Concept and purpose of an apartment card

What is an apartment card?

Form No. 10 was approved by the Federal Migration Service of Russia. Contains information about all persons registered in a particular residential premises. It is issued for residents of apartment buildings.

Owners of private houses have an analogous house register and personally bear the burden of responsibility for transferring registration information to the FMS.

Why do you need an apartment card?

A card is required for:

  • privatization: everyone registered in the apartment, including children, has the right to their own share;
  • purchase and sale: you need to find out whether people currently in the army or in prison (or children in a boarding school) have been registered in this living space;
  • issuing a document confirming the status of a citizen of the Russian Federation to a minor;
  • registration of benefits for housing and communal services: the amount of the subsidy directly depends on the area of ​​the apartment itself, the composition of the owner’s family and the amount of family income;

In what cases is it required?

The apartment map recorded all the information about the persons who had ever lived and were registered in the apartment. This document was required for:

  • registration of permanent and temporary registration of citizens;
  • deregistration.

An apartment card was required for any real estate transactions. For example, when concluding a purchase and sale agreement, the future owner must make sure that no one really lives in the apartment (since all persons have already been registered) in order to avoid in the future the risk of third parties appearing who have the right to use part of the apartment or house. The document was also required when applying for housing and communal benefits.

Since the apartment card is outdated and is no longer used, banks, notaries, various departments, educational institutions and other organizations must independently request information on the registration of citizens through the interdepartmental electronic interaction system (SMEV).

Apartment card: where to get it?

The original document is located in a special file cabinet of the Criminal Code. Citizens can only count on receiving a copy of their apartment card. You must contact the housing and communal services company directly.

How can I get a copy?

Step 1. Visit the passport office with a verbal statement to provide the necessary information. The application can initially be submitted through the State Services portal.

Step 2. Present papers (the list varies):

  • passport;
  • documents on ownership of the apartment;
  • birth certificates of children or death of any family member;
  • paper confirming the registration of marriage or its dissolution;
  • guardianship or disability documents;
  • a certificate from the place of study (full-time), if the student has reached the age of majority.

Step 3. On the same day, you will be given a copy of the card or a certificate of family composition.

The refusal must be made in writing with references to the law. A refusal is considered justified for only one reason - if the applicant does not have a complete package of appropriate documents.

Subtleties of copy design

Question: Since the apartment card contains personal information of citizens, is the consent of the latter required to provide information about themselves to other people?

Answer: According to the ninth article (clause 2) of the Federal Law “On Personal Data”, any person is denied the inviolability of his personal data if this is required by the protection of the legitimate interests and rights of someone else.

Second paragraph of Art. 8 of the Law “On Information” asserts the owner’s right to receive information about all people who have ever registered in the apartment from the Federal Migration Service. In this case, this information directly affects the owner’s rights to free possession of his apartment.

Advice: Since only the owner has access to such confidential information, the buyer of the apartment will be able to get acquainted with it either together with the seller or by proxy.

To ensure that the seller does not hide the fact that someone else is registered in the apartment, realtors advise the buyer to be present when the seller receives a copy of the apartment card and to personally view it in front of him.

When you need it

Despite the fact that the document is not officially valid, it is capable of confirming legally significant facts in the past.

In the regulations governing the acquisition of citizenship by foreigners, this form is included in the list of papers with which applicants have the right to confirm residence in the territory of the Russian Federation - this is the main reason why foreigners need an apartment card in 2021.

So, according to paragraph 1 of Art. 33.1 of Law No. 62 “On Citizenship”, in order for an IG to be recognized as a native speaker of the Russian language, among other requirements is the permanent residence (currently or in the past) of the person or his ascending relatives in the territory of modern Russia. In accordance with clause 16.3 of Presidential Decree No. 1325, the documents that confirm this are considered:

  • extract from the house register;
  • a copy of the apartment card;
  • papers on military registration;
  • military ID.

It is necessary to confirm permanent residence in the Russian Federation, according to Art. 25 of the Law on Citizenship, and in the case of obtaining citizenship by a child. In accordance with paragraph 18 of Decree No. 1325, the following documents confirm this:

  • Residence permit or temporary residence permit for a child;
  • Residence permit or temporary residence permit of a parent indicating the child;
  • extract from the house register;
  • extract from the apartment card in form 10;
  • a copy of the financial personal account;
  • a copy of the detachable part of the notice of stay.

These facts establish that legislators assume that some applicants have copies of an outdated document. But if, in the case of confirmation of residence in the Russian Federation in the past, paper with an expired expiration date is suitable for NRN, then to confirm current residence, its expiration date is taken into account.

Current residence in the Russian Federation for both the NRN and the minor will be confirmed by a registration mark or a tear-off notification of arrival form. Since the legislation by default assumes the conscientiousness and reasonableness of the applicants’ actions, the place of permanent or temporary registration is recognized as the place of residence. Otherwise, you must obtain a certificate replacing an extract from the apartment card through State Services or in person from the Ministry of Internal Affairs.

Who fills out the apartment card?

Only HOA or housing management company. The completed forms are submitted to the registration authority, after which they are returned to the file cabinet of the HOA or management company.

When registering temporarily in a sanatorium, hotel or boarding house, a citizen fills out a special form. It is the responsibility of the person who accepted this form to complete temporary registration with the relevant authorities.

Card validity period

When issuing an apartment card, you should distinguish between the validity period of the original and the extract issued to citizens. The original document has no validity period and is filled out as long as there is space to enter new data. After this, the completed apartment card is handed over to the archives.

The validity period of the statement also does not imply restrictions. The relevance of the information depends on the location of presentation. Typically, the certificate is issued immediately before submitting documents. The recommended validity period should not exceed one month.

How is an apartment card issued?

Enter the following information on the form:

  • apartment address;
  • its area;
  • information about the owner;
  • name of the management company;
  • a list of registered and discharged people with the dates of their birth, registration or deregistration;
  • information about who each registered person is in relation to the owner of the property.

Changes and shelf life

Changes to the card are made by the person responsible for the maintenance, storage and accuracy of the card index of records. The basis for entering information is the provision of documents by the citizen completing permanent or temporary registration and the consent of the owner of the apartment. When making a new entry, the presence of the owner of the property is required. The situation is similar with an extract from this residential address.

The apartment card is stored for an unlimited period of time, until all registered persons leave the given place of residence. Information accumulates starting from the moment the house is put into operation and the first residents move in.

Alternative - apartment book

Since the original apartment card cannot be in hand, you can resort to one trick. You can create a so-called apartment register (similar to the house register) and register it with the Federal Migration Service. In this case, control over the registration of residents in the apartment falls on the shoulders of the owner.

What it is

This document is issued in relation to all persons who undergo the official registration procedure in the premises of municipal, private or public housing stock.

09/11/2012 The Federal Migration Service of the Russian Federation established a single sample apartment card - form 10.

A sample of this document can be found in Appendix No. 7 of the administrative regulations of the Federal Migration Service of the Russian Federation. Size: 21 x 14.8 cm. The form contains information about all residents who live (or have lived) in the apartment.

Consists of the following items:

  1. Name of the form.
  2. Full (indicating the city, district, etc.) address where the apartment is located.
  3. Total area.
  4. Full name of the apartment owner. If there is a long-term lease, then the details of the tenant are indicated.
  5. Name of the HOA (or other organization that provides housing services).
  6. A list of all persons registered at this address. Information about the attitude of citizens towards the homeowner should also be provided here. Persons who previously lived at the address are also included in the document, indicating the date of deregistration.

There is also Form 17, which has some differences. It was officially approved by Resolution of the Ministry of Internal Affairs No. 149. Size of this document: 21 x 15, filled out on all sides. The card presents data on residents (and discharged) citizens in chronological order.

You can obtain an extract from the housing maintenance company or on the government services website.

You will need to provide a Russian passport and documents for the apartment confirming ownership rights (warrant, purchase/sale agreement, etc.). When contacting the HOA in person, a verbal appeal will be sufficient. If the collection of documents is carried out by a legal representative, a written application will be required.

Usually, an extract is issued on the day of application (there may be a wait of several hours if the office is very busy).

In case of refusal, housing company employees must provide written confirmation of this fact, indicating the reasons and the relevant regulations. If a citizen has submitted all the necessary documents and is still refused, he can file a complaint with the court.

The law prohibits issuing original apartment cards to citizens. This document must be kept by the responsible company (homeowners association, management company, etc.). Therefore, residents can only receive the extract mentioned above.

An apartment card is an official, legally binding document that contains information about each resident registered in the apartment. One is issued for each living space and, if necessary, every owner who wishes has the opportunity to receive such a paper (extract) in hand.

The validity period of the received document is unlimited; in fact, it loses its relevance when changes occur (registration of a new tenant, deregistration of the previous one). Until October 2012, the regulations of the Federal Migration Service were in force, which included Form 10. This format has not lost its relevance since then, but has undergone some changes.

Today, there is Order of the Federal Migration Service No. 288 “On approval of the administrative regulations for the provision by the Federal Migration Service of the state service for registration of citizens of the Russian Federation at the place of stay and at the place of residence on the territory of the Russian Federation,” which approves the Regulations on the registration of PCs.

The document describes in detail the procedure for registrars who carry out registration and deregistration of citizens. And although in April 2016 the migration service ceased to exist as a registration institution, the documents it issued have not lost their relevance. In 2021, its functions are performed by the Ministry of Internal Affairs.

Clause 82 of the Regulations states that in the office work of registrars, 2 main documents are valid, similar in purpose and content. This:

  • apartment card;
  • home Book.

The house register is a document mandatory for all owners of apartments, houses, and cottages in private housing stock . And the apartment card is valid for residential premises where house books are not provided, that is, in housing construction cooperatives, state and municipal buildings, service housing, boarding schools for the disabled, the elderly, veterans, and single people.

The cards are maintained and filled out by passport officers of housing cooperatives and management companies, and then transferred to the registration authorities. If a tenant is registered or discharged, changes are made to the PC in the appropriate manner.

A card is kept for each apartment, dorm room, and communal apartment according to Form No. 10. The PC also indicates the reason for leaving. Information about citizens and children under the age of 14 is recorded - every time the child changes birth control. The child is registered according to the place of residence of his legal representative (parents, guardians, trustees).

The apartment map is the basis for filling out the arrival address sheet, which is filled out in the address and information department . This way, government agencies and authorities can track the actual stay and registration of persons in residential premises.

The apartment card itself is not issued to anyone; only an extract from it can be issued, that is, a certificate of registration, or a certificate from the place of residence in Form No. 9.

The paper is issued by the same authorized persons who are in charge of receiving and issuing documents for registration and deregistration, these can be:

  • passport specialists of housing offices servicing the house;
  • employees of the MFC or migration authorities.

An extract can be issued to the following persons:

  • those who are currently registered in the apartment;
  • who was previously registered at this address, but was deregistered as of the date of application;
  • those who are not registered now and were not registered here before, but have the right to use this living space.

Anyone included in such a list can obtain a certificate from their place of registration by applying in person or through an authorized representative.
