What is the cadastral chamber and why is it needed?

The cadastre is a single set of documents containing information about all real estate for the purpose of correct taxation. All completed and unfinished construction projects, as well as land plots, are subject to mandatory state registration. The department that maintains such records is the cadastral chamber.

Thus, this body is an official non-profit structure whose specialists are engaged in registering or deregistering real estate. The institution “Federal Cadastral Chamber of the Federal Service for State Registration, Cadastre and Cartography” has 81 branches and two call centers in the regions of Russia. This is done for the comfort of the population and optimization of work schedules.

The main differences between the cadastral chamber and the technical inventory bureau

Previously, the Technical Inventory Bureau was responsible for registering land plots. But then the Government introduced a special registration body of the Russian Register. The name of the institution remains the same, but the functions have changed. The main activity of the bureau is to carry out work on a complete description of the property in order to put it on the cadastral register. The difference between the work of the technical inventory bureau and the cadastral chamber is that the inspection stores information about lands and buildings registered only before 1998.

Main nuances of Federal Law No. 221 “On the State Real Estate Cadastre”

The technical inventory bureau can provide information about real estate only on items recorded before the specified time.

When you need to obtain a document confirming the right to real estate, you must:

  • contact a cadastral engineer from the technical inventory bureau;
  • submit documents to the multifunctional center to register the object for inventory registration.

The State Registration Service will issue documents confirming the ownership of the object.

Every year the government introduces more and more new functions for the Russian Register and the Cadastral Chamber, so now the state registration service independently requests some of the required documents for registration of real estate ownership.

But no matter how short the requested documents are, communication with engineers, registration of received passports and acts must be carried out independently.

Looking back

FSBI "FKP Rosreestr" was created in accordance with the order of the Federal Land Cadastre Service of Russia dated March 15, 2001 No. 48 and operates on the basis of the Charter approved by the order of the Federal Service for State Registration, Cadastre and Cartography dated September 1, 2011 No. P/331. Its appearance was preceded by a long history.

The need to create a prototype of the modern Unified State Register of rights to real estate and transactions with it became obvious several centuries ago. By the 17th century in Russia, any transaction for the alienation of real estate was recorded in orders. If the object of the transaction was land, the entry was made in the Local Order created in the 16th century. In 1719, a “serf office” or Chamber of Serf Affairs was established at the College of Justice. Several decades later, the execution of serfdom acts was entrusted to the civil chambers and district courts. Since the second half of the 19th century, state registration has been carried out by notaries.

After the events of the beginning of the 20th century, issues of state registration of rights to real estate in Russia lose relevance. But at the end of the same century, against the backdrop of radical transformations in all spheres of life of Russian society, they find it again.

Decrees of the President of the Russian Federation dated October 27, 1993 No. 1767 “On the regulation of land relations and the development of agrarian reform in Russia” and dated December 11, 1993 No. 2130 “On the state land cadastre and registration of documents on real estate rights” set the vector for the efforts of the state to create a unified system of registration and execution of documents on real estate rights. In July 1997, the Federal Law “On State Registration of Rights to Real Estate and Transactions with It” was adopted.

By the beginning of 2000, a system of justice institutions for state registration of rights to real estate and transactions with it was being formed in all constituent entities of the Russian Federation. In October 2004, the Federal Registration Service was created, and from the beginning of 2005 its central apparatus and territorial bodies began to work throughout the country.

In accordance with Decree of the President of the Russian Federation dated May 12, 2008 No. 724 “Issues of the system and structure of federal executive bodies,” the Federal Registration Service, which was under the jurisdiction of the Ministry of Justice of the Russian Federation, is reassigned to the Ministry of Economic Development of the Russian Federation.

By Decree of the President of the Russian Federation dated December 25, 2008 No. 1847, the Federal Registration Service is renamed the Federal Service for State Registration, Cadastre and Cartography. It is entrusted with the functions of organizing a unified system of state cadastral registration of real estate and state registration of rights to real estate and transactions with it.

Adopted on December 21, 2009, Federal Law No. 334-FZ “On Amendments to Certain Legislative Acts of the Russian Federation” provides a legislative framework for creating conditions that ensure the effective functioning of a unified federal system in the field of state cadastral registration and state registration of real estate rights.

Roles and responsibilities of the institution

For the state and land owners, the work of the accounting authority plays a big role. Since it is he who keeps inventory records of real estate and monitors the rational distribution of land plots.

In addition to this, the organization has other functions:

  1. Maintaining real estate registration. The institution can provide data on real estate that has been entered into the general database. That is why, in order to register land and housing, people turn to cadastral chambers.
  2. This organization verifies the accuracy of the data upon presentation of a document on land surveying. Land delineation is the establishment or change of plot boundaries recorded by an authorized organization.
  3. Employees correct data on land and buildings if the owner has provided new information. They also record or write off all previously recorded objects.
  4. Eliminates errors if they were made during the registration of land plots and living space.
  5. Sets the price for registered real estate objects.
  6. Considers applications from citizens and enterprises, helps resolve issues within its competence.
  7. Conducts consultations for the population.
  8. Formally requests information necessary for record keeping.

Employees of cadastral registration authorities provide advice on issues that arise in the field of land registration. Therefore, they are obliged to answer all questions of interest regarding information about the property.

You can contact the accounting authority itself for advice, or by calling, a specialist will advise on all objects of interest. Inventory registration bodies are available in all regions of our country. This is quite convenient, since the state can control the registration of land throughout Russia.

For owners, these organizations are also necessary to obtain data faster.

Main functions of the FKP

Let's take a closer look at what the cadastral chamber does. In addition to registering real estate and monitoring the rational distribution of land, the responsibilities of the FKP include:

  • registration of real estate;
  • checking the reliability of data on the delimitation of land plots;
  • correcting information about land/buildings, entering new data;
  • elimination of errors made during the registration of buildings and land plots;
  • determining the price of registered real estate;
  • consideration of citizens' applications;
  • consulting the population within the limits of their powers;
  • submitting official requests for record keeping.

Where and how are cadastral chamber services provided?

A large number of branches of the cadastral chamber makes it possible for the population to receive the necessary service in their region or city. Today, there are special structures and information portals for interaction with the cadastral chamber.

Citizens can obtain cadastral services in the following ways:

  1. Visit the nearest branch of the Cadastral Chamber or Rosreestr. For this purpose, citizens have the opportunity to make an appointment in advance.
  2. Visit to a remote MFC. The center provides basic services to Rosreestr, acting only as an intermediary in this scheme.
  3. Mailing. The documents required to receive the service can be sent by mail to the head office or the nearest branch.
  4. On-site service. For a fee, chamber staff can personally come to the client’s address. Cadastre employees visit disabled people of the first two groups and veterans completely free of charge.
  5. Electronic interaction. Citizens can send documents and receive services remotely through the Rosreestr website - https://rosreestr.ru/site/ or State Services - https://www.gosuslugi.ru/category/property.

It is easier and more convenient to receive services remotely without visiting a ward branch . However, in such cases, citizens can only receive copies of documents without original seals and signatures, which is often insufficient to complete a real estate transaction.

Make an appointment

Every citizen has the right to make a personal appointment with the Cadastral Chamber on issues of interest to him. The reception is carried out by the director or deputy of the institution in accordance with the previously approved schedule for reception of the population.

How to make an appointment with the cadastral chamber via the Internet? To do this, you need to adhere to a certain algorithm of actions:

  • enter the main page of Rosreestr - https://rosreestr.ru/site/;
  • find the item “Electronic Services” at the bottom of the page;
  • select “Offices and reception areas. Pre-registration for an appointment";
  • choose a service and a convenient time and place for you to visit;
  • enter your personal information and click the “Get coupon” button.

To have this possibility of remote recording, you need to be an authorized user of the Rosreestr website. The duration of a personal meeting on one issue at the Cadastral Chamber is no more than 30 minutes.

For personal questions, you can make an appointment in writing or orally by telephone . Moreover, no more than 3 people can sign up for one question at once. During a personal appeal, a citizen can leave a written statement on a problem that interests him, find out how to order land surveying at the cadastral chamber, how to register a property and find out other issues.

A citizen may be refused admission on the grounds that he is under the influence of alcohol or drugs, as well as in the case of a previously provided response to this appeal. All information about the interaction is reflected in the citizen’s personal reception card.

To order land surveying, a citizen must first collect the necessary documents and receive a survey document, which is drawn up by a special organization that provides such commercial services. Only after this can he apply to the Cadastral Chamber.

It is necessary to prepare in advance a certificate of ownership of the land, a passport of the copyright holder and its copy, a power of attorney for the representative if the documents will be submitted by an authorized person.

Cadastral engineers will have to issue a land survey document for the site in two copies, the first of which will be kept by the owner, and the last one will be transferred to the Cadastral Chamber.

To obtain a cadastral passport of a land plot, you need to submit a survey file to the Cadastral Chamber.

The period for obtaining a passport after submitting the documents is from 1 to 2 months . After this, the citizen will be able to register ownership of the land. The period for providing the service should not exceed 10 calendar days.

The Cadastral Chamber is a budgetary institution subordinate to Rosreestr that is responsible for recording real estate by maintaining a unified cadastral database of objects.

The Cadastral Chamber directly interacts with the population on many issues, providing them with free and paid services for registering real estate objects with the cadastral register, deregistering them, issuing the necessary documents and extracts.

What will happen to the cadastral chamber in 2021

Currently, the cadastral chamber is understood as a Federal government institution, which is entrusted with the functions of recording land plots intended for residence and business activities. It does not apply to commercial organizations and is engaged in the following:

The rights of owners to real estate are handled by Rosreestr, and cadastral registration is handled by the cadastral chamber. And quite a lot of information is duplicated in both registers, although the documents filled out are different. Therefore, the reorganization of these services was planned back in 2014, it was understood that they would be merged into one - the Unified State Register of Real Estate or EGRN. These three years were specifically allocated to convert all available information into electronic digital form (this will greatly simplify the subsequent maintenance of all necessary documentation).

  • Rosreestr: what kind of organization is it and what does it do?

    Many citizens wonder whether Rosreestr is a public or private institution. It belongs to the executive authority of Russia. This is an important service in the list of all systemic entities of the state. Many citizens wonder whether Rosreestr and the Cadastral Chamber are the same or not. Some people think that both of these organizations are engaged in the same tasks. Therefore, it does not matter which institution you contact. But that's not true. Rosreestr and the Cadastral Chamber are different organizations. Their main similar and distinctive features are shown in the table below.

    Functions of Rosreestr

    Rosreestr is a government agency belonging to the executive branch of government. It has many features such as:

    1. Operations to create a comprehensive real estate accounting system.
    2. Registration of rights to real estate.
    3. Registration of real estate transactions.
    4. Control and supervisory activities.

    To ensure the most efficient operation of Rosreestr, a body such as the Cadastral Chamber was introduced.

    Federal Cadastral Chamber - what it does

    The article will focus on the cadastral chamber, as a state budgetary institution, which, in accordance with the Law “On the State Real Estate Cadastre”, is authorized to perform certain functions of Rosreestr: it keeps records of land plots, makes changes to the real estate cadastre information, provides information about the registered lands to individuals and legal entities. First, let's look at what Rosreestr is.

    The cadastre, according to the Land Code of the Russian Federation, is a set of data into which information about real estate objects is entered and recorded for tax purposes. Thus, the real estate cadastre is a kind of database on real estate, necessary for the state to simplify the work of the tax authorities.

    The Accounts Chamber found major violations in the Rosreestr bill

    The bill also proposes to assign to the FKP the powers to carry out the cadastral division of the territory of the Russian Federation into cadastral districts, cadastral districts and cadastral quarters, maintaining and storing register files, maintaining cadastral maps. However, the Accounts Chamber notes, “the specified powers relate to state functions,” the implementation of which, according to the Budget Code, “can only be entrusted to a federal government institution,” which the FKP is not. It is also unlawful, the Accounts Chamber notes, to transfer to the FKP the powers of the operator of the federal state information system for maintaining the Unified State Register of Real Estate, since according to the law such “functions are carried out by the customer who has entered into a state contract for the creation of such an information system.”

    The bill provides for the responsibility of the FKP only for violations of the law in the provision of public services, and this, according to the Accounts Chamber, “creates risks of delegating the right to exercise state powers without assigning corresponding responsibilities to the FKP, which is not a government body.” Meanwhile, “violation of the law in maintaining the state register of real estate entails the responsibility of the state and its obligation to compensate for losses that arise.” “Thus,” Olga Fedorova concludes, “in the event of improper execution of the state powers, functions and provision of public services assigned to the institution, losses are subject to compensation from the treasury of the Russian Federation. An interesting picture emerges: the institution takes all the profits, and the state must sponsor all its activities and the treasury of the Russian Federation is responsible for the quality of work.”

    Privatization of government functions

    On the one hand, such absurdities indicate low legal literacy of the drafters of the bill, which ultimately leads to its inoperability, cadastral engineers believe. On the other hand, they say, the persistent desire of the initiators of the bill to endow the PCF with all sorts of powers may indicate their desire to “privatize” state functions in favor of the PCF. In the bill, Olga Fedorova observes a direct attempt to privatize the federal system of registration of rights and cadastral registration, taking it out of state control, possible “fraud with the use of budget funds with a subsequent decline in the quality and reliability of federal resource information and the manifestation of corruption.”

    It is significant, says Denis Krylov, director of the cadastral SRO Association OKIS, that this conclusion of the Accounts Chamber is not taken seriously by those interested in the bill. So, according to him, during the online meeting of the “Committee of the Chamber of Commerce and Industry of the Russian Federation on entrepreneurship in the field of real estate economics” that took place on Wednesday, there was practically no comment on him at all. Only the State Secretary, Deputy Head of Rosreestr Alexey Butovetsky, according to Denis Krylov, briefly noted that he looked at the report of the Accounts Chamber and believes that no one found any violations there. However, Denis Krylov believes, this is not surprising - the meeting of the Chamber of Commerce and Industry Committee was attended almost exclusively by officials and representatives of government agencies, business was represented by only two people, and two more planned speakers from associations of cadastral engineers were simply not connected to ZOOM, citing technical problems, although in Only about 20 people attended the meeting.

    At the end of June, RBC St. Petersburg sent a request to Rosreestr to respond to the claims of cadastral engineers regarding the work of the department. The department clarifies that it is currently preparing a response.

    Apartment cadastral passport: what is it for and how to get it

    A cadastral passport, like a technical passport of an object, is mandatory for purchase, sale, rental and any other official transactions. Without it, you will not be able to manage your apartment in any way. In fact, it represents a whole collection of documents. This includes the following mandatory papers:

    The cadastral passport of an apartment is a very important document necessary for making any real estate transactions. In Russian legislation, obtaining it is a relatively new practice. Therefore, the subtleties of its design, as well as its essence and characteristic features, are incomprehensible to many. In this article we will try to explain all the nuances and details associated with obtaining a cadastral passport.

    What do Rosreestr and FKP have in common?

    The Cadastral Chamber and Rosreestr are inextricably linked. FKP is one of the divisions of the state registration service and performs part of its functions.

    While Rosreestr deals with registration of rights, FKP is responsible for maintaining records of lands and real estate located on them, as well as issuing relevant documents.

    From the above it follows that both organs complement each other. The difference between them is that one of them organizes and provides a unified system of state accounting, and the second is its subordinate element.

    Find out what the Unified State Register of Real Estate is.

    What does the cadastral chamber do briefly?

    However, until now, few people know about the convenient innovations of Rosreestr. Why is Rosreestr needed at all and what is fundamentally new in it? When Rosreestr was created, two services were abolished - the Federal Agency for Geodesy and Cartography and the Federal Agency for Real Estate Cadastre. The FRS (Federal Registration Service) also ceased to exist in its previous form - it was renamed Rosreestr, and the functions of the two abolished services were transferred to it.

    Examination of land management documentation, as well as leases, easements, disputes and prohibitions are the responsibility of this institution. The cadastral chamber is under the department of this department, therefore, for cadastral registration, documents are also sent to this organization. A separate advantage of the Rosreestr service is their work on the Internet, where they managed to organize and regulate an electronic queue for the provision of all services. The specially created Internet resource service of Rosreestr introduces everyone to general information about real estate objects, provided that you know the cadastral number of the object or its address.
