise about how to correctly transfer this balance. It all depends on the year the property was purchased and the year the citizen retired. Consider the following examples:
1) A citizen bought a house in March 2021. He retired in 2015 and has not worked since the same year. For how many years can he return the tax?
The right to deduction arose for the pensioner in 2021. To receive the deduction, he needs to submit a 3-NDFL declaration to the tax authority. But in order to submit it, he must wait until the end of the current year 2017 (end of the tax period).
According to the rules, the first declaration will be for 2021. When an unused balance of property deduction is formed, we have the right to transfer it back three years: 2021, 2015 and 2014. Of the years we indicated, our pensioner worked only in 2014.
In 2021, our pensioner will be able to return the tax for 2014. And he will be able to submit one tax return 3-NDFL for 2014.
If he returns to work, then he will be able to transfer the remainder of the deduction (if any) from 2014 to the next year.
2) A citizen bought a house in March 2021. Since 2015, he retired, but he still works and receives a salary.
The right to deduction arose for the pensioner in 2021. To receive the deduction, he needs to submit a 3-NDFL declaration to the tax authority. But in order to submit it, he needs to wait until the end of the current year 2017 (end of the tax period), as in the first example.
The first declaration will be for 2021. The second declaration is for 2016; third – for 2015; fourth – for 2014.
So, as we see, a pensioner can return tax for four years at once - the first year is the year the right to deduction arose and three years are the years to which tax law allows him to transfer the deduction.
Let’s conclude: from what year should we count “three years ago” in order to avoid making a mistake when transferring the right to deduction? As the Ministry of Finance of Russia writes in its letter No. 03-04-05/6179 dated February 12, 2015, the three-year period for the return of overpaid tax is counted starting from the tax period immediately preceding the tax period in which the carryover balance of the property tax deduction was formed.
What does the Ministry of Finance say about the transfer rules?

In 2015, a citizen purchased an apartment. Since February 2017, the taxpayer has been a pensioner. In 2021, the pensioner submitted a return for 2015, which created a carryover balance of the property tax deduction.
As explained by the financial department, taking into account the provisions of Art. 78 of the Tax Code of the Russian Federation, if the taxpayer applies for the transfer of the balance of the property deduction to previous tax periods not in the tax period immediately following the year in which the balance of the deduction was formed, but in subsequent years, the number of tax periods to which the above balance can be transferred, respectively decreases.
Based on the foregoing, our pensioner has the right to transfer the balance of the deduction to the tax periods of 2014 and 2013 by submitting tax returns for the corresponding tax periods in 2017. Reason: letter of the Ministry of Finance of Russia dated July 12, 2016 No. 03-04-05/40681.
But let’s complicate our task even more: a citizen bought an apartment in 2009, in 2010 he filed a declaration and returned personal income tax for 2009. He retired in 2013 and had no income until 2021. Will he be able to return the tax in the current year 2021 for any years? No, he will no longer be able to receive a deduction for 2010, 2011, 2012, although he could return the money for these periods if he contacted the tax authority in a timely manner.
How does eligibility for the deduction depend on the year of retirement?
I. A citizen bought an apartment before retirement
If a citizen bought a house in 2021 and retired in 2021, then he can begin receiving the deduction without waiting for the end of the current year 2021. Already now in 2021, he has the right to submit four 3-NDFL tax returns at once: 2021 and for 2015, 2014 and 2013.
II. A citizen bought an apartment in the year of retirement
